    Like the Trayvon Martin killing, this case really sucks. I would not have convicted Zimmerman, who I think is a total dirtbag and created the situation that night, and I wouldn't convict these guys either, though I feel they created the situation by chasing Arbery. Bottom line is Arbery charged him and tried to wrestle away the gun so self defense it is, AFAIC, unless it comes out that the son threatened to shoot him, which I doubt will happen. A very unfortunate and stupid event leading to loss of life only to be exploited by race idiots like Al Sharpton.

    There's another case for which Arbery's lawyer has been hired and this IS case of cold blooded murder of young black woman by a bunch thugs cops:

    Breonna Taylor, 26, was shot eight times by Louisville Metro Police officers who entered her apartment around 1 a.m. March 13. Police have said the officers were serving a search warrant as part of a narcotics investigation, but no drugs were found at the home.

    Kenneth Walker, Taylor's boyfriend, was with her in bed when police entered the home, and police say he shot an officer. He faces criminal charges of first-degree assault and attempted murder of a police office, but no drug charges.

    Taylor had no criminal record.

    According to the lawsuit, LMPD executed at least two search warrants — including one at Taylor's home — in the early morning of March 13 in an attempt to locate a suspect named Jamarcus Glover.

    But police had already located Glover at his home and detained him before executing the warrant at Taylor's residence, the suit says.

    Glover's home is more than 10 miles from Taylor's home on Springfield Drive, records show. He faces drug and gun charges.

    At 12:40 a.m., LMPD Sgt. Jonathan Mattingly and officers Brett Hankison and Myles Cosgrove entered Taylor's residence without knocking or identifying themselves as police, according to the suit, which cited statements from multiple neighbors.

    Taylor and Walker were awakened by the officers' entry and believed their home was being broken into, the suit says.

    Rob Eggert, a defense attorney for Walker, has previously said his client fired one shot, hitting Sgt. Mattingly.

    The suit states that Walker has a license to carry and kept firearms in the home for protection.

    The lawsuit alleges that police fired more than 20 rounds into Taylor's home, striking objects in the living room, dining room, kitchen, bathroom, both bedrooms and into an adjacent residence where a 5-year-old child and pregnant mother were present.

    "Breonna had committed no crime, posed no immediate threat to the safety of the defendants and did not actively resist or attempt to evade arrest prior to being repeatedly shot and killed by the defendants," the suit says.

    okay, but intent is a matter of fact. ie for juries to determine. as is reasonable suspicion. whereas if they can prove the stuff in my post then they will have charges dismissed as a matter of law

    What proof did they have of him entering the house that day? I haven't heard the exact proof just that they say him running down the street. Not that they saw him coming out of the house or that someone said they did. What is the first hand knowledge?

    Dear Captain Jump :My office received the Arbery autopsy report [dated 4/1/2020 yesterday and have reviewed it yesterday and this morning. We were waiting on this important evidentiary article before finalizing our opinions.

    However, since we were initially requested to handle the case the victims mother has clearly expressed she wants myself and my office off the case. She sees a conflict in that my son works in the Brunswick District Attorney’s Office where Greg McMichael retired sometime ago. She believes there are kinships between the parties [there are not and has made other unfounded allegations of bias [es]. As such, I believe it is better for my office to step out and am going to recuse myself and the Assistants working for me from handling the case. I am contacting the Georgia Attorney General Office and seeking their assistance in finding another District Attorney in the State to handle the further evaluation for prosecution this case. That is, to determine whether there is sufficient evidence on which to make a Grand Jury presentation or not.

    Given the Governor’ s current shelter in place order and Justice Meltons Judicial Emergency Order; I can not venture a guess as to when they will move on this request, and once another is found; when that District Attorney will have the staff available to review this case file. I hope for all involved it will move along as quickly as possible.

    After talking by telephone with you yesterday, I appreciate there is immediate pressure on your department as to the issue of Arrest”. Since I have already given you an initial opinion the day after the shooting, I feel I can still comment on this limited issue.

    First,
    I am the current elected District Attorney for the Waycross Circuit, I have worked as a criminal prosecutor for some 36 years. As an Assistant District Attorney in Waycross and Brunswick, as Chief Assistant in Waycross for 20 years and served as the District Attorney the last 5 years; I have been actively involved in over 100 murder cases and assisted other prosecutors with at least 100 more. I have no idea how many Aggravated Assault cases involving gunshots and wounds of all types; Plus I have attended countless schools, classes and seminars on criminal prosecution and criminal acts and evidence. Myself and one of my Senior Trial Attorneys have reviewed the evidence extensively and concur on all points.

    Second,
    As to the case at hand: It is my professional belief the autopsy confirms what we had already viewed as shown in the video tape, with the photographs & from the witness statements taken immediately at the scene. The autopsy supports the initial opinion we gave you on February 24th, 2020 at the briefing room in the Glynn County Police Department after reviewing the evidence you had at that time. We do not see grounds for an arrest of any of the three parties.

    Third,
    It appears Travis McMichael,Greg McMichael, and Bryan William were following, in pursuit burglary suspect, with solid first hand probable cause, in their neighborhood,and asking/tellinghim to stop. It appears their intent was to stop and hold this criminal suspect until law enforcement arrived. Under Georgia Law this is perfectly legal.OCGA 17-4-60 “A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.”

    Fourth,
    It clearly appears Travis McMichael and Greg McMichael had firearms being carried in an open fashion. The investigation shows neither of them to be convicted felons or under felony supervision, they were in a motor vehicle owned by Travis McMichael. Under Georgia Law this is legal open carry.

    OCGA 16- 11 - 126
    “a) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his or her person a weapon or long gun on his or her property or inside his home, motor vehicle, or place of business without a valid weapons carry license.
    (b) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his person a long gun without a valid weapons carry license, provided that if the longgun is loaded, it shall only be carried in an open and fully exposed manner.”

    Fifth,
    The video made by William Bryan clearly shows the shooting in realtime. From said video it appears Ahmaud Arbery was running along the right side of the McMichael truck then abruptly turns 90 degrees to the left and attacks Travis McMichael who was standing at the front left corner of the truck. A brief skirmish ensues in which it appear Arbery strikes McMichael and appears to grab the shotgun and pull it from McMichael The shot is through Arberys right hand palm which is consistent with him grabbing and pulling the shotgun at the barrel tip, the 2nd and 3rd wounds are consistent with the struggle for the shotgun as depicted in the video, the angle of the 2nd shot with the rear of the buttstock being pushed away and down from the fight are also consistent with the upward angle of blood plume shown in the video and that McMichael was attempting to push the gun away from Arbery while Arbery was pulling it toward himself. The 3rd shot too appears to be in a struggle over the gun. The angle of the shots and the video show this was from the beginning or almost immediately became — a fight over the shotgun . Given the fact Arbery initiated the fight, at the point Arbery grabbed the shotgun, under Georgia Law , McMichael was allowed to use deadly force to protect himself. Just as importantly, while we know McMichael had his finger on the trigger, we do not know who caused the firings. Arbery would only had to pull the shotgun approximately 1/16th to 1/8th of one inch to fire weapon himself and in the height of an altercation this is entirely possible. Arberys mental health records & prior convictions help explain his apparent aggressive nature and his possible thought pattern to attack an armed man.

    OCGA 16-3-21 Use of Force in Defense, once confronted with a deadly force situation an individual is allowed to use deadly force to defend themselves or others OCGA 16-3-23.1 Georgia’ s No Duty to Retreat Law ,an individual is not required to back away from or submit to an attack; OCGA 16 -3-24 [b] The use of force which is intended or likely to cause death or great bodily harm to prevent trespass on or other tortious or criminal interference with real property other than a habitation or personal property is not justified unless the person using such force reasonably believes that it is necessary to prevent the commission of a forcible felony. OCGA 16-3-24.2 A person properly and legally defending themselves is immune from prosecution

    For the above and foregoing reasons, it is our conclusion there is insufficient probable cause to issue arrest warrants at this time.As to any further issues on whether to present this to a Glynn County Grand jury, that will have to wait for the next District Attorneys review. Please consider this an OPEN file until that decision is made and restrict the release ofany information under Georgia Open Records Act requests.

    If you watch the video, you see Arbery running toward the parked truck and attack the McMichaels. They weren't ever seen chasing him, they cut him off at the pass and instead of running another direction he kept running toward them.. he could have run away. McMichaels were acting lawfully and defended themselves when he came up and tried to grab the gun.

    In fact, I would say Arbery didn't even get shot, he shot himself. Literally, and mechanically. It's in the video. When you pull a gun toward yourself with the barrel pointing at you and somebody else is holding the other end, it would be very easy for them to inadvertently pull the trigger.

    There is also the issue that Arbery was armed, because he was holding the gun. So he likely shot himself and he was most certainly not unarmed when he was shot.

    Which felony?
    Felony burglary is committed any time a person goes onto a property with the intent to commit a crime. Any crime. It doesn't matter if they go onto the property with intent to steal something, don't find anything and leave, that is STILL felony burglary.

    A citizen's arrest can be made if you have witnessed and there is reasonable suspicion to suspect that someone has committed a felony.

    It turns out that Gregory McMichael called 911 on February 11, 2020, or about 2 weeks earlier to report that he saw Arbery entering the same premises. He saw him, Arbery reached into his pocket and ran into the house. The owner of the property was informed, he had video footage of the incident and thanked the neighbor who he had asked to watch his property and told him to let him know if they caught him. He DID NOT FILE AN OFFICIAL REPORT WITH THE POLICE.

    McMichael and one Diego Perez subsequently went out armed through the neighborhood to see if they could find him. Diego Perez, obviously a white supremacist as well.

    Onto the incident in question, it turns out that the McMichaels were on the phone with 911 during the entire incident, up to and including during when the shots were fired.

    Do you know what white supremacists don't do when they are hunting down black men to lynch? They don't call the $#@!ing police and have them on the line while they are hunting them down..

    The son saw him in the house as he is only two doors down, then he called the cops, then he told them he saw him running out of the house as he was on the call. The surveillance video corroborates his call the the police. Then they got their guns, stayed on the phone with the police and followed him. Initially they said, "Hey stop, we want to talk to you" and he ran off.. But as I said before, the father had investigated, likely questioned and most certainly faced this guy down in court over his weapons charges before. So he had two strikes, this would have been his third and he was facing a life sentence. He runs out of a house after committing a felony, sees a cop who he knew from before, and ran off. Then he realized he had been positively identified, and the only way he was going to get out of this was murdering the witnesses.. So when he saw them in the parked truck after they had circled the block to cut him off at the pass, he ran toward them for at least 100 yards or further when he didn't have to. He ran around the truck and attempted to take a weapon and shoot both of them to get rid of the witnesses.

    That was NOT self defense by Arbery, and in fact, if you are attempting to escape from the commission of a crime Georgia law says you have no claim to self defense.. that doesn't mean there is no protection for you, as reasonable force must be used to restrain, etc, but you can't attack somebody who is attempting to detain you for a crime and claim it is self defense. It's all in the code.

    This case was closed long ago, but it got re-opened because the NAACP and some other leftist groups started putting out inflammatory statements and lies about what happened and so for whatever reason and however it happened, for political reasons it got re-opened.

    No, two weeks before he saw him outside of the house, then saw him run in and called the cops.

    The time of the incident, he saw him in the house, then called the cops, and said to the dispatcher something along the lines of, "he's running out now, there he goes!"

    Apparently he is two doors down.

    Maybe if you measured the furthest corner of one property, to the furthest corner of the McMichaels, it could be 500 yards, but that doesn't seem right to me.

    I just listened to the call the day of the shooting. He said he's running down the street, nothing about him coming out of the house on that call

    I would like to hear that link. The links I've listened to just say "I'm on Santilla Shores there's a black male running down the street. "Nothing about coming out of a house.

    The one that says "there's a guy in the house right now" is the first time he called on 2/11

    I wonder if that is considered 1st hand knowledge? They saw him running out of the house the first time but not the 2nd time. But that is still considered first hand knowledge which is what the other DA said. Or maybe he mixed up the 911 calls too?

    Looks like you are a little confused, both of these calls were made on the day of the incident. The first was before the chase, the second was during the shooting.



    Here is the call from two weeks prior, at least most of it, buried in this short local news piece:

    I forgot to mention, but Molyneux dug up the fact that there was a NO TRESPASSING sign posted at the construction site.

    So it cannot reasonably be argued that he was some kind of construction enthusiast who was just curious, you don't go past "NO TRESPASSING" signs like that just because you want to see how they did the floor joists..
