Illinois Town Ignores Constitution, Citizens Given 60 Days To Turn In Guns Or Become Criminals

Authored by Jack Burns via The Free Thought Project,

Residents of a town in Illinois were just handed down an unconstitutional decree from their local government, they now have 60 days to give up their guns or be fined up to $1000 per day...

As the state promises gun rights activists they’re not coming for their guns, behind the scenes they’re pleading for it to happen. And now the feared gun grab is occurring. Residents in Deerfield, Illinois have 60 days to surrender their “assault weapons” or face fines of $1000 per day per gun.

The gun ban ordinance was passed on April 2nd with residents left with few choices of how to dispose of their valuable “assault weapons.” Upon careful reading of the ordinance, residents will be left with revolvers, .22 caliber “plinking” rifles, and double barrel shotguns to defend their homes and families from criminals who could care less about the law.

Fines for not disposing of the weapons range from $250 to $1000 per day per gun for those who choose not to comply with the city’s ordinance. While a fine may seem reasonable to some, as TFTP has reported on multiple occasions, failure to pay fines always results in police action. It is not far-fetched to predict major turmoil and arrests in the event of non-compliance.

One example of the so-called “assault weapon” is the Ruger 10/22 which can accept magazines that hold more than 10 rounds. Even though the 10/22 is not listed in the list of guns the village wants to see banned, the gun cannot legally be possessed in the village.

But we arent coming for ALL guns, just the Registered ones we disapprove of!

What do they always do? One person uses a gun in a crime (which does happen) and it isnt an "Assault Rifle" so instead of going after the type of gun used in the crime, they go directly after the weapons most likely to be used in resisting govt oppression. What? Your kid used a pencil to misspell a word? Quick, ban plastic forkes and knives!

This is the "common sense" part of those gun laws. Even a fool can see that confiscation is the objective.

We need to limit, if not eliminate all together, qualified immunity. People need to be held personally accountable whenever they infringe upon fundamental rights. Whether its a police officer wrongfully shooting someone, or one of these village thugs taking away someone's property.

Deerfield violated both the constitutional and state law - home rule on firearm ordinances was settled in 2013 with the passing of ccw. Where's the personal accountability? They'll simply use tax payer dollars to fund their legal defence.

Surely someone will file a law suit in defense of their Constitutional Rights. Right?

The National Rifle Association (NRA) announced on Wednesday it would be supporting a lawsuit against the Deerfield, Ill., gun ban brought by an Illinois-based gun rights group named Guns Save Life. The groups said the town's wide-ranging ban, which effects nearly all semi-automatic rifles as well as a large number of handguns and shotguns within city limits and carries a fine of up to $1,000 a day for those who don't remove, destroy, or turn over their affected guns, violates the constitutional rights of its members.

"We are going to fight this ordinance, which clearly violates our members' constitutional rights, and with the help of the NRA I believe we can secure a victory for law-abiding gun owners in and around Deerfield," John Boch, executive director of Guns Save Life, said in a statement.

"Every law-abiding villager of Deerfield has the right to protect themselves, their homes, and their loved ones with the firearm that best suits their needs," Chris W. Cox, executive director of the NRA's Institute for Legislative Action, said. "The National Rifle Association is pleased to assist Gun Save Life in defense of this freedom."

The Second Amendment Foundation joined with the Illinois State Rifle Association as well as Deerfield resident Daniel Easterday on Thursday in a separate suit against the gun ban. Their suit challenges the gun ban on the grounds that a 2013 Illinois state law makes it illegal for any locality to create their own so-called "assault weapon" laws.

SPRINGFIELD, Ill., April 5, 2018 /PRNewswire-USNewswire/ -- The following was released today by the Illinois State Rifle Association (ISRA):

The ISRA is pleased to announce that the association is one of three plaintiffs jointly filing a lawsuit against the Village of Deerfield. The ISRA, along with plaintiffs Daniel Easterday and the Second Amendment Foundation, contends that the village's recently passed "assault weapons" ban infringes on the rights of law-abiding citizens to acquire and keep firearms of their choosing.

"Certainly all citizens of good conscience are seeking a solution to criminal violence," commented ISRA Executive Director Richard Pearson. "But enacting bad public policy for the sake of 'doing something' is not the answer. Lawful citizens should not be forced to pay penance for the misdeeds of others. Our lawsuit demonstrates our willingness and resolve to protect the constitutional rights of the good people of Illinois."

The ISRA is the state's leading advocate of safe, lawful, and responsible firearms ownership. For more than a century, the ISRA has represented the interests of millions of law-abiding Illinois citizens.

These gestapo tactics funded by your tax dollars can be seen everywhere - city councils, HOAs, schools, etc ..... People who have never been fondled find themselves in positions of power and try to make things "right".

A second lawsuit is seeking to overturn the village of Deerfield’s assault weapons ban that is scheduled to take effect June 13.

The suit filed Thursday by the advocacy group Guns Save Life and Deerfield resident John William Wombacher III challenges the Deerfield ordinance that was approved April 2 on numerous grounds.
The National Rifle Association’s Institute for Legislative Action issued a news release Thursday saying it was supporting the Guns Save Life lawsuit.
The suit contends, among other things, that a provision instructing the Deerfield chief of police to confiscate and destroy assault weapons and large-capacity magazines violates a guarantee under the Illinois Constitution that private property shall not be taken for public use without just compensation.
The suit also challenges the definition of “so-called assault weapons” and “large capacity magazines” in the ordinance, noting the ban covers prevalent firearms that are overwhelmingly used for self-defense. Those include the AR-15, described in the suit as “America's most popular semiautomatic rifle.”
“What we are looking to do is block the village of Deerfield’s unconstitutional efforts, in our opinion, to deny residents, passers through and people visiting the right to firearms based merely on cosmetic appearance,” said John Boch, executive director of Guns Save Life.
Boch said the Deerfield ordinance banning firearms “based on appearances makes no more sense than banning brown M&M’s just because the village doesn’t like the color of the particular M&M.”

Deerfield officials could not be reached Thursday for comment on the latest lawsuit.
