    Justice Department Launches the National Extreme Risk Protection Order Resource Center

    For Immediate Release

    Saturday, March 23, 2024


    The Justice Department launched the National Extreme Risk Protection Order (ERPO) Resource Center (the Center) which will provide training and technical assistance to law enforcement officials, prosecutors, attorneys, judges, clinicians, victim service and social service providers, community organizations, and behavioral health professionals responsible for implementing laws designed to keep guns out of the hands of people who pose a threat to themselves or others.

    “The launch of the National Extreme Risk Protection Order Resource Center will provide our partners across the country with valuable resources to keep firearms out of the hands of individuals who pose a threat to themselves or others,” said Attorney General Merrick B. Garland. “The establishment of the Center is the latest example of the Justice Department’s work to use every tool provided by the landmark Bipartisan Safer Communities Act to protect communities from gun violence.”

    ERPO laws, which are modeled off domestic violence protection orders, create a civil process allowing law enforcement, family members (in most states), and medical professionals or other groups (in some states) to petition a court to temporarily prohibit someone at risk of harming themselves or others from purchasing and possessing firearms for the duration of the order.

    In 2023, the Justice Department’s Office of Justice Programs (OJP) awarded $238 million to states, territories, and the District of Columbia under the Byrne State Crisis Intervention Program (SCIP), which was created by the Bipartisan Safer Communities Act and is designed to help jurisdictions implement crisis intervention strategies, including ERPO programs. In addition, OJP awarded $4 million to support training and technical assistance under Byrne SCIP, including $2 million that was awarded to the Johns Hopkins Center for Gun Violence Solutions to establish the ERPO Resource Center. In collaboration with OJP’s Bureau of Justice Assistance (BJA), the Center will support states, local governments, law enforcement, prosecutors, attorneys, judges, clinicians, victim service providers, and behavioral health and other social service providers in their efforts to implement ERPO programs to fit local needs, share resources and promising practices with the field, and help ensure that funding received through Byrne SCIP is effectively utilized.

    “Supporting our law enforcement and community partners in curbing the scourge of gun violence is more critical than ever,” said Acting Associate Attorney General Benjamin C. Mizer. “In addition to other resources leveraged across the Justice Department, this Center will provide communities with new tools and technical assistance to help them implement effective crisis intervention strategies and reduce gun violence.”

    “OJP’s investment in ERPO programs demonstrates the Department’s commitment to addressing the gun violence crisis in the United States,” said OJP Assistant Attorney General Amy L. Solomon. “This crisis cannot be solved at one level of government. We must use all of our resources and collaborate at the federal, state, and local levels to find innovative, evidence-based, and holistic solutions to help keep American communities safe.”

    Through the Center and its newly launched website, states, local governments, law enforcement, prosecutors, attorneys, judges, clinicians, victim service providers, and behavioral health and other social service providers will have direct access to critical information that will enhance their ability to reduce firearm homicides and suicides. The website will be maintained and updated to include newly developed resources for the field created through the Center, in partnership with BJA. The website also provides a platform for the Center to highlight emerging and promising practices in successful ERPO implementation and connect states and localities to innovative strategies to reduce gun violence and save lives.

    As of this month, 21 states and the District of Columbia have enacted ERPO laws. Successful and effective ERPO implementation requires a comprehensive and holistic approach that incorporates a wide range of stakeholders. The Center is designed to provide resources consistent with that need.

    Vice President Kamala Harris will travel to Florida on Saturday where she will tout a Biden administration effort to provide "training and technical assistance" to individuals "responsible for implementing laws designed to keep guns out of the hands of people who pose a threat to themselves or others."

    The new program drew immediate backlash from some Republicans who called the effort a "massive Red Flag Operation."

    The National Extreme Risk Protection Order (ERPO) Resource Center, according to a Saturday Department of Justice press release [see this post - OB], will specifically provide assistance to law enforcement officials, prosecutors, attorneys, judges, clinicians, victim service and social service providers, community organizations and behavioral health professionals.

    "ERPO laws, which are modeled off domestic violence protection orders, create a civil process allowing law enforcement, family members (in most states), and medical professionals or other groups (in some states) to petition a court to temporarily prohibit someone at risk of harming themselves or others from purchasing and possessing firearms for the duration of the order," DOJ noted.

    During her visit to Parkland's Marjory Stoneman Douglas High School, where 17 people were killed in a February 2018 mass shooting, Harris is expected to introduce the effort and call "on states to pass red flag laws" and use federal funding to implement existing laws, according to the White House.

    Attorney General Merrick Garland said in a statement that the effort will provide "valuable resources" to those seeking to keep firearms out of the hands of those deemed a threat to themselves and others.

    "The launch of the National Extreme Risk Protection Order Resource Center will provide our partners across the country with valuable resources to keep firearms out of the hands of individuals who pose a threat to themselves or others," Garland said. "The establishment of the Center is the lates t example of the Justice Department’s work to use every tool provided by the landmark Bipartisan Safer Communities Act to protect communities from gun violence."

    Through the resource center and its website, the Justice Department noted that "states, local governments, law enforcement, prosecutors, attorneys, judges, clinicians, victim service providers, and behavioral health and other social service providers will have direct access to critical information that will enhance their ability to reduce firearm homicides and suicides."

    "The website will be maintained and updated to include newly developed resources for the field created through the Center, in partnership with [the Bureau of Justice Assistance]," the DOJ said. "The website also provides a platform for the Center to highlight emerging and promising practices in successful ERPO implementation and connect states and localities to innovative strategies to reduce gun violence and save lives."

    The creation of the resource operation quickly drew the ire of some House Republicans who blasted the effort as a "Federal Red Flag center" that the DOJ will use to "violate" the Second Amendment rights of Americans.

    What the hell is this evil? A Federal Red Flag center; We did not authorize this. Announced, of course, just hours after the omnibus passes," Kentucky GOP Rep. Thomas Massie wrote in a post to X.

    Echoing Massie, Georgia Republican Rep. Marjorie Taylor Greene expressed concern in a post on social media over how the effort could be used to target certain Americans.

    "Merrick Garland just announced a massive Red Flag Operation that the DOJ will be running by using EVERY spy tool the US government has in order to violate American’s Second Amendment!! This comes right after Johnson fully funded Biden’s weaponized DOJ!" Greene wrote on X.

    Greene's comment on the effort comes one day after she filed a motion to vacate Johnson [see ]this thread - OB], accusing him of having "betrayed" the "confidence" of the House GOP Conference by ushering through a $1.2 trillion federal funding bill to avoid a partial government shutdown.

    The Biden administration has been steadfast in its mission to implement a variety of gun control measures since President Biden took office in 2021.

    During the president's State of the Union address earlier this month, Biden called out the National Rifle Association and demanded strict gun control measures, such as banning so-called assault weapons.

    "I’m proud we beat the NRA when I signed [the] most significant gun safety law in nearly 30 years because of this Congress. We now must beat the NRA again. I’m demanding a ban on assault weapons and high-capacity magazines. Pass universal background checks," Biden said at the time.

    "None of this — none of this — I taught the Second Amendment for 12 years. None of this violates the Second Amendment or vilifies responsible gun owners," he continued.

    The DOJ did not immediately respond to Fox News Digital's request for comment about the ERPO effort.

    When it's at the state legislative level, yes, actually, it can make a difference. Sometimes just a few dozen e-mails will be enough to change a state legislator's mind on a particular vote.

    I had to dig hard to find any information about this. All I can find is rumor/hearsay that Trump supposedly said this in a private conversation with unspecified congressional people. Even if true, it proves literally nothing because part of politics is paying back your opponents in kind: when they lie to you, obviously, you lie back. A military doesn't paint its vehicles safety-orange while the enemy is concealed with camouflage. Screw that, if you use camouflage, so will I.

    Trump spoke to the NRA national convention in Houston days after the Uvalde shooting. He delivered scalding criticism of the gun-grabbing agenda, publicly, on-camera, on-record. (Not in some secret conversation with political opponents, reported third-hand by the DC rumor-mill.) That took some major swinging brass balls, because the Left was beside themselves with the usual gun-seizure frenzy they whip up in the wake of each mass shooting, especially school shootings. Unfortunately, the perp was not white, so they could only turn the frenzy-dial up to 8 or 9. They pitched a fit that Trump spoke at the NRA anyway, and then went silent about the whole thing shortly after. It's probably footnoted in their Playbook for later on during the campaign or, in the apocalyptic event that he re-takes POTUS, after he gets back into office.

    Look, I'm not going to go back and forth endlessly on this issue. Something in reality "broke" prior to Trump running for President. I can't describe it in words more precisely than that... but something broke. Clown World isn't just a term for deriding the political antics of the Ds... we really are in a darkly absurd timeline, and I have no idea how we got here. Causality, especially social-causality, is broken. Impossible things happen all the time, and things that were once commonplace have disappeared. Overnight. For that and many other reasons, I don't read the political scene in the way that was common prior to Clown World, because that calculus is broken. What Trump said or didn't say is uninteresting to me. What is interesting to me is the outcome. The outcome is that bump stocks were banned. Bump stocks are worthless, unsafe piece-of-garbage accessories whose reason-for-existing is inherently absurd. They exist to go around NFA (which itself is unconstitutional) and to make "firearm go BRRRR". If you kept one in your closet for self-defense, you're potentially putting innocents at risk because you cannot properly control the weapon while using one or, even if it can be done, that's a feat in its own right. I agree that we don't need any more bans on stuff, but I'm guessing that Trump got something in exchange for that concession (behind-closed-doors bargaining). What matters more to me than what Trump says to his political opponents in a political negotiation session, is what he says to his constituency, and how he lives up to that (or not). I share all the criticisms that anybody on this forum has for the 2-party system but, for now, Trump seems to be the closest thing to addressing the actual issues in the Swamp and all the neoCONs have boundless hatred for him, which is an enormous green check-mark in his column. I'm not a Trumper and, as I've said many times before, if you can find someone with the principles of Ron Paul, and the rockstar power of Trump, point me to that man and I will write him in for POTUS.

    I don't use google at all, haven't in years. There are other search engines which yield better results.

    Biden’s Federal ‘Red Flag’ Center Defies The Constitution In More Ways Than One

    A Democrat-controlled Congress authorized the president to give grants to states that have red flag laws, but never was he authorized to establish a federal red flag center.

    n Saturday, Vice President Kamala Harris touted the administration’s new National Extreme Risk Protection Order Resource Center, which will “support the effective implementation of state red flag laws” and “keep guns out of the hands of people who pose a threat to themselves or others.” But there is a problem: Congress never authorized the U.S. Department of Justice to create this resource center. The administration confuses “grants … to implement state … mental health courts, drug courts, veterans’ courts, and extreme risk protection order programs” with creating an entirely new center for one of these areas.

    This isn’t the first time the Biden administration has gone beyond what the law allows and done more harm than good.

    The Department of Justice press release claims that Extreme Risk Protection Orders (ERPOs, also known as red flag laws) will “reduce firearm homicides and suicides.” Surveys show likely voters support laws that “allow guns to be temporarily confiscated by a judge from people considered by a judge to be a danger to themselves or others” by at least 2-1 margins.

    But despite what the Biden administration and gun control advocates claim, all 50 states and the federal government have long made it possible to take a dangerous person’s guns away. Civil commitment laws go by various names, such as the Baker Act in Florida or the 5150 code in California.

    If you worry that someone is dangerous, you can tell the police your concerns. If the police agree that there is a “reasonable” chance the person is a danger to themselves or others, mental health professionals will evaluate the individual. If the professionals give their consent, an emergency court hearing is held. A lawyer is provided to those who cannot afford one. Judges have recourse to a wide range of options, such as outpatient mental health care or driver’s license suspension. Gun confiscation or involuntary commitment may also be options, but only after going through the proper legal process.

    Difference with Red Flag Laws

    Under red flag laws, a judge acts solely on the basis of a written complaint. He never talks to the person who made the complaint or the person against whom it was made. States vary on how quickly hearings must occur, but they all require that they take place within a month after one’s guns are taken away. But the steep cost of legal representation often deters defendants from seeking counsel, as lawyers can charge upwards of $10,000 for a hearing.

    When told that red flag laws do not entail consultation of mental health experts and that there are no court hearings before guns are confiscated, public support appears to flip. A McLaughlin & Associates survey (commissioned by the Crime Prevention Research Center) of 1,000 likely voters found 29 percent support and 47 percent oppose these laws.

    Gun confiscation isn’t a serious means of preventing suicides. People can commit suicide in many different ways, and places that have banned all guns or all handguns have seen no change in total suicides. The evidence shows suicide rates remain statistically unchanged or even slightly increased.

    Simply talking to others is important in overcoming depression, but red flag laws may make people reluctant to discuss their feelings. For example, police officers experience work-related depression at high rates but may be less likely to talk about their mental health due to red flag laws. Take away officers’ ability to carry a gun, and they might lose their jobs.

    One can also harm others without the use of a firearm, for instance, by driving a car into a crowd of people.

    Allowing for easy gun confiscation can leave good, law-abiding people defenseless. Andrew Pollack, who lost his daughter in the 2017 Stoneman Douglas High School shooting in Parkland, Florida, recently had an Extreme Risk Protection Order used against him by a neighbor in rural Oregon. When Pollack finally had his hearing in court, the judge didn’t even need to hear a defense because there was no evidence that Pollack had threatened anyone. Unfortunately, while disarmed, he faced a mountain lion outside his home. His dog tangled with the mountain lion, requiring 50 stitches on his side. As is virtually always the case, there was no punishment for the neighbors bringing the false claim.
