SAN JOSE — Early Christmas morning, shortly after she allegedly ran over the man she had been dating, Sabrina Marie Gutierrez reportedly told her mother that she had “pulled an Elsie.”
It was an apparent reference to Elsie De La Rosa, who was sentenced to prison last year for hitting and killing a friend with her car in Campbell in 2017. Records show De La Rosa, who pleaded to vehicular manslaughter, shares a child with Gutierrez’s brother.

Before the violent confrontation that left 31-year-old Ricky Martinez dead, Gutierrez reportedly called her mother to tell her the man she was dating had pointed a gun at her. In the melee that followed, Martinez shot and wounded Gutierrez’s brother; Gutierrez then fatally struck Martinez with her car.

Maria Martinez said the couple was at her home on Christmas Eve and had gotten into an argument over Instagram messages Ricky Martinez had received from other women. Gutierrez had left the house in anger, she said, but eventually returned and left with Martinez, who told his sister they were going to “work things out.”
Gutierrez’s mother, Stephanie Rivera, told police and this news organization that she got a call from her daughter at around 2 a.m. Christmas morning, saying that Martinez was pointing a gun at her.
According to the police statement, Rivera said her daughter told her, “I’m going to jail, this (expletive) has a gun and is pointing at me, I’m going to run his ass over.”

Rivera and her son then drove to East Santa Clara Street near North 26th Street, and spotted Gutierrez sitting in her 2010 Chevy Malibu with Martinez standing outside.
Rivera said she pulled up next to Martinez and that her son got out of the car and had a “short verbal confrontation” before three shots rang out. Rivera said she saw her son fall down, and she helped him get back into her car and drove him to Regional Medical Center about two miles away. She told this news organization that her son suffered gunshot wounds to his arm and thigh.

She said that neither she nor her son had ever met Martinez before the Christmas altercation.
Police said surveillance video from the area did not capture the shooting, but did record Martinez subsequently running east on East Santa Clara Street, before a Chevy Malibu pulled up on the sidewalk, blocking his path. In the footage, police said, the Chevy Malibu reverses, then drives back on to the sidewalk and “appears to run over” a running Martinez “without applying its brakes.” Police said the surveillance shows the car then sped away.
