    President Trump’s long-promised border wall is working.
    The new chief of Border Patrol, which is under U.S. Customs and Border Protection, revealed that the parts of the new “wall system” are 90% “effective,” up from just 10% before it was built, replacing a ragtag of broken fencing.
    “It changes everything,” said Chief Rodney Scott, of the 135-136 miles of new wall, roadways, and high-tech spyware. “There is a huge return on investment,” he added.
    “This system is going to have a huge impact,” added Deputy Chief Raul Ortiz.

    In the San Diego area, Scott said that the wall has essentially ended illegal crossings of humans and cars.
    And, in an added benefit, it now requires 150 fewer border agents, a savings of $28 million in salaries and benefits, he said at a press briefing, his first since he and Ortiz took over CBP in January.
    Plus, with a better border road, vehicles that once fell apart at 40,000-60,000 miles now last to 100,000 miles before they are auctioned off.
    “There is return after return,” said Scott.
    The wall is especially good at stopping trucks and cars, he said, because it takes too much time and effort to saw through several wall bollards needed to make an opening that is big enough to drive through.
    “The border wall system all but stopped that completely,” he said.
    As a result, drug cartels have changed tactics, building expensive tunnels and trying to sneak drugs in on vehicles passing through border entry points. But that isn’t effective, he said.
    “It shut down that entire threat. Anywhere we built the border wall system, the first thing it does is shut off those drive-throughs. The second thing is, it shuts off massive amounts of people coming through at the same time. So, it’s forced the drug cartels, especially El Chapo’s group, Sinaloa, to shift tactics,” he said.

    The Trump administration announced Tuesday that it will be indefinitely extending the public health order it has used to seal the country's borders to unauthorized migrants, including asylum-seekers and unaccompanied children, during the coronavirus pandemic.

    Authorities have used the directive to rapidly remove most border-crossers without proper documents to Mexico, Canada or their home countries and to bypass the immigration, asylum and anti-trafficking laws that govern the processing of migrants. More than 20,000 migrants were expelled from the U.S. southern border under the order in April and the last 11 days of March.

    The Centers for Disease Control and Prevention directive, which invokes sweeping authorities in a 1944 public health law, was first issued in late March and renewed for another 30 days last month. On Tuesday, CDC Director Robert Redfield extended the order once again. But he did not include an end date and instead decreed the order would be reviewed every 30 days.

    "(The order) shall remain in effect until I determine that the danger of further introduction of COVID-19 into the United States has ceased to be a serious danger to the public health," Redfield wrote in the 12-page document published Tuesday.

    The U.S. Department of Homeland Security also announced on Tuesday it would continue to ban non-essential travel through the country's land borders with Mexico and Canada. The restrictions do not prohibit commercial traffic or affect U.S. citizens and permanent residents.

    Beginning this week, Mexican nationals arrested for crossing the border illegally will be flown to Mexico City instead of being dropped off at ports of entry.

    As border restrictions were extended on Tuesday, U.S. Customs and Border Protection decided to alter its own policy. Now, instead of immediately being returned through border crossings, detained migrants will have to wait in custody up to three days before being flown all the way to Mexico City.

    Border Patrol officials said the change in policy was needed to keep Mexican nationals from repeatedly trying to cross into the United States. According to CBP, at least one migrant had been expelled and caught as many as 10 times.

    People from nations other than Mexico, were already being flown back to their countries of origin.

    The Pentagon will put up to 4,000 troops at the U.S. southern border with Mexico from this October through September 2021, a move that will decrease the overall number of troops there while extending the mission another year.

    “Secretary [Mark] Esper has approved a request for assistance from the Department of Homeland Security and authorized the deployment of up to 4,000 DOD personnel to the southern border,” Pentagon spokesman Army Lieutenant Colonel Christian Mitchell said Thursday.

    As of late April, the total number of U.S. military forces deployed to the border was about 5,000, according to the U.S. Northern Command. The military is running more than 200 mobile surveillance sites along the southern U.S. border, in addition to assisting U.S. Border Patrol agents with logistics and transportation.

    The Trump administration is hiking the fees for a range of immigration benefits, including an 83% increase for petitions from green card holders seeking to become U.S. citizens and the first ever charge for asylum requests.

    Set to be published in the federal government's journal of regulations on Monday, the new U.S. Citizenship and Immigration Services (USCIS) fees will take effect on October 2. Roughly 97% of USCIS' budget is funded by application fees, unlike most other federal agencies, whose funds are appropriated by Congress.

    The final rule includes a more than $500 increase in the fee for the form filed by immigrants to obtain U.S. citizenship — which among other benefits, allows them to vote. Fees for other forms, including for family members of victims of crimes who assisted law enforcement and for those seeking genealogy records, will also go up.

    Some fee exceptions and waivers will be eliminated through the rule, which will also make the U.S. one of only a few countries in the world to charge a fee to apply for asylum, a humanitarian protection for those fleeing persecution based on race, political opinion, religion, nationality or membership in a "particular social group." By imposing a $50 charge for asylum petitions, the U.S. joins Fiji, Iran and Australia as the only countries requiring immigrants to pay a fee to seek legal refuge.

    Applications for works permits, including for asylum-seekers, will also go up by 34%.

    By next year, Donald Trump will have reduced legal immigration by 49% since becoming president.

    The cuts to legal immigration have come in several categories, and it appears the Trump administration is not finished restricting immigration.

    The National Foundation for American Policy projects that the number of legal immigrants will decline by 49% (or 581,845) between FY 2016 and FY 2021 due to Trump administration policies. (From the FY 2016 total of 1,183,505 down to 601,660 in FY 2021.) How did the Trump administration reduce legal immigration by 49% without changing U.S. immigration law? The answer is by using executive and administrative authorities, some of which are being challenged in court.

    Below is a review of the impact of administration policies on legal immigration categories since Donald Trump became president.

    Immediate Relatives of U.S. Citizens: The Immediate Relatives of U.S. Citizens category is projected to decline by over 50% between FY 2016 and FY 2021, meaning about 300,000 more spouses, children and parents of U.S. citizens would have been reunited in FY 2021 absent Trump administration policies.

    The three policies most responsible for the decline are the travel ban against primarily Muslim countries, the April 22, 2020, presidential proclamation to prevent the entry of parents of U.S. citizens (and others) and the public charge rule designed primarily to prevent family immigration. “The new public charge rule will likely have two separate impacts on numbers, principally on the immediate relatives and the family preference categories,” according to Jeffrey Gorsky, senior counsel at Berry Appleman & Leiden and a former State Department attorney. Gorsky said in an interview the most direct impact will be increased refusals on public charge grounds. But he thinks the complicated rules and enormous amount of new documentation will slow processing. “That would result in fewer cases making it through the pipeline,” he said.

    Refugees (including the Cuban Adjustment Act): The number of refugees gaining permanent residence (a green card) is expected to decline significantly from FY 2016 to FY 2021. Refugees apply for and usually receive permanent residence (a green card) a year after arriving in the United States, which means the number who become permanent residents lags a year or more. Annual refugee admissions are determined by the president, although according to press reports White House senior adviser Stephen Miller has, in effect, personally determined the number of refugees admitted each year.

    For FY 2020, the Trump administration established an annual ceiling for refugees 84% lower than the final year of the Obama administration (from 110,000 down to 18,000), and as of July 17, 2020, only 7,848 refugees have arrived in the United States in FY 2020.

    In its statistics, the Department of Homeland Security (DHS) includes Cubans paroled into the United States who after waiting a year (or more) applied for and received permanent residence under the Cuban Adjustment Act. New Trump administration policies that affect Cubans and the continuation of certain Obama-era practices have reduced Cuban numbers.

    Asylees: Like refugees, asylees receive permanent residence a year or more after approval. The Trump administration has prevented Central Americans from applying for asylum at the border and made many other changes expected to lower the number of asylum applicants approved each year.

    Family-Sponsored Preferences: The April 22, 2020, presidential proclamation to “suspend” the entry of immigrants seemed designed to prevent the adult children and siblings of U.S. citizens and the spouses, minor children and adult unmarried children of lawful permanent residents from immigrating to America. About 94% of individuals sponsored in the family preference categories must enter the United States to immigrate (as opposed to adjust status inside the country). Although the April proclamation acts as a virtual bar on the entry of new immigrants in the family preference categories, the public charge rule, if applied, would also prevent many people from gaining permanent residence.

    The suspension will likely continue indefinitely if Donald Trump wins reelection unless a judge rules the proclamation to be unlawful.

    Employment-Based Preferences: “A spillover of unused numbers from FY 2020 family-based preferences will be used for the employment-based category in FY 2021 up to the highest recent level of adjustments of status, which was approximately 220,000 in FY 2005,” according to the National Foundation for American Policy analysis. “However, it is possible U.S. Citizenship and Immigration Services (USCIS) will not achieve that level of processing and legal immigration in FY 2021 will be lower, particularly given the financial difficulties experienced by USCIS.”

    Diversity Visas: The Diversity Visa category, a target of the Trump administration, will be zeroed out so long as the suspension on new immigrants continues.

    As the election nears, the Trump administration, under the guise of “merit-based” immigration, appears poised to enact other measures to reduce immigration. Currently, H-1B visa holders and many close relatives of U.S. citizens cannot come to America.

    The Trump administration has enacted the most sweeping immigration reforms of any U.S. presidency and has accomplished this through broad-brush measures, as well as utilizing minute technical loopholes in the law, and the coronavirus pandemic to get around Congress, according to a report released Friday by the Migration Policy Institute.

    The report, “Dismantling and Reconstructing the U.S. Immigration System — A Catalog of Changes under the Trump Presidency,” found immigration to be President Donald Trump’s No. 1 goal during his first term and that he was able more than any predecessor before him to enact change by issuing over 400 executive actions, taking advantage of existing laws and shutting down the Southwest border to all asylum-seekers under the guise of COVID-19.

    “The administration of President Donald J. Trump has dramatically transformed the U.S. immigration system, in bold-brush, sweeping ways but also in small technical details across the immigration portfolio. After pledging to take one of the most activist agendas on immigration in modern times, the administration has delivered on nearly everything the president promised on the campaign trail, almost exclusively via executive fiat, ignoring a Congress he had originally pledged to work with on systemic reform,” the report found. “Trump has dismantled and reconstructed many elements of a U.S. immigration system that was last reformed in 1996. Humanitarian protections have been severely diminished. The U.S.-Mexico border is more closed off than perhaps any time in U.S. history. Immigration enforcement appears more random. And legal immigration has experienced a historic contraction.”

    Report co-author Sarah Pierce told Border Report that the Trump White House has “moved at a rapid-fire pace doing executive action after executive action — some of them have been bold sweeping motions, but a lot of them have been very small technical changes that haven’t really risen to the public’s attention.”

    This includes the utilization of a 1944 relatively unknown law called the Title 42 Public Health Charge, which the administration cited in shutting down the U.S. borders with Mexico and Canada on March 20 to stop the coronavirus from spreading. The administration has extended the restrictions at least through the end of August and many analysts believe he will continue to keep the borders closed until the Nov. 3 election.

    “With this dual crisis of a public health crisis and an economic crisis on the back of this pandemic you’d expect this administration’s agenda to take a backseat, and that just hasn’t been true at all. They’ve been more active than ever and have used the pandemic as an opening to accomplish some of the things they weren’t able to accomplish previously including completely closing off the Southwest border from asylum-seekers, limiting the number of legal immigrants coming into the country, and limiting the number of temp workers coming into the country,” said Pierce, who is an immigration policy analyst for the nonpartisan think-tank based in Washington, D.C.

    The 115-page report found that during Trump’s time in office, his administration has successfully been able to limit entry into the United States, especially arrivals from the Mexico border, by implementing policies such as the Migrant Protection Protocols (MPP) program, which forces migrants to remain in Mexico during their U.S. immigration hearings, and third-country agreements that the Department of Homeland Security reached with Guatemala, Honduras, and El Salvador, which require migrants to claim asylum in the countries they pass first after leaving their homelands.

    “Together, the policy regime blocked asylum access or eligibility for the vast majority of
    asylum seekers,” the report found.

    The vast majority of those placed in MPP have not been granted asylum, with only a sliver of applicants actually being accepted into the United States, migrant advocates say. Many have waited for over a year in tent encampments, such as one in Matamoros, Mexico, during their court proceedings, which have been placed on hold indefinitely with the coronavirus pandemic.

    The president has been successful certainly in sealing off the southern border from arrivals,” Pierce said.

    The report found the administration has successfully limited U.S. immigration through: travel bans; reduced visa processing; enhanced border security; interior enforcement; tougher immigration courts rules and regulations; and repeated efforts to stop programs like Deferred Action for Childhood Arrivals.

    A couple of areas that Trump has not been as successful is in nationwide implementation of an E-Verify system that would electronically verify that all employed workers have proper work authorization. He also has not been able to implement measures to verify birthright citizenship, as he has promised during his campaign. And, if re-elected, Pierce says she expects these are two areas the Trump administration would stress during its next four years.

    PROTECTING AMERICAN WORKERS: President Donald J. Trump is taking action to prevent Americans from being displaced by foreign workers and offshore labor using Federal dollars.

    President Trump is signing an Executive Order to create a policy where Federal agencies will focus on United States labor in lucrative Federal contracts.
    It would be unfair for Federal employers to replace perfectly qualified Americans with workers from other countries.
    The Executive Order will require all Federal agencies to complete an internal audit and assess whether they are in compliance with the requirement that only United States citizens and nationals are appointed to the competitive service.
    The Department of Labor will also finalize guidance to prevent H-1B employers from moving H-1B workers to other employers’ job sites to displace Americans workers.

    PREVENTING HARMFUL OUTSOURCING: This Executive Order will help prevent Federal agencies from unfairly replacing American workers with low-cost foreign labor.

    This Executive Order follows the federally-owned Tennessee Valley Authority’s (TVA) announcement that it will outsource 20 percent of its technology jobs to companies based in foreign countries.
    TVA’s action could cause more than 200 highly-skilled American tech workers in Tennessee to lose their jobs to low-wage, foreign workers hired on temporary work visas.
    TVA’s decision is also expected to cost the local economy tens of millions of dollars over the next 5 years.
    Outsourcing hundreds of workers is especially detrimental in the middle of a pandemic, which has already cost millions of Americans their jobs.
    Given the current climate of rampant intellectual property theft, outsourcing IT jobs that involve sensitive information could pose a national security risk.
    President Trump’s actions will help combat employers’ misuse of H-1B visas, which were never intended to replace qualified American workers with low-cost foreign labor.

    PRESERVING JOBS FOR THE AMERICAN PEOPLE: Throughout the pandemic, President Trump has followed through on his promise to put American workers first.

    As we recover from the pandemic, President Trump has taken action to ensure that American workers never have to remain on the sidelines while being replaced by new foreign labor.
    To protect jobs for American workers, President Trump has placed a temporary pause on new immigration into the country from multiple visa categories.
    President Trump extended the suspension to the end of the year and added several job-related nonimmigrant visas.
    The Administration finalized regulations to eliminate the incentive to file an asylum application for the primary purpose of obtaining an Employment Authorization Document.
    President Trump initiated reforms to the H-1B program to prioritize high-wage workers and close loopholes to ensure American workers are not displaced by low cost foreign labor.

    Trump's action was in part to prevent the outsourcing of jobs at the Tennessee Valley Authority, the federally owned corporation created by congressional charter in 1933 to provide electricity, economic development and other essential services to the region.

    At the White House signing ceremony Monday, Trump said he's pushing for the removal of authority CEO Jeff Lyash and called on its board to make sure Lyash "does not receive a lavish compensation package upon his departure too."

    "He gets $8 million a year, so that was just a succession of deep swamp things happening, and it's a disgrace," Trump said. "So let this serve as a warning to any federally appointed board. If you betray American workers, then you will hear two simple words, 'You're fired.'"

    Lyash almost immediately after the order signing contacted the White House, saying he wanted to settle the labor dispute. But Trump nevertheless fired Lyash, according to the Associated Press.

    Close to 700 immigrants working in the U.S. illegally were detained last year during what federal prosecutors have called “the largest single-state worksite enforcement operation in our nation’s history.”

    Now four higher-ups at the Mississippi chicken plants where they were employed face criminal charges.

    The U.S. District Attorney’s Office for the Southern District of Mississippi unsealed indictments Thursday against two supervisors at A&B Foods Inc. as well as a human resources manager and plant manager at Pearl River Foods Inc.. They are accused of hiring undocumented workers and lying to law enforcement, according to a news release.

    “This office has a successful history of prosecuting employers for violating our immigration laws, and today marks another step in ensuring that justice is fairly and impartially done, no matter the law-breaker,” U.S. Attorney Mike Hurst said in the release.

    A&B is associated with distributor MP Foods Inc., the Clarion-Ledger reported.

    Pearl River runs a poultry processing plant in Carthage, Mississippi, according to its website.
    ICE raids net hundreds of arrests

    U.S. Immigration and Customs Enforcement officials raided seven food processing plants in six Mississippi towns in August 2019, ultimately taking 680 people into custody.

    About 300 were released almost immediately after — at least 30 of whom on humanitarian grounds, The Sun Herald reported.

    Officials offered four possible scenarios for those arrested: criminal charges, deportation, release on the condition they appear before an immigration judge and detention.

    According to Thursday’s news release, the raid resulted in 126 indictments, 117 criminal arrests and 73 convictions. Prosecutors have also accused more than 400 people of falsifying Social Security information “in order to gain illegal employment in the United States.”

    Charges against A&B Inc. managers

    Thursday’s indictments mark the first criminal action federal prosecutors have taken against company managers after last year’s ICE raids.

    “Companies who intentionally or knowingly base their business model on an illegal workforce deprive law abiding citizens and lawful immigrants of employment opportunities, which are especially critical as our economy looks to recover from the challenges faced by the COVID-19 pandemic,” ICE deputy director Matthew T. Albence said in the news release.

    According to the release, Salvador Delgado-Nieves, 57, and Iris Villalon, 44, from A&B Inc. are charged with “harboring illegal aliens” and making false statements to law enforcement.

    Delgado-Nieves is also accused of helping obtain fake Social Security cards for the workers, and Villalon faces an additional charge of allowing false quarterly wage reports to be filed, prosecutors said.

    Delgado-Nieves could serve up to 74 years in prison and owe $2.5 million in fines if convicted, according to the news release.

    Villalon faces up to 20 years in prison and $750,000 in fines.
    Charges against Pearl River Foods managers

    At Pearl River Foods, human resources manager Carolyn Johnson, 50, and manager Aubrey “Bart” Willis, 39, were also indicted on charges of “harboring illegal aliens,” prosecutors said.

    Johnson is additionally accused of committing wire fraud and identity theft, according to the news release.

    “The indictment charges both defendants with harboring illegal aliens following the execution of federal warrants at the Pearl River Foods facility on August 7, 2019,” the release states.

    If convicted, the maximum sentence for Johnson is 84 years in prison and $2.25 million in fines. Willis faces up to 50 years in prison and $1.25 million in fines.

    But prosecutors hinted the four managers won’t be the only individuals charged as a result of last year’s raids.

    “The indictments unsealed today mark the beginning, not the end, of our investigations and prosecutions,” Hurst said in the news release. “Rest assured that we will continue to pursue criminal wrongdoers and enforce our criminal laws wherever the evidence may take us.”

    A federal appeals court has effectively green-lighted the Trump administration’s plan to expel more than 300,000 undocumented immigrants from El Salvador, Nicaragua and Sudan from the U.S. by ending the “temporary protected status” they have enjoyed for as long as two decades.

    A 9th U.S. Circuit Court of Appeals panel ruled, 2-1, Monday that a federal judge in San Francisco erred in 2018 when he blocked the administration’s move to terminate the deportation protections granted to nationals of four countries because of natural disasters, wars or other upheavals in their homelands.

    While the 9th Circuit’s decision also lifted that injunction with respect to unlawful immigrants from Haiti, a New York federal judge’s injunction preventing Haitians from being deported remains in place.

    “The Secretary’s discretion to make TPS determinations, while not without check, is undoubtedly broad and unique in nature,” Judge Consuelo Callahan wrote in the appeals court’s majority opinion, joined by Judge Ryan Nelson. “The decision to designate any foreign country for TPS begins and ends with the Secretary, so long as certain limited statutory criteria are met.”

    The appeals court panel also rejected arguments that the moves to end TPS for the four countries at issue was driven by President Donald Trump’s alleged racial and anti-immigrant bias demonstrated through a series of inflammatory public comments, including in a January 2018 discussion where he referred to “$#@!hole countries.”

    “Plaintiffs fail to present even ‘serious questions’ on the merits of their claim that the Secretaries’ TPS terminations were improperly influenced by the President’s ‘animus against non-white, non-European immigrants,'” wrote Callahan, an appointee of President George W. Bush. She added that the suit suffered from “a glaring lack of evidence tying the President’s alleged discriminatory intent to the specific TPS terminations.”

    Callahan said it was not improper for White House officials to emphatically urge officials at DHS to terminate the TPS programs. “The mere fact that the White House exerted pressure on the Secretaries’ TPS decisions does not in itself support the conclusion that the President’s alleged racial animus was a motivating factor in the TPS decisions,” she wrote.

    This week, President Donald Trump's administration unveiled proposed rule changes that would dramatically alter student visas, leaving the international student community reeling just a few weeks into the 2020-21 academic year.

    According to Yale-Loehr's analysis, the latest proposed changes would, among other things:

    Require most international students to finish their studies in four years — even though, according to the National Student Clearinghouse, most first-time college students take more than five years to earn a bachelor’s degree, and many doctoral programs also take more than four years;

    Limit stays for some international students to just two years;

    Require many international students to apply for extensions to their visas with no guarantee that they’d receive them, especially if the immigration agency determines that the student is not making sufficient progress toward their degree.

    Students born in certain countries — particularly African nations, as well as Middle Eastern countries such as Afghanistan, Iran and Iraq — would be limited to two-year visas, which means no four-year degrees.

    “Amending the relevant regulations is critical in improving program oversight mechanisms; preventing foreign adversaries from exploiting the country’s education environment; and properly enforcing and strengthening U.S. immigration laws,” said Ken Cuccinelli, a senior immigration official in the Department of Homeland Security.

    Foreign students could apply to extend their stay or reapply for admission to the country, Cuccinelli said.

    hile entry in to the US for refugees has been suspended this year due to the coronavirus, driving the tally from the 2020 fiscal year to just 9,000 refugees as of Aug. 31 (one month before the end of the fiscal year). With the new fiscal year starting Thursday, the administration's Department of Homeland Security, along with Health and Human Services, submitted "the President's Report to Congress on the Proposed Refugee Admissions for Fiscal Year 2021", asking for just 15,000 refugees for the 2020-2021 fiscal year.

    In the report, the administration acknowledges that it expects to receive more than 300,000 applications for refuge and asylum. Of these, the US will only accept 15,000 - max.

    Trump suspended processing of refugees between March and July, and the pace hasn't exactly rebounded.

    The Trump administration announced plans Tuesday to sharply limit visas for skilled workers from overseas, a move officials said was a priority amid job losses caused by the coronavirus pandemic.

    Department of Homeland Security and Department of Labor officials said new rules for what’s known as the H1-B program will restrict who can obtain a work visa and will impose additional salary requirements on companies seeking to hire foreign workers.

    Acting Deputy DHS Secretary Ken Cuccinelli said about one-third of the people who have applied for H1-B visas in recent years would be denied under the new rules, which also will include limits on the number of specialty occupations available under the program.

    President Donald Trump in June issued an order temporarily suspending the H-1B program until the end of the year.

    The new rules reflect a broader effort by his administration to curb both legal and illegal immigration, an issue important to Trump’s base even if it’s less prominent in his campaign this year than in 2016.

    A new requirement that employers pay higher prevailing wages to foreign workers will take effect in the coming days, reflecting the need to help the job market recover from the coronavirus shutdown, said Deputy Secretary of Labor Patrick Pizzella.

    “With millions of Americans looking for work, as the economy continues its recovery, immediate action is needed to guard against the risk lower-cost foreign labor can pose to the well-being of U.S. workers,” Pizzella said.

    New Mandatory Bars Prevent Convicted Felons, Drunk Drivers, Gang Members, and Other Criminal Aliens from Receiving Asylum

    Today, the Department of Justice and the Department of Homeland Security announced the publication of a Final Rule amending their respective regulations to prevent certain categories of criminal aliens from obtaining asylum in the United States. The rule takes effect 30 days after publication of the Final Rule in the Federal Register, which is scheduled to occur on Wednesday, Oct. 21.

    Asylum is a discretionary immigration benefit that generally can be sought by eligible aliens who are physically present or arriving in the United States, irrespective of their status, as provided in section 208 of the Immigration and Nationality Act (INA), 8 U.S.C. § 1158. However, in the INA, Congress barred certain categories of aliens from receiving asylum. In addition to the statutory bars, Congress delegated to the Attorney General and the Secretary of Homeland Security the authority to establish by regulation additional bars on asylum eligibility to the extent they are consistent with the asylum statute, as well as to establish “any other conditions or limitations on the consideration of an application for asylum” that are consistent with the INA.

    To ensure that criminal aliens cannot obtain this discretionary benefit, the Attorney General and Secretary of Homeland Security have exercised their regulatory authority to limit eligibility for asylum for aliens who have engaged in specified categories of criminal behavior.

    The new bars apply to aliens who are convicted of:

    (1) A felony under federal or state law;

    (2) An offense under 8 U.S.C. § 1324(a)(1)(A) or § 1324(a)(1)(2) (Alien Smuggling or Harboring);

    (3) An offense under 8 U.S.C. § 1326 (Illegal Reentry);

    (4) A federal, state, tribal, or local crime involving criminal street gang activity;

    (5) Certain federal, state, tribal, or local offenses concerning the operation of a motor vehicle while under the influence of an intoxicant;

    (6) A federal, state, tribal, or local domestic violence offense, or who are found by an adjudicator to have engaged in acts of battery or extreme cruelty in a domestic context, even if no conviction resulted; and

    (7) Certain misdemeanors under federal or state law for offenses related to false identification; the unlawful receipt of public benefits from a federal, state, tribal, or local entity; or the possession or trafficking of a controlled substance or controlled-substance paraphernalia.

    Aliens who have committed certain domestic violence offenses, even if not convicted, will also be barred from asylum.

    U.S. legal permanent residents who apply for citizenship through naturalization on or after Dec. 1, 2020, will face a more challenging test — in which immigrants must prove they can read, write and speak basic English, and have essential knowledge of U.S. history and government.

    U.S. Citizenship and Immigration Services (USCIS) announced Friday the implementation of a revised version of the citizenship civics test for naturalization applicants with a filing date (also known as a receipt date) of Dec. 1, 2020, and beyond.

    The test will evaluate an immigrant’s knowledge of American history, government and civic values, said the immigration agency, which a year ago announced the creation of a working group to review and update the test questions.

    “USCIS has diligently worked on revising the naturalization test since 2018, relying on input from experts in the field of adult education to ensure that this process is fair and transparent,” said USCIS Deputy Director for Policy Joseph Edlow in a news release.

    The Department of Homeland Security (DHS) has announced a proposed rule that would limit work permits for illegal aliens who are pending deportation and who have been temporarily released from DHS custody on an order of supervision (OSUP).

    The public was informed of the proposed rule (“Employment Authorization for Certain Classes of Aliens With Final Orders of Removal”) in a November 17 news release from the U.S. Citizenship and Immigration Services (USIC). The proposed rule was published in the Federal Register two days later.

    The press release explains that “orders of supervision” allow DHS to place conditions on and monitor illegal aliens with “final orders of removal” who have been temporarily released from DHS custody until DHS has the travel documents necessary to deport the alien from the United States, including:

    • Aliens must cooperate with efforts to obtain the travel documents for deportation.

    • Aliens must check in with DHS on designated dates.

    • Aliens must present themselves for removal (deportation) once it is arranged.

    “Authorizing employment benefits to aliens who have already had due process and have been ordered removed by the U.S. government undermines the rule of law and weakens DHS enforcement and removal operations,” the release quoted USCIS Deputy Director for Policy Joseph Edlow. “This effort would also remove the economic incentive for these aliens to not cooperate in the effort to obtain travel documents to return to their home countries.”

    The release noted that under current regulations, an illegal alien who has a final deportation order (called an “order of removal”) and is temporarily released from DHS custody on an OSUP is usually eligible for an employment authorization document (EAD, Form I-765). The EAD, known popularly as a “work permit,” is a document issued by USCIS that provides its holder with a legal right to work in the United States.

    An illegal alien who receives a work permit has little incentive to depart or cooperate with his country of citizenship to obtain travel documents to leave the United States.

    While the proposed rule is undoubtedly a step in the right direction, the release notes some curious exceptions. For example, under the new rule, “only a small subset of these aliens who can demonstrate that DHS has determined that their removal from the United States is impracticable would remain eligible for discretionary employment authorization.”

    One wonders what circumstances would render the deportation of an illegal alien “impracticable” and why whatever impediment to their removal could not be removed, rather than providing them with “discretionary employment authorization.”

    The proposed rule also would limit the validity period of employment authorization for illegal aliens released on an OSUP to one year, raising the question of why an illegal alien should be authorized to work for an entire year pending deportation.

    The final rule cuts off asylum access for most migrants arriving at the U.S.-Mexico border through a series of changes to eligibility criteria, according to experts and advocates. In addition, it directs immigration judges and asylum officers to deny broad types of asylum claims, such as those based on domestic abuse and gang violence, with some exceptions.

    The new rule instructs asylum officers and judges to weigh negatively applications from migrants who crossed into the United States illegally, used fraudulent documents, or passed through other countries without seeking refuge elsewhere first.

    The rule will "eviscerate" migrant protections if it remains in place, said Aaron Reichlin-Melnick, policy counsel at the pro-immigrant American Immigration Council, and "put asylum out of reach for all but the lucky few."
