    The foreperson on Roger Stone’s jury ran for Congress as a Democrat in 2012, it was revealed Wednesday.

    Tomeka Hart revealed her role on the jury in a Facebook post defending four prosecutors who quit the Stone case in protest over a revision to the Trump confidante’s recommended prison sentence.

    Hart’s social media activity shows she closely followed the special counsel’s Russia investigation, and frequently posted negative stories about President Donald Trump.


    A former Democratic congressional candidate whose social media accounts are replete with criticism of President Donald Trump came forward Wednesday as the foreperson on the jury that convicted longtime GOP operative Roger Stone at a trial in November 2019.

    According to multiple news reports, Tomeka Hart revealed her role on the jury in a Facebook post supporting the four prosecutors who withdrew from the Stone case Tuesday in protest over a revision in a sentencing recommendation for the GOP operative.

    “I have kept my silence for months. Initially, it was for my safety. Then, I decided to remain silent out of fear of politicizing the matter,” Hart wrote on Facebook, adding: “But I can’t keep quiet any longer.”

    CNN first reported Hart’s post but did not note that she was a Democrat. Commercial Appeal, a news outlet affiliated with USA Today that spoke to Hart, reported details of her professional background. Those details match up with the same person who ran for Congress in 2012. A Politico reporter who covered Stone’s trial identified Hart as a former congressional candidate.

    Hart, who did not respond to The Daily Caller News Foundation’s request for comment, lost to incumbent Democratic Rep. Steve Cohen in the primary that year.

    Hart’s social media accounts show she kept a close eye on developments in the special counsel’s investigation.

    Her Twitter feed shows dozens of references to Trump, many of them links to negative stories about the Republican. In a Twitter post on Aug. 19, 2017, Hart quoted a tweet referring to Trump as the “#KlanPresident,” in an apparent reference to the KKK

"It pains me to see the DOJ now interfere with the hard work of the prosecutors. They acted with the utmost intelligence, integrity, and respect for our system of justice."

    Stone's lawyers had the opportunity to voir dire (ask questions of) the members of the panel out of which the jurors were to be selected and to challenge prospective jurors for cause. But being a Democrat (especially in D.C.) does not an automatically disqualify someone from serving as a juror in Stone's case.

    It didn't take long for the conspiracy theories about the jury to materialize. I guess some folks believe Hart must have hypnotized the other eleven jurors into voting for a guilty verdict on all seven counts.

    They tried to get several purged apparently but the Obama judge ruled against it. His trial was a farce.

    The statute that Stone was convicted of violating in connection with his lying is 18 USC §1001(a)(2), which covers willfully and knowingly making any materially false, fictitious, or fraudulent statement or representation in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States.

    Presumably, Stone was sworn in before his testimony before Congress and if so it seems he could have been charged with violating the general federal perjury statute, 18 USC §1621.

    I guess another question would be how you know that Stone willfully lied, as opposed to being confused about past events.. do you have a secret portal into his brain??

    Not to mention there was nothing material about his lies. There was no Russia collusion. He may as well have lied, or mis-remembered what time he arrived at his niece's birthday party.

    Clapper, on the other hand, lied about something that is materially significant to EVERY SINGLE $#@!ING AMERICAN.

    Hypothetical- if Hillary Clinton was charged with something and brought to court, would you be opposed to having any Republicans on the jury because they may have a potential bias against her? If such a jury found her guilty, would that be a miscarriage of justice?

    (Side note- the jury picks their own foreman- not the judges or lawyers)

    Well, why don't we read the Constitution?

    It says that they need to be impartial and unbiased, regardless of political party. This lady was clearly NOT.

    The jury was unanimous in their decision of guilty on all seven counts. It was not just one person.

    Does the Constitution say that it is ok for some of the jurors to be biased?

    How do you know they all weren't biased? We only know who two of them are, and they both were biased. Because the judge handed down an illegal gag order.

    The District of Columbia is by far the most liberal voting district in the country even more so than New York and California. It shouldn’t be a surprise if the entire jury is liberal.

    Multiple attorneys who have practiced federal criminal law for years in various parts of the justice system emphasized to TPM that the jury selection process for a federal trial is explicitly designed to eliminate the complaint at the heart of President Trump’s accusation: bias that would prevent a juror from fairly weighing the facts and law of a case.

    Defense attorneys and prosecutors submit questions to the judge, who creates a questionnaire for jurors designed to suss out aspects of their background, information diet, and views related to the case at hand.

    “The whole process is designed to flag potential bias,” Timothy Heaphy, a former U.S. Attorney who is now general counsel for the University of Virginia, told TPM.

    This occurred in the Stone case. Defense attorneys were also granted peremptory strikes, which allows jurors to be stricken for any permissible reason.

    The Juror In Question Revealed Relevant Information

    Mark W. Bennett, a former Iowa federal judge, told TPM that there was one way that Stone and his allies could raise relevant issues about the jury post-trial: if information showing that the juror initially gave false or incomplete information emerged.

    “The only way it could be a problem post-trial would be if they asked a question and the jury foreperson provided an inaccurate, incomplete, or incorrect answer,” said Bennett, the former federal judge.

    No evidence has been publicly brought forth to suggest that that was the case with respect to the juror that Trump referenced.

    In fact, the Washington Post reported on Thursday that the juror disclosed her political affiliation and past involvement with Democratic political campaigns during the selection process, as required.

    Gertner, another former federal judge, examined the questionnaires used in the Stone trial.

    “It’s critical that she disclosed,” Gertner said, emphasizing that there could only be any further issue if what the foreperson initially said was somehow incomplete.

    Stone Got A Fair Shot At Examining Them

    Trump and his allies’ claim that the foreperson suffered from bias also mistakes a key pillar of the jury system: it accepts that people enter the process with independent backgrounds and political views.

    The process, rather, is designed to remove those who cannot fairly judge evidence and make decisions on the law before them.

    In the Stone case, his defense attorneys reportedly interviewed several of the jurors during selection, and submitted interrogatories for the jury questionnaire.

    “They should have had ample opportunity to ferret out any bias and remove a juror,” said Bennett.

    His attorneys could have appealed any ruling made by the judge at that stage of the case, but there’s no evidence that they did so. Once the jury pool was finalized, that was Stone’s last opportunity to contest issues like the composition of those set to judge him.

    Before any high profile trial the question of if the defendant can get a fair trial is always considered.

    What this article doesn't mention, and what ignorant folks, willfully or otherwise, who are being quoted in that article don't mention - is that Stone's attorney's attempted to remove those jurors due to their bias and the judge, who was also bias, shot it down.
