It wasn't forced entry and you have no proof. That's what it's about. The use of force and not some legal mumbo jumbo.
My facts are not wrong and you have no proof or you would have presented it.
That you want the repulsive birth mother who encourages sleazy behavior and lied about the birth father drugging and raping his daughter is disgusting.
It's about what the birth parents are doing now and not something that happened over 15 years ago. The birth mother is constantly making sleazy decisions that will do her daughter harm. The birth father is trying to protect his daughter from that sleazy behavior. That's what it comes down to.
The judges have to review the case because the law, not what is justice mind you, says convicted of rape can't get custody. Dunno if that is 100% the case or not.
As far as the legal law in that state says it's rape just because of the age. A couple hundred miles over it isn't.
I'm defining it as forced. He said, she said.
So yes to 2 different definitions.

Okay. I certainly see the mom as having made some mistakes. Not sure I'd call them hypocrisy. For me the word "hypocrisy" has a particular meaning. "Don't you dare do what I do or what I did and still justify myself doing." Assuming the worst from the mom....did she try to get full custody? Nope. Did she freak out that her underage daughter was acting as she probably did at that age? Nope. Dad on the other hand "OMG! My 14 year old girl is kissing and getting felt up by some 17 year old and posting pictures of herself twerking on TikTok! The world is coming to an end!"
And yes, I've seen a case where the roles were reversed. Teenage boy was living with his dad. Mom sued to get custody. Dad had been going pro se and missed a filing deadline. I was brought in at the last minute. I talked to the other lawyer (female) about the case before the hearing. She was like "Do you know what's going on in that house? The son posted a video on Facebook holding a bong and saying that he was high a fvck." I went back to talk to the father and son about that. (Nothing worse than clients that don't tell you everything before trial). The boy dropped his head and admitted he'd done that. But then he was like "But I'm scared to live with my mom and her new husband. He put a gun up to the head of one of the other children and pulled the trigger. The gun was empty but the other kid didn't know it." I went back to the lady lawyer and asked her if she knew that. Her face dropped in embarrassment. She said "Yes I did read the CPS file and that was disturbing. Let me talk to the son." Father and son agreed. She told the son "Here's my card. If anything happens you just call me right away." Like she was going to do anything other than call 911. Anyway, the judge wasn't hearing none of any of it. The filing deadline had been missed and that was that. Years later I ran in to the father and son. He eventually got custody again and everything worked out.

Hell, dude, he pasted the whole article in the OP. I don't trust the reporter, and I don't trust any of the witnesses. I don't know if the father is protective or controlling, I don't know if the mother is concerned or just vindictive. And neither do either of you.
All I know is, she hollered rape, you doubted it, and Drake said, "Well technically..." and it has been a triggered cluster$#@! ever since.
I don't see enough to like about either the mother or the father to get that excited about the thing.
The headline was designed to push buttons. Seems to have worked.
Yeah, that. We must put the fate of children in the hands of the state because who else can endanger them and deny them their birthright over the fact that somebody didn't fill in all the blanks on the form. Never mind that was because the county denied him the information he needed to fill them in.
Pardon me, I'm digressing.
The only thing worse than letting people work these things out themselves is not letting them work these things out themselves.

My original point, which I think MOST people agree with, is that you're not guaranteed justice from the gubmint. And yes, it's a clusterf***. We've gone from "Even 12 year old girls can make adult decisions if they look old enough and make a fake ID" to "OMG! That sleezy mother let her 14 year old daughter kiss a 17 year old boy and post videos of herself twerking on TikTok. Take away that mom's parental rights!"

That shed a ton of light on the half truths presented in the OP.
The mother has not exhibited the proper behavior to raise the child. Her history after giving birth is proof of that. She does suffer mentally no doubt I don't believe her story about the birth father drugging and raping his daughter and neither did the judge as there was no evidence to suggest there was. That would lead me to not believe her story about not consenting.
Now could the birth mother, even though she comes across as unstable, be telling the truth? Could be. Anythings possible. Just because she is somewhat unbalanced doesn't mean she always makes things up. If he's done it twice, there is a possibility he's done it more than twice. Like Bill Cosby. But no proof on that either.
Any evidence on the father making poor decisions as far as raising a child the last 10-15 years?

He said this wrong decision is proof justice isn't guaranteed by a court. You said the fact that a good decision was overturned is proof justice isn't guaranteed by a court. My own life experience is proof justice isn't guaranteed by a court.
We all agree. And you know it.
We don't have to attempt to retry the whole case (without direct access to the evidence or the ability to cross examine the witnesses) to determine who's right for the right reasons and who's right for the wrong reasons. We all agree, and we're all right. That's good enough for me.
This particular case aside:
If a 12 or 16 year old is aware enough to make herself look older, and has the know-how and the means to make a fake ID, she is obviously aware and intelligent enough (however wrong) of what she plans to do. In the business world that is called FRAUD. And in the business world, the person who commits the fraud is the guilty party, not the person(s) affected.
The "laws" are bogus. This country has among the highest incarceration rates in the world. The lazy and Section 8 gets off easy, we foot the bill, others who "should" be working get the book thrown at them without regard to the specific situation and/or all of the facts.
Like I said in my other post, people have too much free time on their hands. Offspring should be raised to understand from the start right-from-wrong, and what the word FRAUD means well before kindergarten age. Do they teach the word FRAUD in kindergarten? If not, why not?
At 12, certainly 14, definitely by 16, they should have the ability to work, deliver papers, help babysit, cut yards and rake, open lemonade stands, and whatever else will teach them responsibility. Part time as a stock-person, learning the cash register, doing basic wiring jobs, fix a leaky faucet. My grandparents owned a farm, worked it, and had offspring by the time they were in their mid teens. They didn't have time to worry about TicTok, lgbtq, or other manufactured problems of today.
The oldest profession in the world is fine by me, contract between two consenting persons. But they need to take personal responsibility, not after they turn 18 or 21, but well before that. At this rate, .Gov will raise the age yet again to 25, even 30 if humans live to be 125, just to fund their extorting revolving door.

14 year olds used to take care of their aging parents, run the farm or business when the parents couldn't, and legally marry. Now teens are kept babies until they're 18 and then are suddenly expected to be adults. You can thank the public school system for that. And girls usually mature faster than men, looks-wise, so it's not always easy to tell ages. A lot of 14 yr old girls can look very much like an 18 yr old.
.Gov has no business in marriage or families. The marriage license was originally invented to stop inter-racial marriages (interesting how no lefties ever complain about that! ) & now makes a marriage 3-sided: husband, wife, gov.
That said, I have no real opinion on this case, except that it sounds way stupid & exactly why the gov should not be part of families.
Who's right & who's wrong sounds like a mix & the main stupidity in the article is taking away a teen because they now have a cell phone???

In the business world, if a 12 year old claims to be 18, buys a house, once it's found out that the 12 year old isn't really 18 the business doesn't have a valid contract. You may think the law should work that way, but it does. In some cases one party has a greater responsibility to investigate the claims of the other party.
Here's the key. We don't expect a child to understand the full ramifications of his/her actions just because he or she has the capability to actually do the actions. A toddler is strong enough to pull the trigger on a gun. Doesn't mean he understands what's going on. And even if he understands a little bit, it doesn't mean he fully understands. Recent case I saw where the cops were arresting a dad and his son shot at the cops. I don't remember the age. 4? 6? When they got the gun away from the kid and asked him why, his reply was "I shot at the cops so they would stop arresting him and he would be free to do what he wanted." Ummm...okay. The kid "understood" enough to formulate the idea of pointing a gun at someone doing something he didn't like and pull the trigger. So....lock him up for life for attempted murder? Or in a non statist world just do whatever it is you would to to an adult that did the same thing?
Bottom line, the ability to do something is not the same as the ability to be truly responsible for doing it. That said, the important thing for ANY set of rules of behavior, whether it's state mandated or voluntary, is that the rules MUST be consistent. If you think an underage girl who makes a fake ID has shown the maturity to be able to make that decision and be responsible for it, then can't she also be responsible for her TikTok videos? And yeah, dad might not like it. But there are two parents in the situation. Dad hasn't accused mom of letting daughter upload pornhub or even having sex.
I agree that child labor laws are bogus. At age 12 I was driving a tractor. I'm PRETTY SURE kids can still work or farms. Paper routes are a thing of the past. (I worked a paper route with my 16 y/o cousin driving when I was 6. My brother and I threw the papers out the window while she was driving and we helped fold them the night before.) And of course TikTok didn't exist back then. It does now. Some kids make money on TikTok and YouTube and it's not always for shaking their butts.The "laws" are bogus. The red flag was making it about a cell phone. Obvious lack of context and the article I linked cleared it up as a cell phone used to bypass parental controls. As well as other issues.
Could have been a corrupt judge bought and paid for or some other reason. Not in this case from what we know so far.

Not porn. TikTok. Not sex with a grown man. Making out with another teenager and contacting said teenager through a cell phone. No sane person would say that justifies taking away parental rights.

I am only speaking from Personal experience when I was younger.
I lost my virginity at 19,, but had been trying since about 10 or so.

At least a few people actually get it! Dad brings gubmint into his family business because his underage daughter is acting in a more tame way then the woman he had drunk sex with when she was 16 and he was an adult. Now, whether people here think this should be the law or not, dad may very well end up a convicted felon. Stupid move on dad's part. No mater what you think of dad or mom. Dad almost got away with it because judge decided not to actually follow "the law." Now civil judge has reserved himself and state prosecutors are looking at dad. That's the legal reality. And yes, I've seen women make stupid moves like this too. Like the mom who threatened to take her ex to court because she disagreed with the exes plan to get their son caught up in math over the summer during his time. Oh, and he was the math genius and she was unable to help the kids with math post the 5th grade. Now that son is struggling in college and she calls the dad to see if he can tutor their son, which he does without telling her "I told you so" because he loves his son. Access to the courts sometimes makes people stupid.
