The first hearings were scheduled for today (Thursday, 09 February 2023).

    A subcommittee formed to probe the "weaponization" of the federal government will speak with two former FBI agents about the politicization of the bureau on Thursday during its first hearing.

    Former FBI agents Thomas Baker and Nicole Parker are set to testify [see this post below - OB] on a second panel of witnesses after current and former lawmakers speak on the first, a person familiar with the plans told the Washington Examiner.

    Republican Sens. Chuck Grassley (IA) and Ron Johnson (WI), along with former Democratic Rep. Tulsi Gabbard (HI), will testify to the subcommittee on an opening panel about how the federal government has worked to target political enemies.
    Grassley and Johnson each have experience probing the government; Johnson is the ranking member on the investigations subcommittee of the Senate Homeland Security and Governmental Affairs Committee, and Grassley previously chaired the Senate Judiciary Committee.

    The second panel of witnesses will feature the former agents, Baker and Parker [see this post below - OB], as well as Jonathan Turley, a George Washington University law professor who has been outspoken about what he describes as government censorship.

    Led by Rep. Jim Jordan (R-OH), who also chairs the House Judiciary Committee, the weaponization subcommittee was created to look into accusations of bias against conservatives within the federal government.

    Republicans had pointed fingers at the Justice Department for its aggressive pursuit of conservative figures during the Trump administration, and their allegations have only gotten more heated over the past several months due to controversies over the FBI’s focus on parents at school board meetings [see this thread - OB], its failure to prioritize the many attacks against anti-abortion centers, and its seemingly lenient treatment of President Joe Biden in a classified documents case [see this thread - OB], among other charges.

    But the subcommittee hearing this week could focus more broadly on establishing the need for the effort rather than on any specific line of inquiry.

    Jordan has said the Judiciary Committee has spoken with at least a dozen FBI whistleblowers about politicization within the bureau, testimony that could ultimately shape the direction of the weaponization subcommittee’s investigation.

    Two former FBI agents will detail on Thursday how the bureau has become overly political before a new "weaponization" subcommittee spearheaded by House Republicans, according to a copy of testimony obtained by the Washington Examiner.

    The ex-agents, Thomas J. Baker and Nicole Parker, are set to sharply criticize what they view as the FBI's transformation into a partisan agency they say has targeted the public and their constitutional rights, testimony shows. The hearing will also feature testimony from Sens. Chuck Grassley (R-IA) and Ron Johnson (R-WI), who is ranking member of the Senate Permanent Subcommittee on Investigations.

    "Americans have lost faith in the Federal Bureau of Investigation, an institution they once regarded as the world’s greatest law enforcement agency," Baker said in testimony. "I spent many years with the FBI and am deeply troubled by this loss of faith. Specific lapses have come to light, many of which will be focused on by this panel. But why did they happen? What changed? The answer begins days after the 9/11 attacks with a cultural change at the bureau."

    Baker's testimony targets former FBI Director Robert Mueller, who was notably appointed special prosecutor for the investigation into alleged Russian interference during the 2016 presidential election.

    "Just days into his tenure as FBI director, he was humiliated when President George W. Bush dismissed his reporting and said he wanted him to prevent another attack," said Baker, who served as an FBI special agent for 33 years. "After his experience at Camp David, Mueller resolved and resolutely set about to change the FBI 'culture.' That’s the word he used. He was going to make it into an intelligence agency, or in his repeated terminology, an 'intelligence-driven' organization."

    Among other topics, Baker slammed the FBI's Foreign Intelligence Surveillance Act warrant against ex-Trump adviser Carter Page.

    "This use of FISA against a U.S. citizen is what presents a fundamental threat to Americans’ civil liberties," said Baker. "It essentially suspends the Constitution. In 1978, reforms in response to the Church Committee’s revelations gave us the Foreign Intelligence Surveillance Act and the Foreign Intelligence Surveillance Court. For more than two decades, it was used solely, as its name implies, to gather intelligence on foreign agents resident in this country."
    Parker, an FBI agent between 2011 and 2022, will outline how her interpretation of the FBI radically changed due to the bureau's "priorities and governing principles" being "shifted dramatically," according to a copy of her testimony obtained by the Washington Examiner.

    "The FBI became politically weaponized, starting from the top in Washington and trickling down to the field offices," she said. "Although FBI employees have their first amendment rights, they are not at the liberty to allow their personal political views or preferences to determine their course of action or inaction in any investigation."

    "It’s as if there became two FBIs," she also said. "Americans see this, and it is destroying the bureau’s credibility, causing Americans to lose faith in the agency and therefore the hardworking and highly ethical agents who still do the heavy lifting and pursue noble cases. It makes it difficult for agents to do their job when the FBI loses the respect of the American people."

    Parker notably claimed that the FBI has shifted its "recruiting practices" and lowered its "eligibility requirements," which, she claimed, is "negatively impacting the agency’s performance."

    "I love the FBI I joined," said Parker. "I have treasured memories working alongside remarkable people. I’m proud to have served with honor as a special agent. And while I sincerely pray for the FBI’s future success, the FBI’s troubles of late are bigger than anything I could change. Going forward, I will continue serving others and our beloved country while honoring and celebrating the true heroes, both past and present, of the FBI."

    "When I was invited to participate in this hearing, my initial reaction was to decline the request as there may be others more capable who would do a much better job than me," she added. "I have been given the opportunity to speak up on behalf of numerous current and former bureau employees who feel similarly but do not have a voice. I am not here today to show favor to any political party — I am here to stand for the truth based on my experience at the FBI. In all humility, I hope to make an impact in creating a stronger agency which is what Americans deserve."

    The hearing is part of a broader investigation by Republicans into what they call the politicization of the FBI in recent years, and the subcommittee was authorized following a House GOP deal struck with House Speaker Kevin McCarthy (R-CA).

    House Judiciary Committee Chairman Jim Jordan (R-OH) has already fired off subpoenas to the Biden administration this Congress over the FBI. He is demanding that FBI Director Christopher Wray, Attorney General Merrick Garland, and Education Secretary Miguel Cardona hand over documents related to the alleged targeting of parents at local school board meetings [see this thread and this post - OB].

    The Washington Examiner has reached out to the FBI for comment.

    No, the agency needs to be abolished. There are no noble cases the FBI pursues.

    A “MANUFACTURED” ISSUE AND “MISAPPLIED” PRIORITIES: SUBPOENAED DOCUMENTS SHOW NO LEGITIMATE BASIS FOR THE ATTORNEY GENERAL’S ANTI-PARENT MEMO
    Interim Staff Report of the Committee on the Judiciary and the Select Subcommittee on the Weaponization of the Federal Government
    March 21, 2023

    EXECUTIVE SUMMARY

    The Committee on the Judiciary is conducting oversight of the Biden Administration’s
    use of federal law-enforcement and counterterrorism resources against parents voicing concerns
    about controversial curricula and education-related policies at local school board meetings. This
    oversight began in October 2021 following the issuance of a memorandum from Attorney
    General Merrick Garland directing the Federal Bureau of Investigation and all U.S. Attorney’s
    Offices—among other Department components—to examine and address threats posed by
    parents at school board meetings.

    Although the Biden Administration declined to cooperate with this oversight in the 117th
    Congress, whistleblower disclosures and a report commissioned by the National School Boards
    Association (NSBA) shed some light on how the Biden Administration colluded with the NSBA
    to create a justification to use federal law-enforcement and counterterrorism resources against
    parents. There were gaps in the information available to the Committee then, primarily because
    the Biden administration did not participate in the NSBA’s third-party report. On February 3,
    2023, Chairman Jordan subpoenaed the Justice Department, FBI, and Education Department for
    documents necessary to advance the Committee’s oversight and inform potential legislative
    reforms.

    From the initial set of material produced in response to the subpoenas, it is apparent that
    the Biden Administration misused federal law-enforcement and counterterrorism resources for
    political purposes. The Justice Department’s own documents demonstrate that there was no
    compelling nationwide law-enforcement justification for the Attorney General’s directive or the
    Department components’ execution thereof.

    1 After surveying local law enforcement, U.S.
    Attorney’s offices around the country reported back to Main Justice that there was no legitimate
    law-enforcement basis for the Attorney General’s directive to use federal law-enforcement and
    counterterrorism resources to investigate school board-related threats. For example:

    • One U.S. Attorney reported that “this issue was very poorly received” by his local law
    enforcement community and “described by some as a manufactured issue.”2 He
    continued: “No one I spoke with in law enforcement seemed to think that there is a
    serious national threat directed at school boards, which gave the impression that our
    priorities are misapplied.”3

    • Another U.S. Attorney’s Office reported that the local FBI field office in the area “did
    not see any imminent threats to school boards or their members . . . , nor did they
    ascertain any worrisome trends in that regard.”4

    • Local law-enforcement officials noted that local officials should properly respond to
    school board threats. In Montana, several law-enforcement offices rightly advised the
    Justice Department that “local law enforcement authorities are best suited to address
    criminal threats against school board administrators.”5

    • Most threats reported back to Main Justice had little connection to school board matters.
    For example, the Southern District of Alabama reported that although one of the school
    board member’s houses was shot at, the incident was the “unfortunate consequence of
    gun violence in the city” and not related to school board decisions or policies.6

    The documents received pursuant to the Committee’s subpoena show the absence of a
    legitimate nationwide basis for the Attorney General’s directive to insert federal law enforcement
    into local school board matters. The documents also shed light onto how the Administration
    worked with education special interests to generate the predicate for the Attorney General’s
    directive. It appears, from these documents and the information received previously, that the
    Administration’s actions were a political offensive meant to quell swelling discord over
    controversial education curricula and unpopular school board decisions. The Attorney General’s
    directive came just weeks before a pivotal gubernatorial election in Virginia, in which education
    policies were hotly debated and a local school board’s actions were under intense scrutiny.

    7 The inference from the initial tranche of subpoenaed documents is that the Justice Department’s
    actions were a reaction to these political circumstances rather than a legitimate law-enforcement
    response to any serious, nationwide threat.

    In response to the Committee’s subpoena, the FBI acknowledged for the first time that it
    opened 25 “Guardian assessments” of school board threats, and that six of these investigations
    were run by the FBI’s Counterterrorism Division.

    disclosures about the FBI’s actions, including disclosures the FBI investigated a mom because
    she belonged to a “right-wing mom’s group” and “is a gun owner” and a dad because “he rails
    against the government.” According to the FBI, none of the school board-related investigations
    have resulted in federal arrests or charges, highlighting the political motives behind the Attorney
    General’s actions. The Administration’s goal seems to have been silencing the critics of its
    radical education policies and neutralizing an issue that was threatening Democrat Party
    prospects in the close gubernatorial race in Virginia.

    This weaponization of law-enforcement powers against American parents exercising their
    First Amendment rights is dangerous. The Justice Department subjected moms and dads to the
    opening of an FBI investigation about them, the establishment of an FBI case file that includes
    their political views, and the application of a “threat tag” to their names as a direct result of their
    exercise of their fundamental constitutional right to speak and advocate for their children. The
    Committee has called on Attorney General Garland to rescind his memorandum, which he has refused to do.
    From the documents and information received pursuant to the subpoena, it is crystal clear that Attorney General Garland should rescind his unwise and unsupported directive to insert federal law enforcement into local school board matters.

    The House Committee on the Judiciary, through and with its Select Subcommittee on the
    Weaponization of the Federal Government, is charged with investigating “violations of the civil
    liberties of citizens of the United States.”9 This interim staff report fulfills the ongoing obligation
    to identify and report on instances of the weaponization of the federal government—here, the
    misuse of federal law-enforcement and counterterrorism resources against parents exercising
    their First Amendment rights at school board meetings. While the documents produced to date
    help to better understand what transpired, they do not tell the whole story. The Committee and
    the Select Subcommittee will continue to pursue the relevant facts to inform legislative reforms
    to protect American civil liberties.

    House Judiciary Committee Chairman Jim Jordan (R-OH) sent letters Wednesday to former special prosecutors Carey Dunne and Mark Pomerantz demanding documents and testimony relating to Manhattan District Attorney Alvin Bragg’s “unprecedented abuse of prosecutorial authority” amid the reported impending indictment of former President Donald Trump.

    Dunne and Pomerantz both resigned from their positions in the DA’s Office in January 2022 after Bragg’s initial reluctance to move forward with charges against President Trump.

    Since leaving the DA’s office, Dunne and Pomerantz have publicly criticized Bragg for refusing to aggressively prosecute the former president and now have even opened a law firm to bring lawsuits to prevent Trump from holding future office.

    House Judiciary Committee Chair Jim Jordan (R-OH) wrote in the letters "Your criticisms of Bragg's investigation were widely reported. It now appears that your efforts to shame Bragg have worked as he is reportedly resurrecting a so-called 'zombie' case."

    The letters asked Pomerantz and Dunne to turn over documents related to the Trump investigation, including communications with federal agencies and other staffers in the DA's office and sit for transcribed interviews by the morning of March 27.

    On Monday, Jordan, Reps. Jim Comer (R-KY) and Bryan Steil (R-WI), the chairs of the Oversight and House Administration Committees sent a letter to Bragg requesting his testimony and documents which included the communications of Pomerantz and Dunne.

    Jordan wrote, "In January 2022, soon after you took office, you expressed doubts about President Trump’s case and suspended the investigation.”

    News broke Wednesday that the grand jury investigating former President Donald Trump for his alleged involvement in a $130,000 payment to adult film actress Stormy Daniels on the eve of the 2016 election was told not to show up and would reconvene on Thursday amid reports that Manhattan District Attorney Alvin Bragg is "having trouble" convincing members of the grand jury to hear the case.

    Why it matters: House Republicans have made the FTC's investigation into Musk's purchase of Twitter one of many targets in their war against what they view as the weaponization of the U.S. government against conservatives.

    The details: The new subpoena demands a sweeping range of documents and internal communications relating to the FTC's probe, asking that they be turned over to the committee by 9 a.m. Wednesday, April 26.
