Tennessee can't revoke driver licenses of people who can't pay traffic fines, judge says

Traffic fines, like court fees, can prove to be an insurmountable barrier for poor Tennesseans who struggle to cobble together basic living expenses. If they can't drive, the plaintiffs argued, it makes it even less likely that they can work and earn the money to pay down the fees.

In an opinion explaining her order, Trauger sided with the plaintiffs who challenged the state, saying "the lack of an indigence exception has resulted in numerous poor Tennesseans with suspensions that they cannot overcome."

The result, she said, was that poor people suffer "both constitutional and material injuries" that "are, or are likely to be, irreparable."

Trauger found that suspensions did nothing to ensure people paid their debt.

Ahh but that is the catch. You are transporting goods when you "drive". "Driving" is a commercial activity. Guess what the commercial "good", "product", "merchandise" being transported from point A to point B is? YOU ARE! More directly, the license is a voluntary contract which identifies the corporation (ALL CAPS NAME) that the transported "good/product/merchandise" belongs to.

The easiest way to comprehend it is: the license/ID doesn't identify you, you identify as the license/ID, whenever it is requested by an officer of the government corporation (cop, DMV, tax office, etc).

You don't have to be licensed for anything. The ALL CAPS NAME is who is licensed.
