Thread: Cops. Unlawful arrest. Pull down mans pants and tase balls to force compliance.

The stop was for an alleged turn signal violation.

Minutes later, Wheatcroft was handcuffed lying face down on the hot asphalt on a 108-degree day. He'd already been tased 10 times, with one officer kneeling on his back as another, Officer Matt Schneider, kicked him in the groin and pulled down his athletic shorts to tase him a final time in his testicles, according to a federal lawsuit and body camera footage obtained by Scripps sister station KNXV-TV.
If this man didn't want to be handcuffed, beaten, and tased in the testicles, maybe he should have used his turn signal appropriately?

After watching the video, I'm sick to my stomach.

    This was all totally unnecessary.

This man was even using words like "please" and "sir".

But he forgot the magic words - "Thank You!"

Just a simple "Thank you Officer for everything that you do" and this could have all been prevented.

Tasered 11 Times Over Turn Signal

    https://www.ericpetersautos.com/2019...r-turn-signal/

    By eric - February 13, 2019

Here’s a particularly awful story and video out of Glendale, AZ – with implications that are national.

Armed government workers followed a car into a parking lot – over an alleged turn signal violation – and almost immediately escalate the traffic stop into a violent “takedown” that ends with the front seat passenger being Tasered 11 times.

He “don’t got no ID,” says the AGW. “Shut up. Shut up. You’re fine.”

The passenger – who was not driving – didn’t make the alleged illegal U turn and so objected to the AGW’s demand for his ID. Many people do not realize – understandably – that when a vehicle is stopped by AGWs because the driver allegedly committed a traffic violation, the law in some states empowers AGWs to demand ID from the passengers as well.

This is another one of those laws designed to get around our ex-protections – articulated in plain English by the Fourth and Fifth Amendments, parsed into the opposite of their plain meaning by the government’s lawyers, who represent its interests rather than ours – i.e., the Supreme Court.

The vehicle’s passengers’ rights are negated because of something the driver allegedly did. It seems obnoxious because it is – and many people are incredulous when confronted with demands for their ID when they themselves violated no traffic or other law – and hence, have given AGWs no probable cause to search or interrogate them.

Well, the man expressed incredulity – and questioned the AGW’s demands.

This affronted the Authority of the AGWs, which is the most dangerous “offense” one can commit in the United States these days.

They commenced to show the man how to respect their Authority:

One AGW almost immediately presses an Agonizer – that is to say, a Tazer – directly on the man’s right shoulder and begins barking orders. The man “tenses up” – as most people would probably do when an armed government thug appears almost out of the blue and begins barking orders and making violent threats.

    The Tazering commences.

Not once, not twice. Not even thrice. Not even three times thrice. They hit him 11 times with the Agonizer. Some will recognize the Star Trek reference; it is from the classic series episode, Mirror Mirror – in which the transporter sends Kirk to an alternate universe where the Federation is evil and the crew of the Enterprise is kept in line via the threat of a device called an Agonizer – which looks remarkably like a Tazer and does exactly what a an actual Taser does do.

That was 1966 – and science fiction.

This is 2019 – and reality.

Roadside torture for noncompliance. Which ought not to be surprising given the legalization of torture – literally – by the federal government itself. The legacy of The Chimp, now safely retired to paint John Wayne Gacy-like watercolors – and official policy. If it is okay to torture “evildoers,” it is okay to torture anyone the government says is “evil” – which amounts to anyone who affronts its Authority, which is – ipso facto – the very essence of “evil.”

Oil poured in the creek tends to run downstream.

“It’s just a goddamn piece of paper,” after all.

    But wait, it gets better.

    Actually, much worse.

The AGWs pull the man’s pants down and deliberately Taser him in his testicles – while the man’s kid, who is riding in the back of the car watches.

    Yes, really.

Remember: The man is writhing in agony – on the ground, utterly helpless. And they pull his pants down and attack his genitals, just for the sick pleasure they got from doing it.

And the AGW who did it has not been arrested. Much less fired. His compatriots didn’t intervene to stop this attack 0 which was worthy of Ralph Fiennes’ sadistic character Amon Goeth in Schindler’s List.

The inhumanity beggars belief – and it was done under color of law.

They are “investigating” the incident “internally.

What does one say? Words fail. It takes one’s breath away.

What the Hell is happening to this country?

There is no “other side” to this story. The entire event from beginning to end is captured on video. No question as to the facts. The man balked at handing over his ID. Nothing more. The man – half the size of the bald thug who tortured him – was never any sort of “threat” to the “safety” of the AGWs, who were several to his one as well.

No one even attempted to flee.

There is nothing that can be adduced to justify what happened – other than a costumed, government-Rottweiler’s determination to inflict pain as the price of not properly submitting to him.

This “man” is at this very moment armed and prowling the streets of Glendale, AZ. People are advised to remain indoors.

And not just the people of AZ, either.

This horror is far from isolated. It is becoming routine – because abuse has been normalized.

It didn’t happen all at once, because it never does. It takes time.

    And, precedent.

To get people used to it. To acclimate them to violations of their persons and effects by the state’s goons.

This is why random “checkpoints” are far from innocuous – and why the Gate Rape is so goddamn dangerous. One thing begets another thing.

    And here we are.

Once you hear them say "stop fighting!" or "stop resisting!" when you are fukking handcuffed you know he is a psycho setting you up for the kill. Start yelling at the top of your lungs "I am not resisting!"

It is an instrument of torture. These cops are treating US citizens now as if they were jihandi suspects in the street in Iraq. Most disturbing is their blase attitudes. "Stop being a big baby." Then they terrorize the little kid who's going to be traumatized the rest of his life.

Experts: Glendale officer who tased man 11 times could not have seen alleged turn signal violation

The Glendale police officer who repeatedly tased a handcuffed man could not have seen the alleged turn signal violation that he claimed was the reason for the stop, according to experts who reviewed surveillance video, body camera footage, and documents …

the evidence clearly shows that Officer Matt Schneider made up the reason for the traffic stop …

Jeff Noble, an expert witness, attorney, and former deputy police chief … also said the department’s failure to properly investigate and discipline Schneider regarding the false claims raises serious concerns about the Glendale Police Department’s ability to competently and accurately conduct internal investigations. … “What the department did, I would put at a level even worse than Schneider’s conduct,” Noble said. …

“The evidence that not only did this horrific incident occur, but it was based on an untruthful act by an officer,” he said. “Which tells me that the organization is engaged in covering up at least portions of the conduct of this officer." …

Officer Schneider said he “observed the listed vehicle (Ford Taurus) fail to use its turn signal when it drove from Glenn Drive into the Motel 6 parking lot,” police records show. Schneider also repeated the claim to other officers at the scene, according to his body camera footage. …

Surveillance video shows the Taurus pull into the Motel 6 parking lot from the south and then back into the first parking space. Shortly later, the police SUV can be seen entering the parking lot from a back alley on the opposite side of the property. …
Officers Matt Schneider and Mark Lindsey exit the police vehicle and approach the car. …

After the stop, Schneider also tells Wheatcroft that he is required to produce ID if he is the passenger in a vehicle involved in a traffic stop, and that if he doesn’t provide it, he can be arrested and fingerprinted. Both are also false statements, experts said.

Aside from the video evidence proving Schneider could not have seen the violation, Noble said the actions of the officer also raise red flags. “The controlling officer is not going to the driver’s side and investigating the turn signal. He’s focused on the passenger,” Noble said. “Which tells me maybe that’s not why we’re here. They’re not really interested in this turn signal violation."

    VIDEO AND PHOTO EVIDENCE
The Motel 6 at 7116 N. 59th Avenue is two separate two-story buildings split with a center parking lot.
The buildings have thick vegetation in front and do not have exterior windows, making it impossible to see through from one side or the other.
Below is a diagram of the property showing the back alley, where the Glendale police vehicle drove in, and Glenn Drive, where the Ford Taurus entered. The yellow line shows the approximate known route of Officer Schneider and the orange line shows the approximate known route of Johnny Wheatcroft.

Surveillance video from the building shows that when the Taurus enters the lot, the Glendale vehicle can’t be seen emerging from the back alley until about a second or two later. Body camera footage also shows the officers driving in the back alley for about 15 seconds before turning into the center parking lot. In the video, the buildings of the back alley can be seen passing by in the vehicle’s windows. “It’s not possible for Schneider to see a turn signal,” …

a Glendale investigator assigned to the look at the criminal case involving the use-of-force incident also concluded, “it seems unlikely that Officer Schneider could have seen them turn into the parking lot from Glenn Drive.” Noble said the word “unlikely” is being too kind. .. “It’s just simply not true.”

But the final internal investigation findings issued by Glendale police did not sustain any allegations of untruthfulness against Schneider regarding the traffic signal – or even mention it at all. …

Glendale settles lawsuit with man tasered 11 times
A settlement was reached after a mediation hearing in late September, records show
    https://www.abc15.com/news/abuse-of-...sered-11-times
    Dave Biscobing (14 December 2022)

GLENDALE, AZ — The City of Glendale has settled a years-long federal lawsuit against police officers who made up a blinker violation, unlawfully threatened a passenger with jail, and then tasered him nearly a dozen times.

The terms of the city’s settlement with Johnny Wheatcroft and his children are confidential and will be finalized after a probate judge’s approval, according to court records.

After a series of emails seeking comment, Glendale officials wrote, “We will have no further comment on this case now or in the future.”

A spokesperson would not provide ABC15 with the amount of the payout, the amount spent on litigation in the case, or explain the remaining steps for the city to complete the settlement.

“This case has not been settled by all necessary channels. Once it is officially settled and you have submitted a public records request, our City Clerk’s office can provide what our legal advisors allow us to provide at that time,” said Derek Diesner, Glendale’s media relations coordinator.

Outside attorneys for Glendale aggressively litigated the case, and Wheatcroft’s claims survived motions for summary judgment and to dismiss.

A settlement was reached after a mediation hearing in late September, records show.

One of the involved officers, Matthew Schneider, is currently facing multiple felony aggravated assault charges and is set for trial next year.

In July 2017, Schneider and other officers repeatedly tasered Johnny Wheatcroft, who was the passenger in a vehicle stopped for an alleged blinker violation.

In front of his two children, Wheatcroft was tasered 11 times.

Schneider delivered the final tase to a handcuffed Wheatcroft by pulling down his shorts and stunning him in the testicles, according to his lawsuit.

In February 2019, ABC15 exposed body camera video of the disturbing incident, and it immediately drew national attention and outrage.

Surveillance video also showed Schneider lied about witnessing the alleged blinker violation, experts said.

Multiple independent law enforcement experts, who reviewed the incident, said Schneider’s conduct was unlawful, and one of the most cruel and troubling cases of police misconduct they’ve ever seen.

Without public exposure, the case would not have been criminally investigated further.

The Arizona Attorney General’s Office was forwarded the case in June 2020 by the Maricopa County Attorney’s Office. Under former County Attorney Bill Montgomery, MCAO initially declined to file charges against Schneider in 2017.

But the business day after ABC15’s initial 2019 report, the FBI opened a criminal investigation into the matter.

Once the FBI opened its investigation, an MCAO spokesperson said federal agents asked the office if it would re-evaluate the case for state-level charges.

In 2020, the former county attorney, Allister Adel, declared a conflict and had the case sent to the AG’s Office. A spokesperson said Schneider had once coached Adel’s sons in Little League.

At the time of the incident, Glendale conducted an internal investigation into the case and suspended Schneider for three days.

Schneider, who was one of Glendale’s top arrest leaders, has been suspended or disciplined by the city at least six times, according to his personnel file. The issues range from excessive force in the Wheatcroft incident to persistent workplace harassment against a female officer in his unit.

Schneider is no longer on the job.

In March 2020, Glendale’s city pension board approved Schneider’s early retirement for an accidental disability claim. Details about the nature of his disability are confidential.

No jail time for former Glendale officer who repeatedly used stun gun on handcuffed man
    https://www.azcentral.com/story/news...n/69820649007/
    Perry Vandell (25 January 2023)

    [bold emphasis added - OB]

A former Glendale police officer who was charged with three counts of aggravated assault after repeatedly using a stun gun on a handcuffed man in 2017 was fined $100 on Friday afternoon after pleading guilty to one count of disorderly conduct — a Class 1 misdemeanor. He will serve no jail time or probation.

The former officer, Matt Schneider, garnered widespread media attention in 2019 after bodycam footage showed Schneider using a stun gun on then 39-year-old Johnny Wheatcroft 11 times during a traffic stop on July 26, 2017, including after Wheatcroft was on the ground and handcuffed.

In 2018, Wheatcroft sued the city, Schneider and other officers involved in U.S. District Court alleging excessive force, a violation of his civil rights, trauma and emotional harm. Records show the parties reached a settlement in late September 2022, though the amount remains unclear.

Police said officers stopped Wheatcroft, who was traveling in a car with his wife and two children, over a turn signal violation. Police documents claim Wheatcroft initially refused to show identification to the officers and asked why he needed to before reaching into a backpack under his seat.

The lawsuit alleges Schneider then attempted to pull Wheatcroft, who still had his seatbelt on, out of the vehicle while using a stun gun on him multiple times in the back.

It then claims the officer continued to use the stun gun on Wheatcroft even after he was handcuffed on the ground, kicked him in the groin and that Schneider "pulled down Plaintiff’s shorts and Tased his testicles and perineum."

Wheatcroft can be heard in bodycam video repeatedly saying, "I'm not doing nothing." His children are heard screaming in the background.

Jose Santiago, a spokesperson for Glendale, said in 2021 that the police department investigated the incident and submitted a report to the Maricopa County Attorney's Office that included possible charges against Schneider.

Santiago said a separate internal investigation found Schneider violated the city's policies and procedures and he was suspended. Schneider ultimately surrendered his peace officer certification following the incident, barring him from being a police officer in Arizona unless he gets recertified.

Bill Montgomery, who was the Maricopa County attorney at the time, initially refused to file criminal charges against any of the officers involved but later referred the case to the FBI after Gov. Doug Ducey urged him to revisit the case, calling the investigation "whitewashed."

The FBI also launched a criminal investigation into the matter. The County Attorney's office reopened the case in 2020 but Jennifer Liewer, a spokesperson for the agency, said then-County Attorney Allister Adel referred the case to the Arizona Attorney General's Office due to a conflict of interest as Schneider coached Adel's son in Little League.

The Attorney General's Office eventually filed three counts of aggravated assault — all Class 6 felonies — in September 2021.
