    CHICAGO (AP) — Former “Empire” actor Jussie Smollett was convicted Thursday on charges he staged an anti-gay, racist attack on himself nearly three years ago and then lied to Chicago police about it.

    In the courtroom as the verdict was read, Smollett stood and faced the jury, showing no visible reaction. He and his family later left the courthouse without comment.

    The jury found the 39-year-old guilty on five counts of disorderly conduct — for each separate time he was charged with lying to police in the days immediately after the alleged attack. He was acquitted on a sixth count, of lying to a detective in mid-February, weeks after Smollett said he was attacked.

    Outside court, special prosecutor Dan Webb called the verdict “a resounding message by the jury that Mr. Smollett did exactly what we said he did.”

    Smollett “ wreaked havoc here in the city for weeks on end for no reason whatsoever,” then compounded the problem by lying under oath to the jury, Webb said.

    Defense attorney Nenye Uche said Smollett would appeal the conviction. He said Smollett was disappointed but “holding up very strong,” and is “committed to clearing his name.” He expressed confidence the actor would be cleared by an appellate court.

    “Unfortunately we were facing an uphill battle where Jussie was already tried and convicted in the media and then we had to somehow get the jury to forget or unsee all the news stories that they had been hearing that were negative for the last three years,” Uche told reporters after the verdict.

    Judge James Linn set a post-trial hearing for Jan. 27, and said he would schedule Smollett’s sentencing at a later date. Disorderly conduct is a class 4 felony that carries a prison sentence of up to three years, but experts have said if convicted, Smollett would likely be placed on probation and ordered to perform community service.

    The damage to his personal and professional life may be more severe. Smollett lost his role on the TV program “Empire” after prosecutors said the alleged attack was a hoax, and he told jurors earlier this week, “I’ve lost my livelihood.”

    The jury deliberated for just over nine hours Wednesday and Thursday after a roughly one-week trial in which two brothers testified that Smollett recruited them to fake the attack near his home in downtown Chicago in January 2019. They said Smollett orchestrated the hoax, telling them to put a noose around his neck and rough him up in view of a surveillance camera, and that he said he wanted video of the hoax made public via social media.

    Smollett testified that he was the victim of a real hate crime, telling jurors “there was no hoax.” He called the brothers “liars” and said the $3,500 check he wrote them was for meal and workout plans. His attorneys argued that the brothers attacked the actor — who is gay and Black — because they are homophobic and didn’t like “who he was.” They also alleged the brothers made up the story about the attack being staged to get money from Smollett, and that they said they wouldn’t testify against him if Smollett paid them each $1 million.

    In closing arguments on Wednesday, Webb told jurors there was “overwhelming evidence” that Smollett staged the attack, then lied to police about it for publicity. He said Smollett caused Chicago police to spend enormous resources investigating what they believed was a hate crime, and that surveillance video contradicted key moments of Smollett’s testimony.

    Asked Thursday if Smollett could be charged with perjury for lying on the witness stand, Webb said perjury charges “generally” don’t happen after a defendant is convicted, but that it was unclear what would happen in Smollett’s case.

    He also said the Chicago Police Department was vindicated by the jury’s verdict.

    “A lot of times people say, ‘well, police officers sweep things under the rug,’” he said. “This police department responded.”

    But Uche said Chicago police should have investigated the case “much more,” and that there were some witnesses who were never interviewed.

    He called the jury’s split verdict “inconsistent,” saying it made no sense for Smollett to be convicted of five counts but not the sixth charge, since “everything stems from one incident.”

    An attorney for Abimbola and Olabingo Osundairo, the brothers who testified against Smollett, said her clients “could not be more thrilled and pleased with the results.”

The biggest problem is when the facts aren't heard. The courts are the last refuge. Where facts are given a chance to be presented and a small number of people are forced to confront them.

    The decision was one the jury struggled with, the juror said.

    In the end, “we all thought we were doing Jussie a favor,” said the juror, who asked not to be named.

    That count charged the actor with lying to police during a second interview with detectives on Feb. 14 when he reported he was the victim of an aggravated battery. The other five counts of disorderly conduct Smollett was convicted of were for reporting a battery and for reporting a hate crime to other officers in the hours after the attack.

    Essentially, the jurors got hung up on the reasoning behind the last charge and why it was charged differently than the others.

    “We were told it was an aggravated battery because he said they were wearing a mask,” the juror said. But “in all [of Smollett’s] accounts of what happened, he mentioned a mask.”

    If prosecutors had charged all the battery counts the same, “I think we probably would have found him guilty” on all six, she said.

    But because Smollett does not have an extensive criminal history and the conviction is for a low-level nonviolent crime, experts do not expect that he will be sent to prison.     Hate crime hoaxer and disgraced actor Jussie Smollett has been sentenced on Thursday to 150 days in Cook County jail, 30 months of probation, pay a restitution of $120,106, and a fine of $25,000.

    The actor repeatedly shouted, “I am innocent, and I am not suicidal,” as he was hauled off to jail.

    “You’re just a charlatan, pretending to be a victim of a hate crime,” Judge Linn said to Smollett. “Your very name has become an adverb for ‘lying.'”

    “Your performance on the witness stand can only be described as pure perjury,” the judge added. “You are now a permanently convicted felon.”

    “There is nothing that I can do here today that will come close to the damage you’ve already done to your own life,” Judge Linn said before delivering the sentencing. “You turned your life upside down by your misconduct and shenanigans.”

    Judge Linn added that Smollett’s “hypocrisy is astounding,” given that the actor has taken a keen interest in social justice issues for many years, yet staged a hate crime against himself, because he “really craved attention.”

    “I believe that you did damage to real hate crime victims,” the judge said to Smollett.

    “The officer asked you a simple question. And then you start to lie and haven’t stopped lying since,” the judge said. “You’ve been lying and lying and lying about this case, and that’s why you’re here today.”

    Judge added that “This can only be described as pure perjury,” when Smollett got on the witness stand and “committed hour upon hour upon hour of pure perjury.”

    Smollett arrived late to his own sentencing, with his bodyguards knocking one photographer to the ground.

    Smollett’s sentencing comes three months after the disgraced actor was found guilty of five counts of felony disorderly conduct for filing a false police report after he hired two brothers from Nigeria to stage a fake hate crime against him.

    The actor returned to a Chicago courtroom, where he was given the chance to admit that he had lied to police about the racist and homophobic attack in January 2019.

    During the trial, prosecutors showcased how Smollett had gone through extraordinary lengths in January 2019 to stage a hate crime against himself, in which he hired and paid Nigerian brothers Abel and Ola Osundairo to carry out the attack.

    Smollett had claimed he was physically attacked by two men wearing MAGA hats who put a rope around his neck, poured bleach on him, and shouted racial and homophobic slurs at him, before eventually yelling, “This is MAGA country!” — referring to former President Donald Trump’s campaign slogan.

    The brothers later testified that Smollett gave them money to buy the rope they turned into a noose to put around his neck, and the ski masks to hide their faces.
