    Is this still in place?

    The fee is calculated 2 different ways – as a percentage of your household income, and per person. You’ll pay whichever is higher.

    Percentage of income

    2.5% of household income
    Maximum: Total yearly premium for the national average price of a Bronze plan sold through the Marketplace

    Per person

    $695 per adult
    $347.50 per child under 18
    Maximum: $2,085

    There's a form you have to attach. Your employer or the exchange provides it. If you get audited, and the form is not there, they will assess the penalty. It's just like any other audit item.

    What if the exchange you were with collapsed and is no longer in place?

    THey would have sent you the form at the end of the tax year. You play coy all you wish, but they don't $#@! around with all that. When it comes to the audit, you're guilty unless proven innocent.

    If you don't have the form, you'll be assessed the tax. It isn't complicated.

    This goes against the 5th amendment.

    If you don't have the form, you'll be assessed the tax. It isn't complicated.
    Is it legal? The Trump administration sets a precedence by deeming the tax non-mandatory.
