SCOTUS votes 7-2 to Keep Obamacare Individual Mandate

The Supreme Court on Thursday ruled against Texas and other Republican-led states seeking to strike down Obamacare in the law’s latest test before the nation’s highest court.

The top court voted 7-2 to reverse an appeals court ruling that had struck down the law’s individual mandate provision.

Justice Stephen Breyer, who authored the opinion of the court, said that Texas and the other states that challenged the law failed to show that they were harmed by it. In legal terms, the states failed to demonstrate that they had standing.

“Neither the individual nor the state plaintiffs have shown that the injury they will suffer or have suffered is ‘fairly traceable’ to the ‘allegedly unlawful conduct’ of which they complain,” Breyer wrote.

Do I understand correctly that their reasoning for the lack of standing is dependent on the removal of the fines attached to the individual mandate, i.e. that the individual mandate doesn't harm anyone since there's no punishment for violating it?

If so, then at the same time as ruling in favor of the mandate, it's also a rule in favor of keeping the mandate unenforceable. I'm not sure if this is really a win for the mandate if it comes with that string attached.
There is nothing to fear from globalism, free trade and a single worldwide currency, but a globalism where free trade is competitively subsidized by each nation, a continuous trade war is dictated by the WTO, and the single currency is pure fiat, fear is justified. That type of globalism is destined to collapse into economic despair, inflationism and protectionism and managed by resurgent militant nationalism.

Even if it's not legally enforceable, companies like Turbo Tax will probably do their part to make it as enforced as possible

Hmmm. Struck down on a technicality. So they never really address the question. Can the government force you to purchase a product?

And IIRC, Obamacare resulted in quite a few administrative and bureaucratic costs to the states. Is that not harm?

One of the reasons they didn't have standing was because Trump signed a law making the fine $0. So it sounds like the fine of $0 will be enforced. The articles say the case was about the individual mandate, but then they say that states like Texas were trying to strike down the whole law using the individual mandate portion, that covers things like pre-existing conditions, etc.

We have long had death and taxes as the two standards of inevitability. But there are those who believe that death is the preferable of the two. "At least," as one man said, "there's one advantage about death; it doesn't get worse every time Congress meets."

I think that perhaps Thomas took the wrong side in this case as part of their recent trend of trying to prove they are not partisan, he saw they had 5 or more votes anyway so he switched sides to show his vote couldn't be predicted.

I see this shill account is resurfacing again....

FDR? Fascist? Uh, most of the New Deal was straight out of the Communist Manifesto and springboarded from the biggest plank, a Central Bank, in the wake of the new Central Bank engineering a Depression. Granted, there's no much difference between fascism and communism (Nazi "fascists" were national socialists...it's still all authoritarian centralization of money and therefore control regardless of which -ism is applied, the revolving door between public and private should be obvious by now) but it's plain as day that New Deal policies were communist planks.

They have never yet and they never will have the sense to reflect that this hobby-horse is a manifest violation of the most important law of nature, which has established from the very creation of the world one unit unlike another and precisely for the purpose of instituting individuality."- A Quote From Some Old Book

Sadly, we Americans are gone way too far down the pussy highway to see to it that proper measures are taken to correct this felony against America.

That all aside. this leave the door wide open for reformulating the individual mandate some time down the road.

    True,

    The ultimate goal was communism

But in the Communist Manifesto Mark suggested that a free country must go through an interim process - fascism - the boiling frog syndrome step :

"The proletariat will use its political supremacy to wrest, by degree, all capital from the bourgeoisie, to centralize all instruments of production in the hands of the state…"
