    South African President Cyril Ramaphosa has promised to speed up the controversial land reform proposed by the ruling African National Congress (ANC) earlier this year.
    “We are making history and celebrating the return of your land today. We are righting the historic injustice and returning the land to its rightful owners,” the president said at the handover of 4‚586 hectares of land to the community of KwaMkhwanazi at Empangeni in northeastern KwaZulu-Natal.
    Ramaphosa admitted that his government has been too slow in the process of restitution and redistribution of farmlands, stressing that land is a key pillar for economic emancipation and freedom.

    “We are commencing a rolling mass land distribution program in our country. We will be returning land in a massive way. This Mkhwanazi land is the first‚” the president said. “Today we are making history‚ celebrating the return of the land to our people in this area.”

    The KwaMkhwanazi community had been evicted from the lands the previously possessed in several steps: the first, shortly after World War I, and then in the 1940s when commercial cane and timber operations were expanded.

    South Africa’s High Court rejected a legal challenge on Friday brought by a group representing white farmers against President Cyril Ramaphosa’s plans for land expropriation without compensation.

    In its legal challenge, Afriforum questioned the legality of a key parliamentary committee report which recommended a change to the constitution to allow land expropriation without compensation.
    “The relief sought by the applicants... is dismissed,” said Judge Vincent Saldanha.
    Afriforum, which represents mostly white Afrikaners, alleged that the parliamentary committee had illegally appointed an external service provider to compile the report, and also failed to consider more than 100,000 submissions opposing land expropriation without compensation.
    Around 65 percent of public submissions were against a change, according to parliamentary officials.
    Parliament successfully countered Afriforum’s case by saying the court action was premature, the committee had not abrogated its powers and all views had been taken into account.
    “We welcome the orders handed down today particularly because we’ve always been of the view that the matter was not urgent,” Lewis Nzimande, co-chair of the constitutional review committee, told reporters outside the High Court in Cape Town.
    “They (lawmakers) may set aside the recommendations, they may reject the recommendations but procedurally... we can’t just reject the whole work of the committee,” he said.
    He said the report, just one step in a long process to change the constitution, will probably be debated in both houses of parliament on December 4.
    Thereafter, it is expected a new bill proposing the exact changes envisaged to the constitution will go to parliament and further public participation.
    Only once both houses of parliament approve changes to the constitution will it be sent to Ramaphosa for ratification. This process is unlikely to be completed before a parliamentary election expected to be held in May.


    Afriforum said after the judgment they would continue challenging what they say is a flawed process, including through further legal action.

    “AfriForum therefore undertakes to use every possible mechanism at its disposal to, in the interest of everyone in the country, fight to the bitter end against the undermining of property rights,” it said in a statement.

    An advisory report on land reform in South Africa has recommended changing the constitution to allow the government to seize land without compensation but only in certain circumstances.The report by a presidential panel of experts, released on Sunday, poured water on wholesale land seizures without payment - as feared by some farmers, investors and foreign governments.
    It recommended that expropriation without compensation be applied under specific circumstances, including abandoned land; land held purely for speculative purposes; land already occupied and used by labour tenants and former labour tenants; and inner city buildings with absentee landlords.

    I don't think they want to go from one hellhole to another, some have gone to Russia and there might be some other countries like Hungary that they would like better but I think war is coming when the EU collapses.

    We could use them here in the US if they are less socialist than average but I don't know if there is much chance of that happening in the current political environment.

    There is already a Western Cape secession movement and I think it will start to grow rapidly.

    South Africa's unemployment rate has reached a record high, the statistics office said Tuesday, the same day the country's troubled power company reported a billion-dollar loss, piling pressure on President Cyril Ramaphosa's administration.The news serves as a double blow to Ramaphosa's government, which won May elections vowing to halve unemployment, after Africa's most developed economy has suffered through mass layoffs, rolling blackouts and contracting gross domestic product (GDP).

    The unemployment figures came as South Africa's power company Eskom -- which generates around 95 percent of the country's electricity -- reported a record net loss of 20.7 billion rand ($1.46 billion) for the year to March, nearly 10 times more than in the previous 12 months.

    Proposed changes to South Africa's constitution to allow land to be expropriated without payment will be officially published next week, potentially setting the stage for a conflict between the government and commercial farmers and the opposition.

    Publishing the draft bill, after a special parliamentary committee agreed on Thursday to have the bill gazetted, will give people the first chance to see the proposed changes to the constitution and then have their say.
    "I have signed the necessary papers to allow them to publish the bill. We are going ahead so everything is on course," said Mathole Motshekga, chairman of the ad-hoc committee overseeing the legislative changes.
    There are three proposed changes to the text of South Africa's Bill of Rights dealing with property, with the third, an insertion of a new paragraph saying that "national legislation must ... set out specific circumstances where a court may determine that the amount of compensation is nil" proving the most problematic.
    At least three opposition parties, including the largest, the Democratic Alliance, wanted this clause removed entirely or at least for the specific circumstances alluded to become part of the proposed constitutional changes.
    "We should be absolutely clear under which circumstances there can be nil compensation. It should be spelt out, those conditions, and it should be in the constitution," said Corne Mulder of the Freedom Front Plus, which represents mainly white Afrikaner voters.
    The ad-hoc committee expects to finalise its process by the end of March 2020, with public input included. If the changes are adopted, it will goes to the national assembly for vote, then to the upper house and finally to the president to sign into law.

    South Africa’s cabinet rejected proposals to limit the size of farms and to establish a dedicated fund in the nation’s land-reform process, Agriculture, Land Reform and Rural Development Minister Thoko Didiza said.
    An advisory panel set up by President Cyril Ramaphosa in July submitted a report containing 73 recommendations on the land-reform process. Of those, the cabinet endorsed 60 and noted three others, according to the Department of Agriculture.
    The proposal on farm sizes was rejected because “agricultural conditions vary across the country,” Didiza told reporters Thursday in Pretoria, the capital. “While in one place where rainfall is good and the land fertile, a far smaller farm would be needed than a farm in one of the more arid areas.”
    A recommendation by the panel that a dedicated land-reform fund be established was also dismissed “because we believe that the optimum and judicial use of funds can be done through the current budgeting process,” she said.


    The panel’s other proposals included considering a tax on land that exceeds the maximum threshold for one owner and levies on underutilized land. It also suggested dissolving the Ingonyama Trust under which the king of South Africa’s most populous ethnic group, the Zulus, holds 2.8 million hectares (6.92 million acres) of land on behalf of his subjects.
    The ANC plans to change the constitution to make it easier to seize land without paying for it. Separate legislation has been drafted outlining the circumstances under which the state can do this.
