    Man charged with firing handgun just before alleged Kyle Rittenhouse shootings

    A man has admitted being first to open fire at the Kenosha protests in the moments before accused teen gunman Kyle Rittenhouse allegedly shot and killed two people and seriously injured another, according to court documents.

    Joshua Ziminski, 35, and his wife “both admitted” to detectives that he “fired off a ‘warning shot’ into the air” during the Aug. 25 protests in Wisconsin, according to a criminal complaint obtained by The Post.

    Attorneys for Rittenhouse have called the gunshot a “pivotal moment” that left the 17-year-old alleged militia member fearing he had “no way out” as he was chased by protesters with “no way to know who fired that shot.”

    On-the-scene reporter Richie McGinniss has also said the sound of the shot was the moment Rittenhouse “went from running away to aiming his weapon” in what the teen’s attorneys insist was self-defense.

    This was the person that arguably was the instigator and cause of the Rittenhouse attack in Kenosha that led to the shootings and death. Yet he is never mentioned. This was the only reference to his name on this forum until yesterday on the Rittenhouse update thread.

    Why has this person been swept under the rug? Kind of interesting that the key player in setting off this unfortunate chain of events is rarely mentioned.

    From Rittenhouse testimony yesterday, we learned that Ziminski was the person who first confronted Rittenhouse while displaying his hand gun. He was screaming to kill him. This was when the child molesting criminal Joseph Rosenbaum ran over to try to trap Rittenhouse, and then chased Rittenhouse.

    Why wasn't Ziminski charged?

    We told you in October about the man who shot first, the night that Kyle Rittenhouse killed two men who were attacking him during the Kenosha Riots. Joshua Ziminski shot his handgun first and Kenosha Police identified him. Of course, he is a career violent criminal and was out on bond that night. Kenosha Police referred multiple charges against him including a Felony, to Kenosha DA Michael Graveley. Graveley tossed them all out with the exception of one misdemeanor count of disorderly conduct.

    Rittenhouse said he did not notice Rosenbaum until he ran out from behind the car. At that point, Joshua Ziminski, who has since been charged with disorderly conduct, stepped toward him with a pistol in his hand, causing Rittenhouse to drop the fire extinguisher he was holding and making him take a step back. Over his shoulder, Rittenhouse said he saw Rosenbaum running from the right side, saying he was "cornered."

    Ironic how the prosecution and media has repeatedly said that it was all Rittenhouse’s fault because he brought a gun. Yet what instigated the entire incident was Ziminski threatening Rittenhouse with a gun. Ziminski had the drop on Rittenhouse. It was an ambush. Ziminski’s gun was in his hand and ready, while Rittenhouse’s gun was hanging from a strap, not in his hands ready to fire.

    Yet the media completely ignores the fact that Ziminski had a gun and was threatening Rittenhouse with it.

    The FMJ thing was 1 of hundreds of BS arguments he was making that deserved to get him permanently disbarred.

    It had no relevance, no probative value, purely prejudicial.

    Right, so, since HP's generally release their full potential energy in the first target, they are likely to cause more bodily harm than a FMJ ? However an FMJ is more likely to pass through and strike another target in the path of the bullet. Do we agree there ?

    He's awaiting trial on arson charges. Binger is prosecuting him. This is why he wasn't a witness in the Rittenhouse trial.

    Yes.

    The FMJ argument by the prosecution was simply a scare tactic. It makes for anti-gun propaganda sound bytes for those ignorant of different types of bullets. It makes it sound like a military round, which it generally is, but for technical and “humanitarian” reasons. It actually makes it a less scary round in reality.

    A full metal jacket bullet (or FMJ) is a bullet that is encased in a copper-coated steel or gilding metal jacket, designed to stop the bullet from fragmenting within its target. The jacket prevents deformation of the bullet in the barrel or feed mechanism, from dirt overpressures or damage outside the gun. This reduces misfires. The jacket also prevents fragmentation, and the coating helps prevent damage to the gun barrel.

    FMJ ammunition was introduced for ostensibly humanitarian reasons, as the Hague Convention of 1899 prohibits the use of expanding or fragmenting bullets in warfare. (It is commonly but incorrectly stated that this prohibition is in the Geneva Conventions.)
