Stormy Daniels sues Trump, says ‘hush agreement’ invalid because he never signed

    by Sarah Fitzpatrick

Adult film star Stormy Daniels sued Donald Trump Tuesday, alleging that he never signed the nondisclosure agreement that his lawyer had arranged with her.
The civil suit, filed in Los Angeles Superior Court and obtained by NBC News, alleges that her agreement not to disclose her "intimate" relationship with Trump is not valid because while both Daniels and Trump's attorney Michael Cohen signed it, Trump never did.

Stephanie Clifford, known professionally as Stormy Daniels, signed both the agreement and a side letter agreement using her professional name on October 28, 2016, just days before the 2016 presidential election. Cohen signed the document the same day. Both agreements are appended to the lawsuit as Exhibit 1 and Exhibit 2.

The "hush agreement," as it's called in the suit, refers to Trump throughout as David Dennison, and Clifford as Peggy Peterson. In the side letter agreement, the true identity of DD is blacked out, but Clifford's attorney, Michael Avenatti, says the individual is Trump.
Each document includes a blank where "DD" is supposed to sign, but neither blank is signed.
According to the lawsuit, which Avenatti announced in a tweet, Clifford and Trump had an intimate relationship that lasted from summer 2006 "well into the year 2007." The relationship allegedly included meetings in Lake Tahoe and at the Beverly Hills Hotel.

Alleged payment to porn star was illegal donation to Trump campaign, watchdog says

The call from Common Cause for criminal prosecution echoes charges against John Edwards.

    By JOSH GERSTEIN
    01/22/2018

A watchdog group filed a pair of complaints on Monday alleging that a $130,000 payment reportedly made to a pornographic film actress who claims to have had an affair with Donald Trump violated campaign finance laws.
In submissions to the Justice Department and the Federal Election Commission, Common Cause said the alleged payment to Stephanie Clifford — who uses the stage name Stormy Daniels — amounted to an in-kind donation to Trump's presidential campaign that should have been publicly disclosed in its official reports.

An attorney for Common Cause, Paul Ryan, said the payment appeared to be hush money. He compared the situation to the series of events that resulted in the prosecution of former Sen. John Edwards (D-N.C.) over nearly $1 million in payments allegedly made to cover up an affair he had with videographer Rielle Hunter during his 2008 presidential bid.
“The purpose is the heart of all this,” Ryan said. “It’s pretty obvious this payment to Ms. Clifford was intended to keep her quiet just weeks before the election so she would not damage the candidate’s effort to win the election.”

Trump Lawyer Used Private Company, Pseudonyms to Pay Porn Star 'Stormy Daniels'
Highly Cited Wall Street Journal 2h ago

President Donald Trump’s lawyer used a private Delaware company to pay a former adult-film star $130,000 in return for her agreeing to not publicly discuss an alleged sexual encounter with Mr. Trump, according to corporate records and people familiar with the matter. The lawyer, Michael Cohen, established Essential Consultants LLC, on Oct. 17, 2016, just before the 2016 presidential election, corporate documents show. Mr. Cohen, who is based in New York, then used a bank account linked to the entity to send the payment to...

CPAC speaker criticizes attendees for supporting ‘brainless, sinister, clownish thing called Trumpism’

By Brett Samuels - 02/25/18 11:52 AM EST

Charen spoke Saturday at CPAC on a panel focused on feminism and sexual abuse amid the recent #MeToo movement. Charen ripped the Republican Party for supporting politicians who are accused of sexual misconduct “because he happens to have an ‘R’ after his name.”

"I am disappointed in people on our side for being hypocrites about sexual harassers and abusers of women who are in our party, who are sitting in the White House, who brag about their extramarital affairs, who brag about mistreating women," Charen said, a likely reference to a video of Trump released during his presidential campaign in which he bragged about grabbing women.

Intended audience for headlines of scandal may have been GOP base with Christian family values and not necessarily libertarian/pragmatic minded folks.

That said, if above claims are factual, there is potential that "dirt" like this could be used to blackmail an otherwise unwilling politician to start/escalate a war to spread freedom in a country like Binomo, to start a new chapter of ISIS allied group in Syria intervention project etc. These are hypotheticals ofcourse, but there have been events like beow in news recently. So if factual, above reports will not be entirely unimportant politically.

    Jared Kushner, Shanda
How the scion of one tri-state crime family married into another, in a story equal parts ‘Sopranos’ and ‘Game of Thrones.’

    By James Kirchick

Charles Kushner seemed to have an insatiable appetite for money and power and recognized the role politics played at the nexus of both. To maximize his influence, Kushner circumvented federal campaign finance laws by funneling money to candidates and elected officials with donations made in the names of other people and through the more than 100 separate real-estate development partnerships he controlled. In one of this already absurd campaign’s more novelistic ironies, Kushner’s dirty dealings caught the attention of a young, ambitious federal prosecutor named Chris Christie, who opened up an investigation that called Kushner’s sister, Esther, and brother-in-law, Billy, as witnesses. Determined to prevent Billy from testifying, Charles set up a honey trap for his brother-in-law in a motel room—fully equipped with video cameras—and paid a prostitute $10,000. Kushner then sent a tape of the assignation to his sister, who promptly turned her brother’s attempt at blackmail over to the authorities.

So, who was Golan Cipel? McGreevy had met Cipel several years earlier in Israel, and it was Charles Kushner who sponsored the young Israeli’s work visa to the United States and then generously employed Cipel in one of his companies before the governor hired him. Some speculated that Kushner, recognizing the blackmail potential of this arrangement, persuaded Cipel to threaten McGreevy with exposure.

Mueller is reportedly investigating incidents involving Trump's personal lawyer Michael Cohen

Special counsel Robert Mueller is investigating a number of incidents involving President Donald Trump's lawyer Michael Cohen — including Cohen's role in negotiations over a potential Trump Tower in Moscow, the Washington Post reported Tuesday.
Cohen reached out to Vladimir Putin's chief spokesman in an effort to advance the building's construction after the project began to stall, according to the Post, who cited several people familiar with document subpoenas and witness interviews. Cohen said he did not recall receiving a reply from the spokesman, the Post said.

Cernovich was pondering why the media simply doesn't ask her to break the agreement? Apparently they haven't asked her that question. She would have lawyers and donors lined up for days to cover the legal fees and pay the lawsuit, so it wouldn't cost her anything.

Cernovich thinks it is because she has nothing, no hard proof, and it is better to let what is out there just marinate because people tend to imagine the worst.

Ok understood what Cernovich is speculating, this is a strange story and has many unanswered questions apparently due to secrecy clauses in NDA agreement between Stormy and Mr. "DD".

But my question was about claim made by Stormy that she was paid $130K hush money by Trump lawyer using a fake company as a cover weeks before 2016 elections . Trump lawyer claims he paid this money from his own pocket and Trump did not know about this. Do you find these to be fakenews?

RF, that is not my theory, heard about it in media and some aspects of it seem plausible provided underlying news is not fakenews.

In other news, this is hard to believe and hopefully fakenews since trump tends to hire best of the best:

    CBS News March 9, 2018

Michael Cohen used Trump Org email to arrange Stormy Daniels payment

President Trump's personal attorney, Michael Cohen, used his Trump Organization email to arrange the wire transfer of funds to a bank account shortly before he wired $130,000 to adult film star Stephanie Clifford to keep her from talking about an alleged affair she had with Mr. Trump over a decade ago, CBS News' Julia Kimani confirms.

Clifford's attorney, Michael Avenatti, sent CBS News part of an email chain that shows Cohen used a Trump Organization email to arrange the funds transfer to pay Clifford to sign a nondisclosure agreement (NDA). The exchange shows an Oct. 26, 2016 email from an employee of First Republic Bank, which confirms that "the funds have been deposited into your checking account," and she addressed the email to Cohen's Trump Organization email.

Cohen then forwarded the email to his personal email account, and then forwarded the exchange to Keith Davidson, who was Clifford's attorney at the time. Cohen had, at that point already missed two deadlines to pay Clifford because he hadn't been able to reach Mr. Trump, the Wall Street Journal reported earlier this week.
    Here's the email:

According to the Journal, Cohen wired $130,000 from First Republic Bank in October, and it was received on Oct. 27, 2016, just 12 days before Election Day.

To give credit where due, even some POTUS critics have strated to realize making this top story in media is not a winning strategy for them:

Why nobody should care about Trump's alleged affair with Stormy Daniels

    Dahleen Glanton Contact Reporter
    Chicago Tribune

Here we go again, getting sidetracked.

This time, we’re allowing a former porn star to distract us from the greatest task facing the American people — limiting Donald Trump to a one-term presidency.

Stormy Daniels isn’t going to get the job done for us. We’ve got to come at Trump with something much stronger than allegations that he slept with an adult film star a decade before he got to the White House.

Without a doubt, the allegeddetails that have seeped out thus far are pretty juicy. From the interview Daniels gave InTouch magazine in 2011, we learned that Trump allegedly was reckless enough to have sex without a condom. And that he was rather unspectacular in bed, “textbook generic,” as she called it.

We also found out that Trump was allegedly a textbook cheater as well, calling his mistress from a blocked number and assuring her that she need not worry about his wife. Melania Trump, by the way, had recently given birth to their son.
The only tidbit that has a chance of doing any harm to Trump is the allegation that he was involved in paying Daniels $130,000 in hush money days before the presidential election. But even that’s a long shot.
Daniels is suing Trump now, claiming that the agreement to keep quiet is invalid because he never signed it. She is champing at the bit to tell her version of the whole sordid affair.

As for myself, I couldn’t care less what she has to say.

    For now.

Judge denies motion to depose Trump, but Stormy Daniels’ attorney vows to refile

A federal judge on Thursday denied a motion from Stormy Daniels seeking to depose President Donald Trump and his longtime personal lawyer Michael Cohen in the case over the adult film actress’s nondisclosure agreement.

Michael Avenatti, Daniels’ attorney, filed the action in U.S. District Court in Los Angeles on Tuesday asking permission to question Trump for two hours. Avenatti also sought to depose Cohen.

According to the filing, Daniels, whose legal name is Stephanie Clifford but who goes by her stage name, wants Trump to answer questions about their alleged affair and wants Cohen to discuss the reported hush agreement he struck with her.

After the motion was struck down by a judge as premature, Avenatti vowed during a CNN interview on Thursday afternoon to re-up the legal maneuver, possibly by the end of the day.

“We can refile this motion,” he said. “That’s exactly what we’re going to do.”

David Schwartz, the lawyer who represents Cohen, told NBC host Megyn Kelly before the judge’s ruling that the motion filed by Daniels’ legal team seeking permission to question the president and Cohen under oath was a nonstarter.

“It’s absolutely not going to happen — not in this case, anyway, because the case itself is completely frivolous,” Schwartz said.

Avenatti had argued in the filing that Trump could be deposed because “a sitting president is not afforded special protection from a civil suit regarding conduct before he or she entered office.”
