    A Philadelphia gun store owner allegedly killed a potential looter early Tuesday, police said.

    The owner of Firing Line Inc. in South Philadelphia told police he was inside his store when four men entered after smashing the glass of the door at about 4:13 a.m.

    The 67-year-old owner, whose name was not released by police, confronted the men after they ran up the stairs and discharged his Bushmaster M4 rifle, “fatally wounding one offender,” the Philadelphia Police Department said in a statement.

    "One of the individuals that broke into the property, pointed a handgun at him," Chief Inspector Scott Smalls told Fox 29. "And that's when the store owner fired his own weapon -- striking the one perpetrator at least one time in the head and he collapsed, dropping his gun between his legs."

    The individual, who was pronounced dead at the scene, was a black male in his mid 20s and armed with a handgun, police said, adding that the other three men “fled the store in an unknown direction."

    The store owner was not injured, and no arrests have been made.

    “This investigation is active and ongoing with the Homicide Unit,” the department said in a statement.

    Police officials said a man at Thomas Jefferson University Hospital was being treated with a gunshot wound to the shoulder, and it’s a “possibility” he is connected to the incident. Officials are waiting to see the bullet before verifying any connection, according to The Philadelphia Inquirer.

    The store owner told police that he stayed the night in his store after an attempted break-in on Sunday evening, according to Fox29. It's unclear whether he called the police that night.

    Here's the short version:

    Gun store owner defended and protected his own store. He shot an intruder. Police did not arrest the owner.

    Good for him. Hopefully he was smart enough to do the right thing in situation like this. Which is put down your weapon when the police arrive and make no statement without your lawyer present.

    Some of the gun laws are different within the city of Philadelphia. You have to be careful.

    Yes thank you you are correct about Philadelphia. Not even sure you can get a carry permit. But state law does allow self defense.
    I am honestly unclear what Philadelphia can or can’t do regarding state law.


    Pennsylvania has a very similar statute to other stand your ground states. However, there are some distinctions.

    Generally, stand your ground establishes a defense for justifying the use of force in either a civil or criminal case. In short, they are an extension of the self-defense exception.

    Stand your ground laws authorize the use of deadly force to protect yourself or others from threats of force or bodily injury without being required to try to escape. You can also use protective force in public where you have a right to be by law. This includes cars, homes, and other public places.

    In Pennsylvania, any person “has no duty to retreat and has the right to stand his ground and use force, including deadly force if . . . (he) believes it is immediately necessary to do so to protect himself against death, serious bodily injury, kidnapping, or sexual intercourse by force or threat.” See 18 Pa.C.S. § 505(b)(2.3) for the entire statute.
