    That's it. This is geared for Big Pharma, not small businesses. It solves nothing. It doesn't matter if you are for it or against it (deregulation), because all it does is speed up the vaccine and other products they want the pharmaceutical cartel to bring to market. And as a side effect, it gets the Trump supporters happy and praising Trump during an election year.

    So when it comes to this the order things are fixed in matters but when it comes to open borders and the welfare state the order doesn't matter and we should just throw open the gates while we still have a welfare state?

    Considering the fact that this is about so much more than just medical regulations, the fact that deregulation of the medical field is also good and your open borders position I begin to smell an agenda that isn't liberty.

    Since the crisis began, many federal, state and local regulations argued to have stood in the way of health crisis response have been relaxed.

    What the new order more explicitly acknowledges is that the same approach can be taken with the immediate economic crisis—and then some.

    Calling the "innovation, initiative, and drive of the American people" the "greatest engine of economic prosperity the world has ever known," Trump instructs agencies to:

    "address this economic emergency by rescinding, modifying, waiving, or providing exemptions from regulations and other requirements that may inhibit economic recovery. ... They should also give businesses, especially small businesses, the confidence they need to re-open by providing guidance on what the law requires; by recognizing the efforts of businesses to comply with often-complex regulations in complicated and swiftly changing circumstances; and by committing to fairness in administrative enforcement and adjudication."

    Some agencies had already taken such temporary actions prior to the public health emergency under the auspices of far earlier Trump executive actions (like one-in, two-out). Agencies are now more aggressively directed to "determine which [rescisions, suspensions, modifications or waivers], if any, would promote economic recovery if made permanent."

    President Trump does have emergency powers that, while the “authority” might not be “total,” are nonetheless considerable. The new order expands upon that by directing agency heads to assume “to the fullest extent possible” the same emergency authorities Trump himself has invoked in recent weeks, as well as those prior authorities “otherwise available” to “support the economic response” to today’s crisis.

    Those prior authorities agencies have relied upon include provisions like the “good cause” exemption of the Administrative Procedure Act, which allows agencies to partly leapfrog public notice and comment provisions and issue so-called interim final rules instead of proposed rules. This has been problematic in terms of bypassing formal rulemaking and Congress’s duty to make law in particular, and it can be again.

    It needs to be clarified though, that, while emergency powers are invoked in the Executive Order on Regulatory Relief to Support Economic Recovery, the phrase “consistent with applicable law” appears five times.

    The use of aggressive executive power, however justified, does set up tensions for later. Just as Trump is doing now, progressives will exploit IFRs to address their future contrived crises such as climate, or what they call food and housing insecurity.

    The difference here is that while good cause and other exemptions have been exploited to expand government and its power, Trump is now uniquely using the same provisions to shrink it.

    The order also encourages agency heads “to promote economic recovery through non-regulatory actions.” That too is a good thing, but can set up clashes with Trump’s important earlier efforts such as Executive Order 13,891 on "Promoting the Rule of Law Through Improved Agency Guidance Documents" to restrain abuse of said documents (or the stuff I like to call regulatory dark matter). That state of affairs isn’t the fault of Trump, though; the problem lies in the replacement of constitutional lawmaking with an administrative state.

    Among the public protections, agencies are to "consider exercising appropriate temporary enforcement discretion or appropriate temporary extensions of time as provided for in enforceable agreements with respect to those requirements." Also in service of economic boost is a 10-point section now being referred to (but not within the text of the order itself) as a “Regulatory Bill of Rights.”

    These protections appear to be offered in the same spirit as the pursuit of liability protections for reopening businesses by some in Congress. That is, moves like the bill of rights could be seen as preemptive with respect to the missteps and misunderstandings inevitable in complying with future health-related and economic re-opening guidance. Interpretations of complicated reopening directives are likely to be as varied and conflicting as state approaches to economic re-entry.

    In their dealings with individuals, agencies in this strained environment are to be fair, transparent and prompt, and operate without "improper coercion" and "unfair surprise." These reasonable notions reinforce provisions laid out late last year in Executive Order 13,892 on "Promoting the Rule of Law Through Transparency and Fairness in Civil Administrative Enforcement and Adjudication."

    Agencies are further encouraged to “decline enforcement against persons and entities that have attempted in reasonable good faith to comply with applicable statutory and regulatory standards" as well as to publicize intent with respect to enforcement discretion. Violations of law will require proof by the agency, not proof of compliance by the public (again, in accordance with existing applicable law).

    So, while being very careful to emphasize that this does not repeal any regulations at all, here we have an order to bureaucrats not to nitpick businesses to death in the inevitable event that "reopening guidelines" issued by a thousand bureaucracies are contradictory, and no business is closed because they had to violate this hasty "guideline" to obey that one.

    Next produces a commercial for that and collagen, and Pavlov's Elephants salivate. Gee.

    Or maybe this is pablum disguised as deregulation. Read it and you discover it ends no regulations at all. It just tells bureaucrats to lay low for a while, like cops not running speed traps at the moment, but threatening "game on" when Trump and his masters are through slowing the velocity of all the currency they're printing.

    In short, this is just an increase in the arbitrariness that American jurisprudence has fallen into. Yeah, walking down the street is a violation of three felony laws. But don't worry, nobody will enforce those three felony laws--unless you pissed off somebody important. At least, not this month. Next month, when we really need the revenue, however...

    Your agenda, meanwhile, smells of covering up the true nature of Trump's actions, tarring reputations as a substitute for rational debate (is it really impossible for someone who favors open borders to have a valid opinion about something else?), and obfuscating facts with innuendo and random psychotic attacks.

    This is not deregulation. It's a vague call to temporarily ignore regulations, which has no teeth. And it's decorated with a vague call to remove regulations permanently at some unspecified future date which is very likely to be ignored. Nobody deserves to be beset upon because they refuse to celebrate this. Even if Gary Franchi does try to sound like a Plexiderm commercial while selling it (and collagen).

    In February 2020, AstraZeneca agreed to sublicense its global rights (except Europe, Canada and Israel) to Movantik (naloxegol) to Redhill Biopharma.

    In March 2020, the company announced that it would be donating PPE, including 9 million face masks, to help support various international health organisations mitigating the COVID-19 pandemic. In April, the Chief Executive, Pascal Soriot, reported that the company was working with GlaxoSmithKline and the University of Cambridge to develop a new laboratory capable of conducting 30,000 Covid-19 tests per day. The company also announced plans for a clinical trial to assess the potential use of Calquence in the treatment of Covid-19.


    Controversies

    Seroquel

    In April 2010 AstraZeneca settled a qui tam lawsuit brought by Stefan P. Kruszewski for $520 million to settle allegations that the company defrauded Medicare, Medicaid, and other government-funded health care programs in connection with its marketing and promotional practices for the blockbuster atypical antipsychotic, Seroquel. According to the settlement agreement, AstraZeneca targeted its illegal marketing of the anti-psychotic Seroquel towards doctors who do not typically treat schizophrenia or bipolar disorder, such as physicians who treat the elderly, primary care physicians, pediatric and adolescent physicians, and in long-term care facilities and prisons.

    In March 2011, AstraZeneca settled a lawsuit in the United States totalling $68.5 million to be divided up to 38 states.

    Nexium

    The company's most commercially successful medication is esomeprazole (Nexium). The primary uses are treatment of gastroesophageal reflux disease, treatment and maintenance of erosive esophagitis, treatment of duodenal ulcers caused by Helicobacter pylori, prevention of gastric ulcers in those on chronic NSAID therapy, and treatment of gastrointestinal ulcers associated with Crohn's disease. When it is manufactured the result is a mixture of two mirror-imaged molecules, R and S. Two years before the omeprazole patent expired, AstraZeneca patented S-omeprazole in pure form, pointing out that since some people metabolise R-omeprazole slowly, pure S-omeprazole treatment would give higher dose efficiency and less variation between individuals.[86] In March 2001, the company began to market Nexium, as it would a brand new drug.

    The (R)-enantiomer of omeprazole is metabolized exclusively by the enzyme CYP2C19, which is expressed in very low amounts by 3% of the population. Treated with a normal dose of the enantiomeric mixture, these persons will experience blood levels five-times higher than those with normal CYP2C19 production. In contrast, esomeprazole is metabolized by both CYP2C19 and CYP3A4, providing less-variable drug exposure.[88] While omeprazole is approved only at doses of up to 20 mg for the treatment of gastroesophageal reflux,[89] esomeprazole is approved for doses up to 40 mg.

    In 2007, Marcia Angell, former editor-in-chief of the New England Journal of Medicine and a lecturer in social medicine at the Harvard Medical School, said in Stern, a German-language weekly newsmagazine, that AstraZeneca's scientists had misrepresented their research on the drug's efficiency, saying "Instead of using presumably comparable doses [of each drug], the company's scientists used Nexium in higher dosages. They compared 20 and 40 mg Nexium with 20 mg Prilosec. With the cards having been marked in that way, Nexium looked like an improvement – which however was only small and shown in only two of the three studies."

    Bildman fraud, and faithless servant clawback

    On 4 February 1998, Astra USA sued Lars Bildman, its former president and chief executive officer, seeking $15 million for defrauding the company. The sum included $2.3 million in company funds he allegedly used to fix up three of his homes, plus money the company paid as the result of the EEOC investigation. Astra's lawsuit alleged Bildman sexually harassed and intimidated employees, used company funds for yachts and prostitutes, destroyed documents and records, and concocted "tales of conspiracy involving ex-KGB agents and competitors. This was in a last-ditch effort to distract attention from the real wrongdoer, Bildman himself." Bildman had already pleaded guilty in US District Court for failing to report more than $1 million in income on his tax returns; in addition, several female co-workers filed personal sexual-harassment lawsuits.

    In Astra USA v. Bildman, 914 N.E.2d 36 (Mass. 2009), applying New York's faithless servant doctrine, the court held that a company's employee who had engaged in financial misdeeds and sexual harassment must "forfeit all of his salary and bonuses for the period of disloyalty." The court held that this was the case even if the employee "otherwise performed valuable services," and that the employee was not entitled to recover restitution for the value of those other services. The decision attracted a good deal of attention by legal commentators.

    Study

    In 2004, University of Minnesota research participant Dan Markingson committed suicide while enrolled in an industry-sponsored pharmaceutical trial comparing three FDA-approved atypical antipsychotics: Seroquel (quetiapine), Zyprexa (olanzapine), and Risperdal (risperidone). University of Minnesota Professor of Bioethics Carl Elliott noted that Markingson was enrolled in the study against the wishes of his mother, Mary Weiss, and that he was forced to choose between enrolling in the study or being involuntarily committed to a state mental institution. A 2005 FDA investigation cleared the university. Nonetheless, controversy around the case has continued. A Mother Jones article resulted in a group of university faculty members sending a public letter to the university Board of Regents urging an external investigation into Markingson's death.

    It can't be any more disingenuous, no matter who is doing it. Unemployment number are meaningless when the economy is shutdown. It is not an indicator of anything other than the shutdown. "OMG, we told everyone to shutdown and now everyone is shutdown! The horror!"

    And the game is so obvious. Blue states keep the shutdowns and pain going as long as they can, so that they can grab power too, and then blame the unemployment and economy on Trump.
