Too bad congress is so partisan.
Congress can and should legislate zero tariffs with no loopholes the president can use to impose them on his own.
The Constitution would say yes, but I believe we would be better off if the legislative power was transferred to the President, the responsibility for bad laws would be easily assigned and the culprit could be easily removed, then the replacement could easily undo the problem.
The Constitution boils the frog slowly and allows everyone to point the finger of blame at someone else.
