Virginia lawmakers ban guns at state Capitol

    RICHMOND, VA.
Virginia lawmakers voted Friday to ban firearms at the state Capitol, the first in what's expected to be many contentious gun votes in coming weeks.

Newly empowered Democrats in the General Assembly voted to ban guns at the Capitol and a legislative office building, saying the move was needed to protect public safety.

Public officials have expressed concerns about planned Jan. 20 rallies that are set to draw huge crowds of pro-gun and gun-control advocates. Gun advocates from around Virginia and even out of state have pledged to turn out in force to highlight their resistance to proposed gun-control measures.

"The overall goal here is to protect and ensure the safety of our members and of the people that are in our building coming and going," Democratic Del. Marcus Simon said before the vote.

The ban would apply to lawmakers in addition to the general public.

Republicans have voiced opposition to banning guns at the Capitol and some GOP lawmakers routinely carry guns while at the legislature. "I feel this egregious, I think it's an overreach." said Del. Terry Austin.

Previously, anyone with a valid concealed handgun permit was allowed to bring a gun into the Capitol. Weapons were banned in certain parts of the building, which was designed by former President Thomas Jefferson, including the Senate gallery and the governor's office on the third floor.

Virginia Gov. Ralph Northam has outlawed guns from other state buildings, continuing a policy started by his predessor, former Gov. Terry McAuliffe, in 2015.

The debate on whether to ban guns in the Capitol is part of a larger fight on guns that's set to dominate this year's legislative session.

Democrats have a full majority at the state house for the first time in a generation and have promised significant new gun restrictions, including universal background checks, a ban on assault weapons and a red flag law that would allow authorities to temporarily take guns away from anyone deemed to be dangerous to themselves or others.

Gun owners are demanding that local government officials establish sanctuaries for gun rights. More than 100 counties, cities and towns have declared themselves Second Amendment sanctuaries and vowed to oppose any new “unconstitutional restrictions” on guns.

    Yup.

And don't ever let a Progressive tell you they don't want to ban guns. Because, here they are doing it. For lawful gun owners that jumped through the hoops, the time, the expense, of getting a Concealed Carry license.

I can't believe that anybody would swallow that bull$#@! about how "they don't want to ban guns" anymore.

Of course the bolsheviks want to ban guns.

Yeah, and this comes a week after THIS report:

    https://www.wric.com/news/local-news...-guns-in-2019/

RICHMOND, Va. (WRIC) — Richmond police said there were more than 450 guns reported stolen in the city in 2019. With more than half taken from cars, which are sometimes left unlocked, authorities are labeling the problem a public safety concern.

Police seized more than half a dozen guns from one car during a New Year’s Eve traffic stop in Richmond.

It was 10 p.m. when officers pulled over 38-year-old Sean Brownlee in the 400 block of West Ladies Mile Road. Brownlee tried to run but police caught up, searched the car and made a big find.

“They found a bag with seven firearms in it,” Lt. David Naoroz told 8News.

Lt. Naoroz says all of the guns were illegally possessed and at least one of the firearms was reported stolen. Brownlee has been arrested on weapons violations. Court records show he has a long rap sheet.

“This took seven out of the hands of an individual who was not supposed to have them in the first place,” Naoroz said about the guns police seized.

The incident is shedding new light on a growing problem with stolen guns in the City of Richmond. Police say the issue raises concerns because the stolen guns are often used in other crimes or sold on the street.

“The numbers haven’t slowed down,” Naoroz explained. “We had one recently that was stolen and used in a shooting a week later.”

According to Richmond police, more than 450 guns were reported stolen in 2019 and even more concerning, 270 were stolen from parked cars.

Police seized more than half a dozen guns from one car during a New Year’s Eve traffic stop in Richmond.
“Some of that was unlocked motor vehicles,” Naoroz told 8News.

Despite several public service announcements and social media campaigns from police some gun owners are still failing to take the proper steps to secure their weapons.

Officers say people are leaving their weapons under the seat, in the middle console and unlocked in the glove box. Richmond police say if you have to leave your gun in car lock it up in the trunk inside a lockbox.

In the City of Richmond, gun owners are required to report any lost or stolen guns within 24 hours or they could face a fine. In October, Richmond City Council passed the ordinance proposed by Mayor Levar Stoney. Under the ordinance, offenders could face a $125 fine for the first offense and a $250 fee for any subsequent offenses.
Now how many car break-ins will there be on Lobby Day, I wonder?
We all know, they do not care about "safety". All they care about is CONTROL.

    *** Gun Policy Update ***

It looks like the Democrat controlled Joint Rules Committee just banned guns in the General Assembly Building and the Capitol but not the grounds.

This means that you will have to choose between being able to carry and lobbying your elected representatives.

The Democrats claimed that the Capitol Police requested this policy but COL Pike confirmed that they did not.

So Democrats tried to blame their desire to disarm their constituents on the Capitol Police.

The dishonesty is strong with the Democratic leadership this year.

GOA and VCDL File Suit to Strike Down Gov. Northam's Illegal Gun Ban

    Per GOA-

The Governor’s action is illegitimate and cannot be allowed to stand.

GOA and VCDL are challenging Gov. Northam's illegal gun ban in court.

Gun Owners of America and the Virginia Citizens Defense League (VCDL) are filing an Emergency Injunction against the governor’s actions.

His action infringes on both the First and Second Amendment rights of Virginian’s who wish to peaceably assemble to petition their government, while at the same time not surrendering their right to self-defense.

This rally is held annually with thousands of participants and without incident. The only difference this year is that, in response to the Democrats’ attempt to eviscerate the Second Amendment, a much larger crowd is expected.

Incredibly, Northam is using the 2017 rally in Charlottesville, Virginia, in support of his ban on firearms, ignoring the fact that the unfortunate death that day was a vehicular homicide.

Northam hasn’t made any attempt to ban cars.

Like all gun control, this gun ban could have only negative consequences. If there are, in fact, any bad actors who would attempt to hijack the rally, they would simply ignore the law.

Over the next 24 hours, GOA and VCDL lawyers will be in court fighting the ban.

RICHMOND, Va. – A lawsuit has been filed challenging Governor Northam’s executive order banning guns from the Virginia Capitol, an official with the office of the Virginia Attorney General said.

A hearing has been scheduled for 1:30 p.m., Thursday afternoon in the Richmond Circuit Court.

On Tuesday Gov. Northam declared a state of emergency over threats from militia groups ahead of a gun-rights rally that is scheduled for Monday.

Northam’s emergency order will ban weapons of all kinds, including firearms, from the Capitol grounds starting Friday because of potential violence during a gun-rights rally scheduled for Monday.

There are no further details at this time on what the lawsuit says.

Virginia revokes handgun permit agreement with 25 states

    RICHMOND, Va. –
Concealed handgun permits held by residents of 25 states will no longer be valid in Virginia, the state's attorney general said Tuesday, drawing swift criticism from GOP lawmakers.

Attorney General Mark Herring, a Democrat, said the state will revoke its reciprocity agreement with the states because their concealed weapon laws don't meet Virginia's standards. Those states hand out permits to people who are barred under the Virginia law, like fugitives, convicted stalkers and drug dealers, which undermines the state's law and puts residents at risk, he said.
"Evenly, consistently and fairly enforcing Virginia's concealed handgun permit law, as we are now doing, means that it will be more difficult for potentially dangerous individuals to conceal their handguns here in Virginia and that will make Virginians safer, especially Virginian law enforcement," Herring said.
The move means that Virginians will no longer be able to use their concealed handgun permits in six states that require a mutual reciprocity agreement: Florida, Louisiana, North Dakota, Pennsylvania, South Carolina and Wyoming.
John Whitbeck, chairman of the Virginia Republican Party, said Herring's announcement was further proof that Democrats have "declared war on the Second Amendment."
The top Republican in the GOP-controlled House of Delegates said that Herring is "damaging the integrity of the office he holds."
"Despite promising to take politics out of the attorney general's office, Mark Herring consistently seeks to interpret and apply the law of the Commonwealth through the lens of his own personal, political opinions," House Speaker William Howell said.
Lars Dalseide, a spokesman for the National Rifle Association, said concealed handgun reciprocity agreements between states have ended before, but his organization is unaware of another state ever implementing a change of this magnitude.
States are currently being notified about the change, which goes into effect on Feb. 1, Herring said. The only states that have tough enough laws to maintain their reciprocity agreement with Virginia are: Michigan, Oklahoma, Texas, Utah and West Virginia, he said.
The states whose permits Virginia will no longer recognize are: Alaska, Arizona, Arkansas, Delaware, Florida, Idaho, Indiana, Kansas, Kentucky, Louisiana, Minnesota, Mississippi, Montana, Nebraska, New Mexico, North Dakota, North Carolina, Ohio, Pennsylvania, South Carolina, South Dakota, Tennessee, Washington, Wisconsin and Wyoming.

This sounds like it is from 2015.

Currently Virginia has reciprocity with 35 states.

For anyone who is following this and is interested:

So the GOA/VCDL suit was DENIED.
In her written ruling, Richmond Circuit Court Judge Joi Taylor said the governor has the authority under state law to take action related to “the safety and welfare” of the state.

Taylor cited rulings from the U.S. Supreme Court and other courts that found the Second Amendment right to bear arms is not unlimited. Because of that, she wrote, the gun-rights groups would not “suffer an irreparable harm” sufficient to justify the injunction.

Virginia Citizens Defense League — the gun-rights group sponsoring Monday’s rally — called the ruling “mind-boggling” and said his group’s lawyers were racing to file an appeal with the Virginia Supreme Court.

Here is what was filed by GOA/VCDL. It's a good read:
Complaint and Application for Temp Injunction as FILED

    Now the APPEAL:
    APPEAL TO VA SUPREME COURT
Which will supposedly be heard tomorrow, Fri. 1/17.

To be honest, Virginians put dems in power so they voted for this entire mess. But the good news is that all this overreach might make VA go almost all red for 2020 senate/house elections.

As Americans, sometimes we need to be reminded that votes have consequences.

Maybe a particular election they didn't have the time to look up the candidates, or maybe wanted a certain program, well next time they know better.
