    The National Rifle Association says it is facing major financial losses and "irreparable harm" as a result of New York State's crackdown on the gun rights group.
    In a legal filing obtained Friday by Rolling Stone, the NRA said it could soon "be unable to exist" due to a state-wide "blacklisting campaign." The organization claimed it had lost insurance coverage and suffered "tens of millions of dollars in damages" following Gov. Andrew Cuomo (D)'s attempts to cut the NRA off from financial service providers. "Insurance coverage is necessary for the NRA to continue its existence," the organization argued, saying that its conventions, meetings, and day-to-day operations are in danger because of its inability to obtain insurance. The filing also says that the NRA may soon shutter its video streaming service and magazine because of the financial distress, reports Rolling Stone.
    New York regulators stopped the sale of NRA-branded insurance policies that "unlawfully provided liability insurance to gun owners for certain acts of intentional wrongdoing" earlier this year. The halted sales of "Carry Guard" policies pushed the NRA to strike back with a lawsuit, accusing the state government of "abuse" against the group's "advocacy mission." The NRA argues that the state has continued on in a "malicious conspiracy" against the organization's political speech even after shutting down Carry Guard.
    Cuomo has called the lawsuit "a futile and desperate attempt to advance its dangerous agenda to sell more guns." Read more at Rolling Stone.

    NRA finances still shaky despite post-Parkland surge

    If the National Rifle Association were a public company, listed on a major stock exchange, the seemingly insecure financial state of its membership arm might be a reason to worry for its future.

    The NRA membership organization’s 2016 financial filing — the latest report available — is pockmarked with accounting red flags: significant deferred revenues compared to cash balances; high allowances for uncollectible accounts; a negative balance for unrestricted net assets; $43 million in short-term debt; and a cumulative pension liability of $40 million.

    The NRA, founded by Union Army veterans Col. William C. Church and Gen. George Wingate in 1871 to “promote and encourage rifle shooting on a scientific basis,” can count on several sources of funds for its myriad activities over and above the dues, advertising revenues and product sales produced by its tax-exempt, 501(c)l4) membership association. Contributions also pour in to four 501(c)13) public charities (NRA Civil Rights Defense Fund, NRA Foundation Inc, NRA Freedom Action Foundation and the NRA Special Contribution Fund also known as the Whittington Center) and an IRS Section 527 political action committee called the NRA Political Victory Fund, which is a separate segregated fund.

    The NRA Political Victory Fund (PVF PAC), NRA Foundation, Inc., the NRA Civil Rights Defense Fund, NRA Special Contribution Fund and the NRA Freedom Action Foundation report their financial activities separately from the membership organization.

    The NRA membership association branch claims to have about 5 million members, but that is difficult to verify. It has operated as a social-welfare organization since 1944, exempt from taxation on the revenue like a charity but differing from a charity in several ways.

    According to an article by Samuel Brunson, a professor of law at Loyola University Chicago, donors to social-welfare organizations can’t deduct their gifts from their taxable incomes. Social-welfare organizations like the NRA membership arm can also support and oppose political candidates, unlike charities, which would lose their tax-exempt status if they did.

    Finally, social-welfare organizations may lobby lawmakers as much as they want, as long as that effort is related to their core mission. Like charities, social-welfare groups must spend all their revenue on work tied to that mission or supplementing their endowments. They can’t pay out profits to employees, funders or anyone else.

    The arm of the NRA membership organization that lobbies politicians is called the Institute for Legislative Action, or ILA. It was established in 1975, and the NRA website says it “is committed to preserving the right of all law-abiding individuals to purchase, possess and use firearms for legitimate purposes as guaranteed by the Second Amendment to the U.S. Constitution.”

    The NRA’s political spending more than doubled between the 2012 and 2016 electoral cycles, rising to $54.4 million, according to the Center for Responsive Politics, a nonpartisan group that tracks the money reported to the government in federal elections. About $31 million of that sum supported President Donald Trump’s candidacy, according to Brunson’s research.

    PVF PAC is a separately unincorporated NRA political action committee whose five officers are also NRA employees. The NRA routinely provides certain benefits to PVF PAC at no cost, such as use of office space and other administrative and support services. In 2016 the NRA paid $38.8 million for the PVF PAC’s administrative and fund-raising expenses. That is a significant increase from 2015, when the amount provided for PVF PAC’s support, which auditors said NRA executives believed was nonmaterial, was only $4.9 million.

    Donations to NRA PVF, the political-action-committee arm, more than tripled in February 2018 in comparison with January contributions, according to data from the Center for Responsive Politics. That’s after activists, some politicians and celebrities joined the victims of the Feb. 14 mass shooting at Marjory Stoneman Douglas High School in Parkland, Fla., which left 17 dead, to advocate for gun-control measures and called out NRA sponsors and politicians who have received campaign contributions from the organization.

    The PVF PAC raised $779,063 in February after reporting $247,985 in donations in January.

    The Chicago Tribune, citing data from tech company Pathmatics, reported in mid-March that the NRA “aggressively increased” its advertising on Facebook in the weeks after the Parkland attack from an average daily spending of $11,300 in the 24 days before the shooting to $47,300 in the succeeding 24 days.

    The NRA did not respond to a request for comment about the pace of its spending, the proportion of current funding from PAC donations versus memberships and the source of funds for its increased ad spending.

    In the 2016 presidential election year, the NRA’s main membership organization spent more than it collected — $412.7 million vs. $366.9 million — resulting in a decrease of $39.2 million in net assets. That spending depleted its cash reserves by $7 million.

    As of the end of 2016, the NRA also maintained its cash balance in an interest-bearing account in excess of federally insured limits, according to notes prepared to accompany an audit report prepared by RSM LLP. That firm also prepares the organization’s tax returns.

    Prepaid members’ dues allocated to the cost of the magazine are deferred and amortized over the life of the membership. Deferred revenue — what can’t be recognized yet — grew to $39.4 million by the end of 2016 from $26.9 million at the beginning of the year, according to the NRA’s filing with the IRS for that year.

    “As a result of the NRA’s precarious financial position, the organization is now even more dependent on a small number of telemarketing firms to pump up membership rolls,” said Brian Mittendorf, a professor and chair of the department of accounting & management information systems at Ohio State University’s Fisher College of Business. Those membership lists provide a source for other fund-raising campaigns.

    The contract for one firm, Akron, Ohio–based InfoCision, calls for 100% of funds collected via credit card for new memberships and renewal of lapsed memberships to go to the outside firm, according to a contract posted on the North Carolina secretary of state’s charities site. The agreement meant only 52% of the total gross receipts collected by InfoCision in 2016 went to the NRA.

    Mittendorf wrote in January that the U.S. Supreme Court has ruled that state laws capping the share of money that telemarketers may pocket from charities could violate the charities’ free-speech rights. Enforcement cases like the ones in Ohio and Illinois are rare because they can take years of effort, and are resisted by the charities themselves, who even have helped defeat efforts to require telemarketers to tell donors how their gifts are spent.

    Despite signing multiyear contracts with professional fundraisers like InfoCision, and another with a firm called Allegiance that is headquartered at the same Fairfax, Va., address as the NRA, the organization set aside quite a bit for uncollectible accounts in 2016.

    “Reserving more than 25% for uncollectible accounts is quite high for an organization that says it has such a loyal membership base,” said Mittendorf.

    In 2016, the New York Post reported that the NRA failed to list the Political Victory Fund, its PAC, as one of its associated organizations until 2014. It told the IRS it spent nothing on lobbying each year from 2008 to 2013. Finally, in 2014, the NRA recorded $1 million in lobbying expenses, an amount that contradicts the figure reported to Congress of $3.4 million, according to the Center for Responsive Politics.

    In 2014 the NRA also acknowledged for the first time that it receives membership dues, which start at $35 a year.

    After a McClatchy News report suggested that the FBI had been investigating whether a top Russian banker with Kremlin ties illegally funneled money to the NRA to aid Donald Trump’s campaign for president, NPR reported that Senate Finance Committee ranking member Ron Wyden, D-Ore., wrote to ask the organization how and where it raises donations, in the context of other ongoing investigations.

    “While we do receive some contributions from foreign individuals and entities, those contributions are made directly to the NRA for lawful purposes,” NRA general counsel John C. Frazer wrote to Wyden in a letter obtained by NPR. “Our review of our records has found no foreign donations in connection with a United States election, either directly or through a conduit.”

    July 2018 saw the second highest number of background checks for gun sales for any July in history.

    FBI numbers show that there were 1,835,318 background checks in July 2018, and that is second only to July 2016, when there were 2,197,169 background checks.

    Breitbart News reported that June 2018 also witnessed the second most background checks for any June in history. There were 1,935,691 background checks performed in June 2018, second only to the 2,131,485 checks in June 2016.

    The elevated background checks are only the latest evidence of the push back against the 24/7 gun control push that followed the February 14, 2018, Parkland school shooting.

    In March the NRA broke a 15-year fundraising record with nearly $2.5 million for their Political Victory Fund and the Second Amendment Foundation witnessed a 1,200 percent jump in members aged 18-20. Also, March, April, and May each witnessed record background checks, making March 2018 the biggest March in history for background checks, April 2018 the biggest April, and May 2018 the biggest May.

    Background checks are not a perfect indication of the number of guns sold because retail purchasers can buy multiple guns with each background check. But a record number of background certainly indicates a high number of guns sold.

    About 100 protesters, many wearing T-shirts emblazoned with "NRA = Not Real Activists," marched through the National Rifle Association's annual meeting in Dallas in May to slam the powerful gun lobby as too conciliatory on gun rights and rally for their candidate for the board.Adam Kraut, a gun rights lawyer, fell about 4,000 votes short of the 71,000 needed for election, but earned 5,000 more than the previous year, a sign of the growth of the Second Amendment purists within the NRA known to many as "gundamentalists."
    With opinion polls showing U.S. public support for more gun control growing in the wake of mass shootings in recent years, the NRA is facing internal pressure from this little-known force that is demanding that the leadership concede zero ground to gun-control advocates.
    Its rise has rattled the NRA leadership and threatens the association's ability to hold on to moderate supporters and to make compromises that might help fend off tougher gun control measures, according to some of the two dozen gun-rights activists, policy experts and gun-control advocates interviewed for this story.
    "Generally, they have a disproportionately huge amount of power in the gun-rights movement," said Richard Feldman, a former NRA lobbyist.
    The NRA has faced divisions before. An internal revolt at the 1977 meeting in Cincinnati turned the polite, sport-shooting organization into a bare-knuckled political lobby that today claims five million members and is closely aligned with the Republican Party, funding pro-gun politicians. The NRA, which spent $30 million to support Donald Trump's 2016 presidential campaign, is often viewed by gun-control advocates as implacably opposed to tighter gun laws.
    The NRA leadership has put up obstacles to Kraut's election, both with bylaws that make it harder for candidates not put forward by the nominating committee to get elected to the board, and by enlisting a senior member to campaign against him.
    Marion Hammer, a past president of the NRA and one of the group's most successful lobbyists, denounced unsanctioned candidates in a column on the website Ammoland just as Kraut appeared on the 2018 ballot. Though Hammer did not name Kraut, he was one of only two non-approved candidates to run.
    "Once again the NRA is being threatened by the enemy within," Hammer wrote. "It is time to wake up and stop it before it begins."
    Neither the NRA nor Hammer responded to requests to address the influence of the gundamentalists and the criticism that these activists and other gun-rights groups directed at the lobby.
    SOCIAL MEDIA PRESSURE
    The Dallas protesters, almost all white men, included bearded outdoorsmen and buttoned-down libertarians. Some said they hid their T-shirts while entering the conventional hall for fear that NRA security would ban them.
    Kraut, 31, who says he grew up in a house without guns but as an adult taught his father how to shoot, practices firearms law in suburban Philadelphia and also hosts a video blog called The Legal Brief on The Gun Collective, a YouTube channel.
    He has campaigned for the NRA to push for even more expansive gun-rights laws. He wants to change NRA bylaws, such as imposing term limits for board members and mandatory meeting attendance, to renew its leadership.
    "Some members feel it (the NRA) doesn't go far enough to defend what we believe to be the core of the Second Amendment," Kraut told Reuters.
    One of Kraut's most prominent supporters, Tim Harmsen, who led the pro-Kraut march through the convention center, has 770,000 subscribers to the Military Arms Channel on YouTube, where he criticizes the NRA for being weak on gun laws.
    "We're going to continue to apply pressure (on the NRA) every way that we can through social media and we'll be there again next year," Harmsen said.
    These hardliners deeply cherish their right under the U.S. Constitution's Second Amendment to keep and bear arms. They oppose any form of gun control, saying criminals will find ways around gun laws, which only strip lawful gun owners of the right to self-defense and protection against state tyranny.
    The gun-rights purists are outraged by any concessions the NRA makes in the wake of mass shootings, even if they are made to avoid stricter gun control laws.

    The American Civil Liberties Union (ACLU) came out in defense of the National Rifle Association (NRA) on Friday, accusing Governor Andrew Cuomo of violating the First Amendment by targeting the group’s access to basic financial services.
    ACLU legal director David Cole sided firmly with the NRA in its ongoing legal battle against the Cuomo administration, which has conducted a sustained campaign to deprive the Second Amendment advocacy group of access to insurance and banking services.
    “In the ACLU’s view, targeting a nonprofit advocacy group and seeking to deny it financial services because it promotes a lawful activity (the use of guns) violates the First Amendment,” Cole wrote. “Because we believe the governor’s actions, as alleged, threaten the First Amendment rights of all advocacy organizations, the ACLU on Friday filed a friend-of-the-court brief supporting the NRA’s right to have its day in court.”
    The NRA sued the Cuomo administration in May, alleging the state financial regulatory agency engaged in a “blacklisting campaign” against banks and insurance companies contracted with the NRA, infringing upon the group’s constitutional right to “speak freely about gun-related issues and defend the Second Amendment.”
    The suit was filed after insurance companies Lockton and Chubb were fined $7 million and $1.3 million respectively for insuring the NRAÆs Carry Guard program, which reimburses licensed gun owners for legal expenses incurred after justifiably firing their weapon.
    NRA officials claim that they have been unable to replace the sanctioned insurance providers, who revoked their services following the fines, due to fear among their competitors that they will be similarly targeted by the state’s regulator apparatus.

    New York Gov. Andrew Cuomo is finding new allies in his campaign to “bankrupt” the National Rifle Association, as three additional states follow his call to take legal action against the gun-rights group’s insurance program.
    And an ethics watchdog anticipates more states could join.
    “It is troubling that we have seen the government targeting individuals and organizations to silence them based on their political positions,” Kendra Arnold, executive director of the Foundation for Accountability and Civic Trust (FACT), told Fox News.
    She cited similarities to the 2016 discovery that state AGs were cooperating to target skeptics of climate change. In the latest case, FACT has filed freedom of information requests with 21 states including the four publicly targeting the NRA – New York, New Jersey, California and Washington state – in search of evidence that might show such coordination here.
    The requests seek communications with “any other Attorney General, Governor, or state insurance official … that mention the ‘National Rifle Association’ … or ‘Carry Guard Insurance.’”
    “Carry Guard” is an NRA-sponsored insurance policy for gun owners who use a firearm in self-defense but face civil or criminal liability expenses. State officials have specifically targeted the Overland Park, Kansas-based Lockton Affinity and the Chicago-based Illinois Union, a member of the Chubb group, which were involved in marketing and selling the NRA insurance plans. The New York Department of Financial Services in May levied a combined fine of more than $8 million against the two companies.


    On Aug. 4, Cuomo said: “I am calling on states across the country to join New York to outlaw this absurd program that insures intentional criminal conduct. … If the NRA goes bankrupt because of the State of New York, they'll be in my thoughts and prayers.”
    The Democratic governor followed up in a letter to fellow governors requesting action against the NRA.
    Cuomo is up for re-election in November, facing Republican opponent Marcus Molinaro, the Dutchess County executive.
    Among his allies in this cause, Washington state Insurance Commissioner Mike Kreidler commenced an investigation after issuing a cease-and-desist order in April against the NRA concerning Carry Guard.
    “The Washington state Office of the Insurance Commissioner (OIC) was in touch with the New York state Department of Financial Services after it sent a letter on Aug. 7 to our commissioner, Mike Kreidler,” Steve Valandra, a spokesman for the insurance commissioner, told Fox News in an email.
    “We found the policies sold by the NRA Carry Guard program were done without an insurance producer license, a violation of Washington insurance law,” Valandra said. “That investigation began in 2017 following a consumer complaint. Our current investigation – following the cease-and-desist order – was prompted by concerns about whether the NRA Carry Guard program may have other consumer issues.”
    Last month, the California Department of Insurance also issued a cease-and-desist order against the NRA insurance, alleging the NRA marketed the product without a license to do so in the state.
    “The Department of Insurance is not working with any other authority regarding the NRA’s compliance issues with the sale of Carry Guard,” California Department of Insurance spokeswoman Nancy Kincaid told Fox News.
    She said the state “insists on full compliance with the California law that requires persons who solicit the purchase of insurance in California must be appropriately licensed to do so.” Kincaid said the NRA has not complied with that requirement, which “led to the administrative action to address the illegal conduct in California.”
    The New Jersey Department of Banking and Insurance also is investigating the NRA, a probe that began in August after Cuomo’s invitation to other states. A spokesperson from the New Jersey department did not respond to inquiries from Fox News.
    NRA lawyer William Brewer pushed back on the state claims, though, telling Fox News the NRA conducted reviews to ensure compliance with state laws where Carry Guard is sold.

    Is the NRA claiming that NY is the only state that has insurance companies and banks? I don't get the issue here. If Cuomo and NY are a problem, go elsewhere for banking and insurance services. It's not like Cuomo can fine an insurance company based in Nebraska.

    U.S. District Judge Thomas McAvoy ruled Tuesday that the NRA’s suit against New York can continue on First Amendment grounds.

    The New York Law Journal reports McAvoy issued his ruling after Gov. Andrew Cuomo (D) and Department of Financial Services Superintendent Maria Vullo sought to have the NRA’s suit dismissed.
    On May 3, Breitbart News reported that New York declared NRA’s Carry Guard insurance program “illegal” and barred it from being marketed in the state. The state also canceled policies of New Yorkers who had already acquired Carry Guard.
    On May 11, 2018, Breitbart News reported that the NRA filed a suit against Cuomo, Vullo, and New York’s Department of Financial Services, claiming the cancellation of Carry Guard policies was part of a larger “blacklisting campaign” against the civil rights organization. The NRA claimed Cuomo and the financial regulator actually acted to prevent NRA from “[speaking] freely about gun-related issues and defend the Second Amendment.”
    In the text of the suit the NRA claimed:
    Together with DFS Superintendent Vullo, his longtime lieutenant, Cuomo has embarked on a campaign to chill the political speech of the NRA and other so-called “gun promotion” organizations by leveraging state power to punishing financial institutions which maintain “business arrangements with the NRA.” To achieve this, Defendants draw upon the formidable regulatory powers of DFS—an agency charged with ensuring the stability and integrity of New York’s financial markets.
    At Cuomo’s behest, Vullo and DFS have threatened, and continue to threaten, regulated institutions with costly investigations and penalties should they fail to “discontinue[] . . . their arrangements with the NRA.” And Defendants have already carried out some of these threats. Within a single week, DFS levied multi-million dollar fines against two insurance-industry firms that dared to do business with the NRA. Under intense scrutiny, both firms were coerced to terminate their business arrangements with the NRA and its members—including arrangements having nothing to do with the allegedly unlawful conduct cited by DFS. A DFS press release publicizing one recent enforcement action makes clear the gravamen of Defendants’ campaign: financial institutions regulated by DFS must refrain from “[e]ntering into any . . . agreement or arrangement,” which “involv[es] the NRA, directly or indirectly”—or face the consequences.
    The case is NRA v. Cuomo, No. 18-CV-0566 in the Northern District of New York.
