    Mark and Patricia McCloskey say they were defending themselves against violent demonstrators

    St. Louis Circuit Attorney Kim Gardner said Monday she's charging the couple who flashed guns at a crowd marching to the mayor's office last month with felony unlawful use of a weapon.

    Gardner, the city's top prosecutor, told The Associated Press that Mark and Patricia McCloskey also faced a misdemeanor charge of fourth-degree assault over the June 28 incident. "It is illegal to wave weapons in a threatening manner -- that is unlawful in the city of St. Louis," Gardner said.

    However, the McCloskeys have said many times they were defending themselves, with tensions high in St. Louis and other cities over race and law enforcement. They said that the crowd of demonstrators broke an iron gate marked with "No Trespassing" and "Private Street" signs, and that some violently threatened them.

    I don't think that @TheCount is showing enough outrage for the anti 2nd Amendment harassment that this couple is facing. TheCount should spend equal time and outrage on this thread as the Portland arrest thread.

    It'll get dropped quietly in the future when things cool down. That is how it always goes in cases like this. Worse case they get a pardon. They didn't break any laws.

    That said the wife needs to learn to keep her finger off the trigger.

    All they will remember is they got arrested for defending their home against a violent mob.

    I think I would have hung back, under cover, armed and ready if anybody crossed the line.

    Well I certainly wouldn't have run out in the yard like an idiot with my finger on the trigger waving a handgun around, even thought it is legal and I support their right to do it. I also wouldn't have engaged these "protesters" at all. If they trespassed on my property with intent to damage it, they would be dealt with as the law allows me to. I don't look for trouble. but can handle it. My state as many do explicitly allows the use of deadly force to prevent arson and property damage.

    I think that they were foolish in how they went about things, but why should we hold private citizens defending their homes to a higher standard than we hold government-trained individuals such as law enforcement?

    Missouri Attorney General Eric Schmitt on Monday moved to dismiss charges brought by St. Louis’ top prosecutor against a couple who pointed guns at a crowd marching to the mayor’s home last month, Fox News has learned.

    St. Louis Circuit Attorney Kim Gardner, the city’s top prosecutor, said Mark and Patricia McCloskey – both personal injury attorneys in their 60s – will be charged with felony unlawful use of a weapon following the June 28 incident.

    "It is illegal to wave weapons in a threatening manner -- that is unlawful in the city of St. Louis," Gardner said in a statement. She added that she was recommending a diversion program as an alternative to jail if the McCloskeys are convicted.

    Gardner declined to discuss to why Missouri’s “castle doctrine,” a law that justifies deadly force for those who are defending their homes from intruders, didn’t apply.

    Within hours of the ruling, Missouri Attorney General Eric Schmitt filed a brief seeking to dismiss Gardner’s charges against the McCloskeys on the grounds that their Second Amendment rights are being violated.

    “The right to keep and bear arms is given the highest level of protection in our constitution and our laws, including the Castle Doctrine, which provides broad rights to Missourians who are protecting their property and lives from those who wish to do them harm,” Schmitt said in a prepared statement provided to Fox News.

    “Despite this, Circuit Attorney Gardner filed suit against the McCloskeys, who, according to published reports, were defending their property and safety. As Missouri’s Chief law enforcement officer, I won’t stand by while Missouri law is being ignored,” Schmitt said.

    The brief filing says the attorney general “respectfully requests that the Court dismiss this case at the earlier possible opportunity.”

    The McCloskeys have said they were defending themselves, with tensions high in St. Louis amid nationwide police protests sparked by the police custody death of George Floyd. The McCloskeys said that the crowd of demonstrators broke an iron gate marked with "No Trespassing" and "Private Street" signs and that some violently threatened them.

    An attorney for the couple, Joel Schwartz, called the decision to charge "disheartening as I unequivocally believe no crime was committed."

    I’m sure there are a few of you out there that don’t think CCW insurance is even necessary. For some of you, this may actually be true, but only if you’re somehow stuck in a state that doesn’t recognize the Second Amendment and you are limited to shooting your firearms at the range.

    On top of that, you also need to have decided that you will never use a firearm in self-defense, even at home. If you meet those conditions, then CCW insurance might not be for you.

    For literally everyone else, you should probably at least check out the most basic options available, even if you don’t carry, concealed or otherwise, because if you ever need to discharge your firearm, whether it’s at home, in your car, or in the sketchy parking lot outside of that equally sketchy Denny’s, you’ll wish you were covered.
