Trump indictment #4: 2020 election RICO conspiracy [Fulton county GA]

    [Trump indictments: index of threads]

Trump's (still impending) fourth indictment is already a farce, and it hasn't even officially happened yet.

Georgia court website briefly publishes, removes document about potential Trump charges
    https://www.reuters.com/legal/us-sta...nt-2023-08-14/
    Reuters (14 August 2023)

The Fulton County, Georgia, court's website briefly posted a document on Monday listing several criminal charges against former U.S. President Donald Trump that appeared related to his attempts to overturn his 2020 election defeat in the state, before taking the document down without explanation.

The Fulton County District Attorney's office said in a statement that no charges had been filed against Trump.

The document was dated Aug. 14 and named Trump, citing the case as "open," but is no longer available on the court's website. Reuters was not immediately able to determine why the item was posted or removed."The Reuters report that those charges were filed is inaccurate. Beyond that we cannot comment," a spokesperson for the District Attorney's office said.

A Georgia prosecutor, District Attorney Fani Willis, has been probing whether Trump and his allies illegally sought to overturn the state's 2020 election results and has been expected to seek an indictment from a grand jury this week.

If Trump is charged in Georgia, it would mark his fourth indictment in less than five months, and the second to arise from his efforts to overturn his loss to Joe Biden's in the 2020 presidential election.

The Fulton County clerk's office could not immediately be reached for comment on the docket report. Representatives for the county and Trump also could not be immediately reached for comment.

The two-page document cites the "Violation Of The Georgia Rico (Racketeer Influenced And Corrupt Organizations) Act," "Solicitation Of Violation Of Oath By Public Officer," "Conspiracy To Commit False Statements and Writings" and "Conspiracy To Commit Forgery in the First Degree," among other charges listed.

    Am I understanding this properly?

The DA's office posted a list of indictments before the grand jury ruled?

Or someone on Trump's team got hold of it, and released it early to control the news cycle. Trump has done this frequently. Bill Clinton did it all the time and was known for it.

Be that as it may, the release of Trump got illegal access to the election computers - with permission! - in a different county?! looks like an attempt to influence the grand jury illegally too. Presumably by the prosecutor - but maybe not! See next post.

I am not of the apparent opinion of a few here - I think both sides are corrupt, and am content to see them take each other down and just watch.

See http://www.ronpaulforums.com/showthr...-New-York-Post for Trump doing it too.

So far promising to be a very dirty fought case all round (if Trump didn't also release the leaks - we'll see what happens).

I think what's more likely to happen is that the democrats consolidate the establishment's power by getting rid of Trump, and someone like Pence or Chris Christie will get in and we'll lose about 15 years of progress in trying to put the neocons on the backfoot.

I can't really see that as a gain, and I would not be content with that, personally.

Does anyone still think Trump is going to be found not guilty in all these cases and be a viable candidate? It's time for him to step aside.

How would stepping aside benefit Trump as an individual?

Supporting an obvious Democratic operative and grifter like Trump isn't exactly a good strategy either.

Trump co-defendant Scott Hall pleads guilty in Georgia RICO case under condition that he testify against co-defendants
"Conditions of your probation in this sentence is that you testify truthfully at any further court proceedings..."
    https://thepostmillennial.com/trump-...-co-defendants
    {Sara Higdon | 02 October 2023}

On Friday, bail bondsman Scott Hall, one of 18 co-defendants charged alongside former President Donald Trump on election interference charges in Georgia, pleaded guilty.

Hall pleaded guilty to five misdemeanor charges of conspiracy to commit intentional interference with the performance of an election. He was sentenced to five years probation and agreed to testify in the court hearings of his co-defendants.

During the plea hearing in front of Fulton County Superior Court Judge Scott McAfee, the Fulton County District Attorney's office asked Hall, "Do you understand that conditions of your probation in this sentence is that you testify truthfully at any further court proceedings to include trials of any co-defendants that is listed on the original indictment in which you were charged?"

    He responded, "Yes, ma'am."

According to the Daily Mail, Hall was initially accused of unlawfully breaching voting machines in Coffee County in early 2021 to access voter data in an attempt to back up claims of election fraud made by Trump lawyer Sidney Powell.

On August 14, Fulton County, Georgia, Fulton County District Attorney Fani Willis indicted former President Donald Trump, Rudy Giuliani, John Eastman, Mark Meadows, Kenneth Chesebro, Jeff Clark, Jenna Ellis, Ray Smith III, Robert Sheeley, Michael Roman, David Shafer, Shawn Still, Stephen Lee, Harrison Floyd, Trevian Kutti, Sidney Powell, Cathleen Latham, Scott Hall, and Misty Hampton on charges relating to the 2020 election.

The list of charges includes a violation of the Georgia RICO Act, solicitation of violation of oath by a public officer, false statements and writings, impersonating a public officer, conspiracy to commit impersonating a public officer, forgery in the first degree, conspiracy to commit forgery in the first degree, conspiracy to commit false statements and writings, criminal attempt to commit filing false documents, conspiracy to commit filing false documents, criminal attempt to commit influencing witnesses, influencing witnesses, conspiracy to commit election fraud, conspiracy to commit computer theft, conspiracy to commit computer trespass, conspiracy to commit computer invasion of privacy, conspiracy to defraud the state, and perjury.

The indictment in Georgia was the second that former President Trump is facing in connection to the 2020 presidential election. The first is in federal court for allegedly attempting to prevent the certification of the election on January 6, 2021 [see this thread - OB].

Trump has pleaded not guilty to all charges that have been brought against him.

ATLANTA (AP) — The judge overseeing the Georgia 2020 election interference case on Wednesday dismissed some of the charges against former President Donald Trump and others, but the rest of the sweeping racketeering indictment remains intact.

Fulton County Superior Court Judge Scott McAfee quashed six counts in the indictment, including three against Trump, the presumptive 2024 Republican presidential nominee. But the judge left in place other counts — including 10 facing Trump — and said prosecutors could seek a new indictment to try to reinstate the ones he dismissed.

The ruling is a blow for Fulton County District Attorney Fani Willis, who already is facing an effort to have her removed from the prosecution over her romantic relationship with a colleague. It’s the first time charges in any of Trump’s four criminal cases have been dismissed, with the judge saying prosecutors failed to provide enough detail about the alleged crime.

The sprawling indictment charges Trump and more than a dozen other defendants with violating Georgia’s Racketeer Influenced and Corrupt Organizations Act, known as RICO. The case uses a statute normally associated with mobsters to accuse the former president, lawyers and other aides of a “criminal enterprise” to keep him in power after he lost the 2020 election to Democrat Joe Biden.

Trump won't step aside until he completes his mission of destroying the GOP and making them unelectable from here on out. It's the whole reason why the Democrats told him to infiltrate the GOP in the first place.

That would have happened if Jeb! had won in 2016.

If you really wanted to go back to making republicans "electable" you'd have to go all the way back to 2007 and convince Ron Paul not to run, because he started the disunity. (thank God)

Except Jeb isn't someone that you can turn into a gigantic cash cow like you can with Trump. Democrats fundraise and make more money off their "hatred" of Trump than anything else. That's why I refuse to take any of these indictments seriously because there's no way they want to jail the guy that makes them so much bank. It's also why I refuse to believe Trump will go away after 2024 because the Democrats need him to continue getting involved in future presidential elections so that he can screw the GOP in those elections as well.

It's also the real reason I think for J6. He didn't expect the States legislatures to change anything, I didn't either. He didn't expect Pence to do anything like Trump said, Trump already knew he wouldn't and Pence is a straight arrow.

Trump did it so he could get as many Republicans as possible to support it in a vote and then get them all removed in the most embarrassing mess possible. And some of them were going to vote for it. And Trump controlled all those federal agents infiltrating the crowd. He was the executive.

Mike Pence, Thomas Massie and Rand Paul were right not to go along with it -
it was a setup to damage conservatives by Trump.

Agreed. The people should not be allowed to vote for the candidate they want. One's political opponents have every moral right to decide their competition.
