Surveillance footage capturing the outside of Jeffrey Epstein’s cell during his first suicide attempt in July is gone forever, prosecutors confirmed Thursday in a bombshell court filing.
The revelation comes after Assistant US Attorney Jason Swergold told White Plains federal Judge Kenneth Karas in December that the footage was missing — and then backtracked the next day, claiming it had been preserved.
In a Thursday filing, Swergold admitted that the Metropolitan Correctional Center had preserved footage amid the investigation — only it was the wrong cell in the Lower Manhattan jail.
“The Government has learned that the MCC inadvertently preserved video from the wrong tier within the MCC, and, as a result, video from outside the defendant’s cell on July 22 – 23, 2019 (i.e. the requested video) no longer exists,” the letter reads.

A year after a dam of secrecy burst over the sex-trafficking case of the now-deceased Jeffrey Epstein, a federal judge Thursday ordered the release of another torrent of files.
The soon-to-be-public documents come from a 2015 lawsuit against Epstein’s accused accomplice Ghislaine Maxwell, whose depositions in that case form the basis of two now-pending perjury charges against her.
U.S. District Judge Loretta Preska tore through a bid to have the files kept sealed because Maxwell considers them either untrustworthy, embarrassing or an interference with her criminal investigation.
“Ms. Maxwell proffers little more than her ipsi dixit,” U.S. District Judge Loretta Preska said, using the Latin phrase meaning her say-so. “She provides no specifics as to these conclusions.”
The public may soon have a chance to see Maxwell’s deposition that prosecutors contend show her lying under oath.
“In her first deposition, which is among the documents being considered on this motion, Ms. Maxwell refused to testify as to any consensual adult behavior and generally disclaimed any knowledge of underage activity,” Preska noted, describing what appears to be the same testimony quoted in her federal indictment.
“In the context of this case, especially its allegations of sex trafficking of young girls, the court finds that any minor embarrassment or annoyance resulting from disclosure of Ms. Maxwell’s mostly non-testimony about behavior that has been widely reported in the press is far outweighed by the presumption of public access,” the judge added.
Other eyebrow-raising documents slated for release include Epstein’s correspondence with Maxwell and the deposition of one of their most prominent accusers: Virginia Roberts Giuffre, whose lawsuit five years ago alleged that Maxwell groomed her to be Epstein’s “sex slave.”
Giuffre claims that Epstein passed her off to his rich and powerful friends, including Britain’s Prince Andrew, New Mexico Governor Bill Richardson, financier Glenn Dubin, model scout Jean-Luc Brunel and former Senator George Mitchell. The men have denied the allegations, and prosecutors formally began the process seeking the British government’s help to question the prince.
The day began with U.S. District Judge Alison Nathan, who is presiding over Maxwell’s criminal case, denying a gag order requested by Maxwell’s attorneys against prosecutors and attorneys for the witnesses in her criminal case.
Rejecting the argument that Maxwell’s right to a fair trial was at risk, Judge Nathan reminded all of the attorneys that the court’s rules already prohibit anybody from making statements that could prejudice a jury.
“The court will ensure strict compliance with those rules and will ensure that the defendant’s right to a fair trial will be safeguarded,” Nathan wrote in a 1-page order.
Later that morning in a telephone conference, Preska unsealed dozens of files from the Giuffre v. Maxwell docket.

Interestingly, the U.S. Attorney for the Southern District of New York (SDNY) oversees prosecutions of Wall Street banks and the privately owned Federal Reserve Bank of New York (both located in that district).
After Geoffrey Berman was ousted as US attorney, President Donald nominated Jay Clayton for SDNY US Attorney, who was previously installed by Donald to head the Securities and Exchange Commission (SEC).
Clayton, who Donald likes to “oversee” (not) prosecution of the major banks, has previously represented 8 of the 10 largest Wall Street banks when he was an attorney, partner at the Sullivan & Cromwell law firm...
Jay Clayton has worked for UBS and the Deutsche Bank that was recently fined $150 million (after charges brought by Berman’s office) over amongst others its relationship with Jeffrey Epstein.
He also represented the film studio of Harvey Weinstein.
Clayton represented Goldman Sachs in perhaps its most important deal, the $5 billion investment by Warren E. Buffett’s Berkshire Hathaway during the 2008 financial crisis. His wife, Gretchen, has worked at Goldman Sachs...
In the last year, Jay Clayton earned some $7.6 million from Sullivan & Cromwell. He has investments in Apollo Global Management, Bain Capital (founded by Mitt Romney), J.C. Flowers and Perry Partners.
Jay Clayton has also represented TeliaSonera that has business ties to Russia and Iran.

Jan.26 -- A report released by law firm Dechert, commissioned by the board of investment firm Apollo Global Management Inc., found that its founder and chief executive officer Leon Black paid Jeffrey Epstein $158 million between 2012 and 2017 -- after the sex offender pleaded guilty to felony charges in 2008 -- for advisory services that helped expand the wealth of one of America’s richest men. Apollo said in a statement Monday that Black will retire as CEO no later than July 31, while remaining chairman. Bloomberg's Tom Metcalf reports.

The two prison guards — Tova Noel and Michael Thomas — assigned to guard Jeffrey Epstein on the night that he died have admitted that they falsified prison records and have cut a deal with federal prosecutors.
“As part of the deal with prosecutors, they will enter into a deferred prosecution agreement with the Justice Department and will serve no time behind bars,” The Associated Press reported. “Noel and Thomas would instead be subjected to supervised release, would be required to complete 100 hours of community service and would be required to fully cooperate with an ongoing probe by the Justice Department’s inspector general.”
The guards, who were supposed to be checking on Epstein every 30 minutes, are accused of checking sports news and shopping for furniture on the internet before taking a nap during Epstein’s death. The two are accused of falsifying prison records to make it look like they had been doing their job during the time of Epstein’s death.

It isn't quite clear to me why Professor Alan Dershowitz waiting so long to file a defamation lawsuit against Netflix claiming $80 million in damages for the raunchy May 2020 documentary “Jeffrey Epstein: Filthy Rich”.
Usually defamation lawsuit are filed immediately, and include demands to stop publishing the defamatory allegations.
The most important thing of this lawsuit is that Dershowitz denies having sex with Giuffre. Dershowitz was however interviewed in the documentary where he had already denied this, but finds it unfair that they didn't give enough attention to his "evidence" that this never happened.
Dershowitz even claims that the producers of "Filthy Rich" promised that they would include all of his "evidence" (how/why could/would they?).
