Thread: Utah to become first state to lower DUI level to .05

Thumbs down Utah to become first state to lower DUI level to .05

We knew it was coming. It was only a matter of time. Now, just like the .08 limit, it will begin to creep across the nation. Destroying more lives.
The Utah State Legislature has passed a bill lowering the blood alcohol content level for DUI from .08 to .05.

House Bill 155, sponsored by Rep. Norm Thurston, R-Provo, passed the Senate on Wednesday night on a close 18-11 vote. Having previously passed the House, it now goes to Governor Gary Herbert for his signature or veto.

The governor's office told FOX 13 on Wednesday night he plans to sign the bill into law, making Utah's DUI threshold the lowest in the nation.

They don't want you to drink any wine at all, thus these laws.

It has nothing to do with safe driving.

They'd rather it be an Uber. That way you can be tracked and forced to use digital "money" annnnnd.....*bonus* conditioned for the autonomous cars, a la Total Recall.

Just stop agreeing to their corporate regulations (what they like to call "laws" and "codes"are simply corporate contract regs) by voluntarily agreeing to the regs when you apply (asking) for a drivers license. Start traveling and stop driving.

Utah is actually the land of Mormons (LDS) The predominant population of Utah are members of LDS Church. In Mormon religion is absolute teetotalism, so this state can live dry, even keep drinking age 25 or 90. Dry religion, so even BAC there can be 0.0.

I would imagine that a blood test might come back at .05 if they wipe the arm with enough rubbing alcohol before putting the needle in.

Unlikely. Besides, they cop will see the injection mark. So, no problems with that.

I suspect Utah is just looking for a way to collect more revenue.

  25. #22
I heard MADD was actually against it. Not sure why.

Tyler Ayres, an attorney who represents people accused of DUIs, said he did not believe such legislation would be effective. He said DUI rates have been declining in Utah and accused the bill of being a "revenue generator."

"They're consuming less alcohol and so now our legislature evidently is saying we're not getting the revenue from it, so we better lower the legal limit so as soon as they have a single drink the average person will be at or near .05," he said.

Ayres said he has lawsuits pending against police and the state of Utah over officers already arresting people for impairment below .08. Those lawsuits are pending in federal court.

Surprisingly, Mothers Against Drunk Driving said it would not support a bill lowering the DUI legal limit. Utah MADD chapter president Art Brown told FOX 13 the group prefers to focus on interlock devices prohibiting people from driving drunk.

"MADD's position is we really emphasize interlocks and getting those on people, and staying .08," he said.

So it looks like MADD is pushing for new alcohol lock-out devices on cars. Where's AF?

Apparently lowering it to the absurd level of .08 did not generate enough funds.
Liberty is lost through complacency and a subservient mindset. When we accept or even welcome automobile checkpoints, random searches, mandatory identification cards, and paramilitary police in our streets, we have lost a vital part of our American heritage. America was born of protest, revolution, and mistrust of government. Subservient societies neither maintain nor deserve freedom for long.

MADD would be happy to move to the new phase of raising the drinking age from 21 to 25, even to bring back The Prohibition.

UT already has a high smoking age. It is a pretty decent state when it comes to business regulations (except for companies involving smoking or drinking) but the people there sound like the fun police. Yup, the people there are as anti-fun as the people in ID, but they are worse than average.

We have had a .05 limit for a long time and a .02 limit for people who have their license for less than 5 years.

I have to say, the worst part about it, is that people really do not care about peoples ability to drive a car. Some say they think anyone who's had any amount of alcohol and drives a car should be shot, other people are a bit more moderate. Sadly it's never really about facts.
