    Question about jail and charges dismissed

    Let's say someone get arrested and put in jail and stay in jail. Later on, the charges get dismissed before court, or at court. Does the state (federal, state, or local) compensate the person for the time spent in jail?

    That seems like it would be totally backwards. The person in jail should be compensating the state for the costs of their stay. As well as the cost of any consumables used during the arrest (tasers, ammunition, etc). Add a uniform cleaning surchage if there were any beatings involved.
    It's all about taking action and not being lazy. So you do the work, whether it's fitness or whatever. It's about getting up, motivating yourself and just doing it.

    When paying your jail bill you should also be given an "option" to donate $10 to the National Law Enforcement Officers Memorial Fund.
    It's all about taking action and not being lazy. So you do the work, whether it's fitness or whatever. It's about getting up, motivating yourself and just doing it.

    It seems like there should be compensation, I recall and actual 'inmate' that
    served scores of years and was eventually released after being found to
    have not committed 'the' crime, he was compensated financially.


    However, as far as sitting in jail awaiting a hearing, I have no idea but it brings to mind
    an idea that if the State was to compensate , the DA and court might have an incentive
    to go ahead with prosecution of just about anything and try to make 'it' stick, to
    avoid the 'payout' .

    Not here that I am aware of . My best advice is do not get arrested .

    The only recourse would be if there was some aspect of the arrest that was unlawful- then you may could sue for unlawful arrest.

    If the police got a warrant and arrested someone and he was able to cast reasonable doubt or have enough evidence thrown out to get charges dismissed, then that’s the court system at work.

    Best advise is to be able to bond out and not spend any time in jail if you can help it. That way you can work and pony up for an actual legal representation- and not talking about the phony job of a court appointed attorney.

    Poor people have no chance. They get arrested on trivial charges and have to sit in jail for months and months until their hearing.
