    How totalitarianism begins in the U.S.

    Stated differently, the police cannot be sued for their willful failures. The remedy for those failures — according to the court — is to elect different officials who will deploy police assets differently. Yet, the police have a moral obligation to protect lives and property. For what other purpose have we hired and empowered them?

    All persons have a natural right to protect their lives and property, especially when the government fails to do so. If its failures are systemic and repeated, it is the duty of the people to alter or abolish the government. We know this from the Declaration of Independence.


    Portland has been the center of anti-police demonstrations this summer. The neighborhood around the state capitol has endured nearly two months of nighttime demonstrations. Most of these are peaceful; some are destructive.

    Last weekend, with no notice or local consent, the U.S. Department of Homeland Security sent teams of agents — untrained in crowd control and wearing military fatigues — onto Portland’s streets. Their uniforms bore no governmental, administrative or personal names, just the word “Police” on masking tape. They descended upon the city in unmarked SUVs and began grabbing people indiscriminately off the streets, without regard to the person’s lawful presence or personal behavior.

    According to the account of one victim, he was walking peacefully in the downtown area, observing the chaos, when five masked men in fatigues exited an unmarked SUV, grabbed him and pulled him into the car. They tied his hands with plastic behind his back. They pulled his cap over his face. They kept him for two hours and then released him. They filed no charges against him.

    They had no basis for this kidnapping.

    It was a kidnapping, not an arrest. An arrest is a lawful restraint by a legitimate government authority pursuant to a warrant issued by a judge specifically naming the person to be arrested, or pursuant to probable cause of crime personally observed by the arresting officers. Neither of these was the case in Portland.

    And some victims were even less fortunate than those kidnapped. They were assaulted with pepper spray and hit with nonlethal exploding bullets that stun, hurt and disorient. The bullets can harm the eyes, heart and liver. I saw a video of a young man riding a bicycle away from the chaos. Yet, he was attacked by five of these feds.

    An Annapolis graduate and Navy veteran asked a small group of the feds by what constitutional authority they were present in Portland. They responded by pepper-spraying his face and beating his hand with a baton, shattering numerous bones in his hand.

    Portland is in America, right? What’s going on here?

    On Monday, the DHS acknowledged that these thugs are its police and said their behavior somehow will bring stability to downtown Portland. The phrase that Acting DHS Secretary Chad Wolf used — mimicking his boss — was “law and order.”

    But there is nothing lawful or orderly about what these agents did. Their activities in Portland are unlawful, unconstitutional and harmful.

    They are unlawful because federal agents are selectively arresting folks and not even pretending to be enforcing local and state laws. Under federal law, the feds may not deploy police or military domestically unless the state legislature or the state governor requests it. Neither has done so for Portland.

    The feds’ activities are unconstitutional because they are using government force to arrest people without probable cause or arrest warrants. We know there is no legal basis for these “arrests,” as they have not charged anyone. Moreover, this is so harmful and terrifying — being kidnapped, handcuffed, blindfolded, not spoken to and then released, all for no stated reason — it will chill others from public dissent.

    The First Amendment to the U.S. Constitution requires the government to protect speech, not assault those who exercise it. If these indiscriminate beatings and kidnappings are intended to deter folks from publicly dissenting, it is profoundly unconstitutional, counterproductive and will be costly to the federal government.

    Under the Constitution, the ability to regulate for health and safety belongs to the states and local governments. The feds simply do not have the lawful authority to fill in gaps in local law enforcement, no matter how offended they may be.

    This is how totalitarianism begins. The feds claim that federal property needs protection and the folks assigned to do so need help. When help arrives, it does so by surprise, under cover of darkness and shielded by anonymity. Then, the reinforcements beat and arrest and harm protesters because their bosses in Washington do not approve of the protesters’ message.

    Public dissent against the government is a core personal freedom. It is as American as apple pie. It was integral to the creation of our republic. Government repression of dissent is totalitarian. It is as un-American as the governments against which we fought world wars to preserve our core freedoms.

    If this hadn't been written by Judge Nap[1], I'd say that the author hasn't been paying much attention.

    I've come to identify this sort of thing as the "another nail in the coffin" mode of rhetoric, which could just as well be characterized by the phrase "if this goes on ..."; the former is more picturesque, although admittedly also more clichéd.

    And I increasingly find it to be silly, pointless and aggravating ...

    I understand that this way of presenting things is meant to imbue the matter with a sense of urgency (which is entirely proper), but it amounts to an exhortation to "hurry up and try to stop something that has already happened." To invoke another cliché, this mode of rhetoric is "a day late and a dollar short."

    What we need now is not (yet more) dire warnings of encroaching, but not quite fully arrived, oppression and tyranny. Such alarms only serve to reinforce the notion that things aren't quite that bad - at least, not yet - and that disaster can still be averted (at least for the time being, and perhaps only narrowly) if we can just manage to prevent this, that or the other particular "nail" from being driven any deeper. What we need now are full-throated acknowledgements that, when it comes to oppression and tyranny, we are already well in the thick of it, and that it can only get worse unless and until we accept (and begin to think and act) on the basis of that fact. What we need now are not discussions about how to avoid it, but rather, discussions about what to do (and how to do it) now that it is clear that we have utterly failed to avoid it.

    IOW: At this point, it's "all nails and no coffin" - and the rhetoric of our exhortations would do well (or at least better) to acknowledge and incorporate that fact ... (otherwise, we're just conducting fire-prevention seminars while the house is burning down around us ...)

    What if a “shadow government” that, behind the scenes, decides which politicians are elected and increases control by staging false flags, was already installed a long time ago?
    What if this “shadow government” has complete authority over the press? How could anybody know?
    A strong case could be made that the US “shadow government” is the National Security Council (NSC) that established the Federal Emergency Management Agency (FEMA) to carry out the operation.


    The NSC has the power to suspend laws (including the US Constitution), move entire populations, arrest and detain citizens without warrant or trial, seize property, food supplies, and transportation systems.
    FEMA was conceived in the Richard Nixon Administration, refined by President Jimmy Carter and given teeth in the Ronald Reagan and George Bush Administrations.
    Under emergency plans the power exists to suspend the US Constitution and turn over the reigns of government to FEMA and appoint military commanders to run state and local governments. FEMA’s powers have been established through a number of Presidential Executive Orders.

    These powers have increased considerably with successive Crime Bills, (particularly in 1991 and 1993), including the possibility to seize property of criminals, and participants in demonstrations.

    EO #12656 - gave the NSC the power to suspend the US Constitution, install martial law and bring FEMA into action.
    EO #10997 – gives government the right to take over all electrical power, gas, petroleum, fuels and minerals.
    EO #10998 – gives government the right to take over all food resources and farms.
    EO #11001 – gives government the right to take over all health, education and welfare functions.

    FEMA twice almost took control of the US: in 1984 under President Reagan, and in 1990 and 1992 under President Bush Sr. FEMA was also brought into action in the 1989 Loma Prieta earthquake in the San Francisco Bay Area.
    In April 1984, President Reagan signed Presidential Director Number 54 that involved a secret national "readiness exercise", code name REX 84, to suspend the US Constitution, declare martial law, place military commanders in charge of state and local governments, and detain large numbers of American citizens for the case the NSC declares a "State of National Security".

    In 1990, FEMA was on standby when Desert Storm was enacted. Prior to the (first) invasion of Iraq, new legislation was drafted to increase the powers of the NSC and FEMA.
    In 1992, during the Los Angeles Rodney King riots, FEMA was ready to take control if the protests had spread to other cities.

    The first targets in a FEMA “emergency” are Hispanics and Blacks, the FEMA orders call for them to be rounded up and detained.
    Operation Trojan Horse was designed to identify potential opponents to martial law. The program lures potential protesters to forums. The protesters are registered so they can be targeted in case of an “emergency”.
    “Dangerous” people include tax protesters, demonstrators against military interventions and people who possess weapons.

    FEMA has spent only about 6% of its budget on national emergencies (12 times more on "black operations" than on disaster relief). Most of their funding has been used for the construction of secret bunkers throughout the US for a major foreign or domestic “emergency”.

    Plans like these were already implemented long before FEMA was installed.
    On 14 January 1942, President Roosevelt issued Presidential Proclamation No. 2537, under which immigrants from “enemy” countries like Italy, Germany and Japan, had to register with the US Department of Justice.
    Over fears that Japanese Americans on the west coast would start telling the truth on the staged Pearl Harbor attacks and would protest against the brutal bombing of Japanese cities, more than 110,000 were detained in internment camps.

    REX 84 was written by Lt. Col. Oliver North, who was both NSC liaison to the White House and to FEMA, and John Brinkerhoff, deputy director of "national preparedness" programs for FEMA.
    Similar exercises as REX84 are Garden Plot (drafted after the Watts, Newark, and Detroit riots) and Lantern Spike.
    In the Hurricane Katrina disaster, parts of FEMA’s job description - humanitarian efforts - were coordinated by the Department of Homeland Security.     The martial law portions of the “emergency” plan were outlined in a 30 June 1982 memo by Guiffrida’s deputy for national preparedness programs, John Brinkerhoff. This memo resembles a 1970 paper by the 1987 head of FEMA, Louis O. Giuffrida, in which he advocated detaining 21 million “American Negroes” to “assembly centers or relocation camps” in case of an emergency.
    Some of Bush`s closest friends and advisers, including former national security adviser William Clark, the late CIA Director William Casey and Atty. Gen. Edwin Meese, were part of the informal secret structure that established these plans.

    To keep the whole thing flexible the plan didn’t even define what a “national crisis” is.

    In the 1987 Iran-Contra hearings, Congressman Jack Brooks asked a question to Oliver North about “a contingency plan in the event of emergency, that would suspend the American constitution” (didn’t he know that these hearings were a cover-up?).
    The Democratic Chair of the joint Senate-House Committee, Senator Daniel Inouye, replied that he shouldn’t “touch upon that”, because “that question touches upon a highly sensitive and classified area”.

    In March 2002, The Washington Post described that President Bush had installed a secret shadow government of about “100 senior civilian managers”, to “ensure survival of federal rule after catastrophic attack on the nation’s capital”.
    The civilian cadre draws from every Cabinet department and some independent agencies.

    Deployed civilians are not permitted to tell anyone but instead explain their absence by “a business trip".

    In May 2007, Bush signed executive orders NSDP51 and HSDP20 to increase the powers of the NSC and FEMA even further.
    In the 1990s, the military checked all the major food store chains around the country. Probably Wal-Mart will become the food distributor for the US in case of an “emergency”.

    Representative Peter DeFazio finds it necessary that Congress is allowed to read the secret plans.

    “Covert operations” (false flag attacks) have been part of the policy of the US government since at least 15 March 1954, with the approval of NSC 5412.
    NSC 5412 described covert operations as:
    Specifically, such operations shall include any covert activities related to:
    propaganda, political action; economic warfare; preventive direct action, including sabotage, anti-sabotage, demolition; escape and evasion and evacuation measures;
    subversion against hostile states or groups including assistance to underground resistance movements, guerrillas and refugee liberation groups;
    support of indigenous and anti-communist elements in threatened countries of the free world; deceptive plans and operations;
    and all activities compatible with this directive necessary to accomplish the foregoing.

    In 1970 NSC 5412 was replaced by NSC 40 under which covert activities continued to take place.
    The “secret” group that coordinated the false flag attacks has been known by a variety of names: in 1954 it was named Special Group; 1964 - 303 Committee; 1970 - 40 Committee; 1976 - Operations Advisory Group; 1977 - NSC Special Coordination Committee; the Reagan administration called it National Security Planning Group; 2002/2003 - Office of Special Plans.

    In 1970, the 40 Committee played a major role in preventing Salvador Allende from taking office in Chile, when Rockefeller agent Henry Kissinger chaired it.
    In 1976, the 40 Committee consisted of the President's Assistant for National Security Affairs, the Secretaries of State and Defense, the Chairman of the Joint Chiefs of Staff, and the Director of Central Intelligence.
    Under Reagan, the National Security Planning Group included the Vice-President, the Secretary of Defense, the Secretary of State, the Assistant for National Security Affairs, and the Director of the CIA.
