The real villain here is the State of New York for denying sane rational people the tools with which to defend themselves.

In this case, a good OC spray, backed up with a lethal force option, would have neutralized Neely without having to go hands on.

Our defender would not be facing life in prison for controlling Neely, Neely himself would have still been alive.

A dark skin black[1] man tries to get off the train. Apparently he's going to be late for work. A mob of mostly women, some men, won't let him off. Some black police officers are standing right there and do nothing. Some (Latina?) women tell him "You are not getting off this train." Then a light skin black man keeps repeatedly saying "They lynching us out here bro." The dark skinned black man with a job says "I'm black. I understand. I understand. Bro here me out. I understand." Jordan Neely, the homeless man choked to death on the subway, sank into a deep depression after his mother was brutally murdered by his stepfather in 2007 — and was not properly treated for his mental illness, friends and family told The Post.

Neely, who died Monday afternoon after being held in a chokehold for 15 minutes by a straphanger, descended into “a complete mess” after his mother, Christie Neely, was reportedly strangled to death and then stuffed into a suitcase when he was just 14, according to his aunt, Carolyn Neely.

“My sister Christie was murdered in ‘07 and after that, he has never been the same,” Carolyn, 40, said.

“It had a big impact on him. He developed depression and it grew and became more serious. He was schizophrenic, PTSD. Doctors knew his condition and he needed to be treated for that.”

Carolyn, who described herself as Jordan’s closest living relative, said she pleaded with judges and doctors to help get the proper care for her nephew, but to no avail.

“The whole system just failed him. He fell through the cracks of the system,” she said.

Christie Neely was murdered by Shawn Southerland, then 50, who stuffed her dead body in a suitcase and threw it on the shoulder of the Henry Hudson Parkway, according to a 2012 NJ.com report.

Jordan Neely reportedly spiraled after the murder of his mother.

Jordan was even called to testify in Southerland’s murder trial when was 18.

“The relationship had been crazy… a fight every day,” he said when describing the relationship between his 36-year-old mother and Southerland, according to the news outlet.

During the trial, Jordan said he tried to say goodbye to his mother before school on April 4, 2007, but Southerland blocked him from their bedroom.

He said later that day Southerland packed up and moved out.

Southerland was found guilty of murder. He was sentenced to 30 years in prison in March 2012.

Nedra Guaba of Washington Heights, who said she wanted to be identified as a close friend of the family, said she knew Jordan’s late mother for most of her life and knew Jordan since he was 4 years old.

“He suffered so much because of what happened to his mother,” Guaba told The Post. “She was his sole support. His father sure wasn’t.”

Guaba said Jordan loved doing his Michael Jackson impersonations on the subway when he was younger but spiraled into difficulties in recent years.

“He liked to hang out at train stations,” Carolyn said. “He wasn’t aggressive. That’s not who he is. He loved to dance and that was his outlet, that was his mental outlet after his mother died.”

Jordan reportedly had been arrested numerous times.

“He really started going downhill two years ago,” Guaba said, “I would see him all the time and give him something to eat. It was like he gave up. He felt his dreams were dead. He needed his mother.”

Cops said Jordan had been living on the streets and had a recorded history of mental illness. But Guaba said he had a place to live recently but did not want to say where.

Both women said Jordan’s father had not been around much. Carolyn Neely said Andre Zachery, now 60, abandoned Jordan as a baby. Nedra said Jordan lived with his father occasionally but the two did not get along.

Carolyn said she last spoke to Jordan on Facetime seven months ago.

“He would call me. We would video chat. He’d come to me when he had a problem,” said Carolyn, who now lives in Watertown, NY.

During the last call, she said, “He was smiling. He had a beautiful smile.”

Jordan had testified his mother and Southerland met in law school. At the time she died, Christie Neely was working as a telemarketer in Manhattan. Sources said Southerland had worked for a law firm at some point.

A GoFundMe has been set up to help with funeral expenses for the Neely family.

Alberto Vazquez, a freelance journalist who filmed video of the shocking incident, told The Post Neely was unhinged, yelling at riders that he didn’t have food or drinks and “doesn’t care if he goes to jail.”

Mr. Vazquez said at the time he did not believe the 30-year-old man could die.

“None of us were thinking that,” he said. “He was moving and he was defending himself.”

He reportedly started acting erratically on the train and harassing other passengers before being restrained and ultimately choked by a straphanger, identified as a 24-year-old marine from Queens.

The marine, who was seen on video applying the chokehold, was taken into custody and later released but the DA is mulling charges, which could include involuntary manslaughter, according to experts.

Fallout: The city medical examiner ruled Neely’s death a homicide, noting he died due to “compression of neck (chokehold).” This will be weighed during the investigation into whether charges will be brought for Neely’s death.

Neely’s aunt told The Post that he became a “complete mess” following the brutal murder of his mother in 2007. She noted he was schizophrenic while suffering from PTSD and depression.

“The whole system just failed him. He fell through the cracks of the system,” Carolyn Neely said.

Law enforcement sources said Neely had “numerous” arrests on his record, including for drugs, disorderly conduct, and fare beating.

At the time of his death, Neely had a warrant out for his arrest for a November 2021 case where he was accused of assaulting a 67-year-old woman in the East Village, the sources said.

Mayor Eric Adams has said it’s important for the DA to complete the investigation into Neely’s death and not rush to conclusions.

The city medical examiner ruled Neely’s death a homicide Wednesday and said his cause of death was “compression of neck (chokehold).” Prosecutors are mulling whether to press charges against the Marine who choked Neely.

Mayor Eric Adams, in a Wednesday night interview on “CNN Primetime,” said “our hearts go out to the family in this terrible incident.”

“And the district attorney, as you stated, the medical examiner’s office just ruled the case, and now it’s in the hands of the investigators to determine exactly what happened. There’s so many unknowns at this time,” the mayor said.

Yeah. This case is nuts. Again, I understand why the marine did what he did. I also understand why Jordan acted the way he did. I wish Jordan had gotten the help he needed and the help his aunt was begging the system to give him. I wish the marine had used a seatbelt hold, but considering marines are trained to kill they probably wasn't emphasized in the training. It's not really emphasized in "sport" BJJ either. The seatbelt hold is simply a transition to get to the rear naked choke. But all of the chokes are being done in a controlled environment among friends.

Full footage that emerged on social media this Sunday revealed that marine corps veteran Daniel Penny had placed Jordan Neely in a "recovery position" after subduing him on the New York City subway earlier this week.

Jordan Neely, a 30-year-old violent homeless man and repeat offender with over 40 prior arrests, died on Monday after Penny, 24, had placed him into a chokehold on the F train. Neely had reportedly started behaving erratically and showing aggression towards other passengers.

The unearthed full footage revealed passengers complimenting Penny for taking action. It also shows Penny and one other passenger arranging Neely's body in the "recovery position" in an attempt to ensure that he would be okay. A passenger off screen can be heard saying "he'll be alright." Neely appears to be moving late in the video.

Penny had restrained Neely in a chokehold before he fell unconscious.

The former Marine was taken into custody following the incident, but was ultimately released.

On Saturday far-left activists and agitators swarmed the NYC subway, attempting to block trains, and erupting in violence.

Following the incident, woke NYC Comptroller Brad Lander decried the use of force, saying, "NYC is not Gotham. We must not become a city where a mentally ill human being can be choked to death by a vigilante without consequence."

On the other hand, former NYPD Commissioner Bernard Kerik argued that people have the right to defend themselves, slamming Lander for failing to ensure that there were enough police officers on the subway.

The night before Neely's death, a Reddit user claims that the violent homeless man attempted to shove an innocent individual waiting to board the train onto the train tracks.

Wrong argument that doesn't help Daniel Peters. This isn't about whether Jordan Neely "deserved to die." He didn't. It's whether Daniel Peters used excessive force under the circumstances. There are a lot of forces beyond Jordan Neely's control that led to this moment. He really was the happy talented (though mentally ill) young man doing the Michael Jackson impersonations on the subway until his mother was brutally murdered (ironically choked to death) by his step father. That would through a lot of people over the edge, let alone someone already marginal. His aunt begged the courts and doctors to do something about Jordan for years, but the problem wasn't taken care of. Daniel Peters didn't come to the conclusion that some people seem to be driving at that Jordan was some POS that needed to be culled. Daniel was trying to restrain Jordan but he used the wrong hold. I get it. I understand. In BJJ we are trained to go for a rear naked choke to get the tap and the win. I've never been in the military, but my guess is the marines are taught to take out the enemy as quickly and efficiently as possible, so again that would mean going for a rear naked choke. A seatbelt hold would have been more appropriate. One of the people that was holding Jordan's arms stated that he didn't see pressure on the neck. But a rear naked choke is more of a blood choke than an air choke. The pressure is on the side of the neck and not the trachea. So Jordan could have still been able to breath all while the blood supply was being cut off to his neck. I don't know enough about New York criminal law to know how all of this ties in. I am sure this was not premeditated murder. The video that @Occam's Banana just posted shows Daniel trying to revive Jordan which contrasts his actions to those of Derick Chauvin who kept his knee on George Floyd's back/neck for 1 to 3 minutes after Floyd no longer had a pulse. It's not second degree murder. The most it can be is reckless homicide. I think the attempt to revive Neely would negate the reckless homicide charge too but I'm not sure.

Bottom line takeaway. If you aren't trying to kill someone in a self defense situation, don't use a chokehold. Use a restraint hold. If the self defense situation does justify the use of deadly force then all bets are off. A self defense situation generally warrants the use of deadly force to protect your life or the life of someone else. It doesn't matter whether the person you are using the force against is a saint or an shythead.

Your statement is a rational, factual assessment of the situation, with which I mostly agree, except for the fact that the better solution all around would have been to use an OC spray and not go "hands on" at all.
