    Republicans Relax : Prez Election will be decided by US House of Representatives via the 12th

    Summary

    The 12thAmendment to the Constitution requires that candidates for President and Vice President receive a majority of electoral votes (currently 270 or more of a total of 538) to be elected.

    If no candidate receives a majority, the President is elected by the House of Representatives (which occurred once, in 1825), and the Vice President is elected by the Senate (which also occurred once, in 1837). This process is known as contingent election.The 12thAmendment prescribes some contingent election procedures for the President: the President is elected from among the three candidates who received the most electoral votes; each state casts a single vote for President; a majority (26 or more) state votes is required to elect a President; the House must vote “immediately” to the exclusion of all other business, and by secret paper ballot.

    It'll never happen. You're under the mistaken impression that in determining the legitimacy of the electoral votes the 12th Amendment's vote-by-state procedure will be used, but that procedure is to be used only to choose a President after it's been previously determined that no one has received a majority of the electoral votes. The procedure for hearing and resolving objections to electoral votes is set out in 3 USC 15, which specifies that the House and Senate are to vote separately on all objections, and there's no provision for voting by state. The procedure has been used only twice since the statute was enacted in 1887, and in both instances the objections were voted on in both houses by roll call votes.     The quote is from Justice Kavanaugh's concurring opinion in the denial of an application to vacate a stay of a lower court's injunction extending the period within which absentee ballots could be received in Wisconsin. His reference to 3 USC 5 reinforces my original point that it is up to the States, not Congress, to determine the validity of the votes that chose a State's electors, and if a State meets the safe harbor deadline set out in Section 5, its determination of who its electors are "shall be conclusive, and shall govern in the counting of the electoral votes as provided in the Constitution, and as hereinafter regulated, so far as the ascertainment of the electors appointed by such State is concerned."

    In other words, your scenario in which the GOP-controlled state delegations in the House are going to elect Trump ain't gonna happen.

    You should also read Chief Justice Roberts's concurring opinion in which he noted that the Wisconsin case was different from the Pennsylvania case in which the deadline for mail-in ballots was extended: "While the Pennsylvania applications implicated the authority of state courts to apply their own constitutions to election regulations, this case involves federal intrusion on state lawmaking processes. Different bodies of law and different precedents govern these two situations and require, in these particular circumstances, that we allow the modification of election rules in Pennsylvania but not Wisconsin."
