    Trial begins for Oregon standoff leader Ammon Bundy

    The trial started for Ammon Bundy, the leader of a standoff at an Oregon wildlife refuge back in January 2016. Bundy and his supporters took over the refuge to protest the government's management of federal lands.

    The alarming tale of a tense, deadly standoff at an eastern Oregon wildlife refuge that gripped the nation last winter and turned a spotlight on federal land management in the West is being retold at a federal courthouse in Portland.

    The trial began Tuesday for Ammon Bundy, his brother Ryan and five supporters who say they were exercising constitutional rights to speak freely and bear arms when they seized the Malheur National Wildlife Refuge, 300 square miles of wind-swept, high desert that before the protest was best known for a diverse population of waterfowl.

    The federal government sees the issue differently, and all the defendants are charged with conspiring to impede federal land managers through force and intimidation. Five of the defendants also face gun charges.

    No federal land management agency has announced any sweeping change in policy since the standoff, Bruce Huber, a Notre Dame law professor who specializes in natural resources, told USA TODAY.

    "If anything, officials seem to be using more stern language than before Malheur," Huber said.

    Bundy's group of self-described "patriots" seized the refuge administrative offices on Jan. 2 following a local protest in support of two ranchers sent to prison for starting fires on federal land. Bundy and many ranchers say tough federal restrictions on grazing and other uses threaten their way of life.

    The federal government, and particularly the Bureau of Land Management, plays a huge role in land use in the West. The government owns more than half of Oregon's land and almost 40% of all the land in Arizona, where Bundy owns a truck maintenance shop. Bundy is the son of Nevada rancher Cliven Bundy, who was involved in a high-profile 2014 standoff with the government over grazing rights. The government owns 85% of land in Nevada.

    Redoubt News: Judge Anna Brown Drops Her Mask

    The Malheur Protest Trial has been going well for the defense, as the witnesses all confirm the transparent and safe atmosphere the protesters encouraged. This must be angering the Judge because she took a decided twist in her handling of the trial today.

    Jeff Banta testified last week about how he arrived at the Refuge on January 25th, just one day before LaVoy Finicum was murdered at an illegal Deadman’s roadblock orchestrated by the FBI and Oregon State Police (OSP). His testimony included discussion of a video he had seen online that prompted him to get involved.

    The video was made by John Witzel of French Glen, Oregon. The video shows the ‘Miller Homestead Fire’ of 2012 in which the Bureau of Land Management (BLM) started multiple blazes that caused damage to property and livestock.

    After allowing the prosecution leeway in their video selection, including watching several people target practice, the video that was so compelling to Jeff Banta was not to be allowed. Judge Brown decided that this video would be too confusing for the jury. She allowed Witzel to come in and describe a few parts of his video, but that was all.

    The defense asked to play a video of Senator Harry Reid calling the Bunkerville Patriots “Domestic Terrorists”. Judge Brown told the defense that Ammon Bundy can say what he wants, but we don’t need videos. So, this one was out as well.

    Another issue at hand today had Judge Brown refusing to deal with the issue of FBI Agent Ronnie Walker sitting in the courtroom from day 1 even though he was on the prosecution witness list. She blamed that problem on the attorneys and refused to admit that the buck stops with her. She is completely responsible for this breach, and I certainly hope at least one defense attorney files for a mistrial based on this blatant favoritism.

    Judge Brown is well known to be favoring the prosecution, but has completely ripped off her mask and stopped pretending to be fair in this trial. She has threatened the defense if they bring up the truth of the FBI lying and covering up their part in the murder of LaVoy Finicum. She has not allowed crucial evidence, but has allowed the prosecution it’s grandstanding.

    Marcus Mumford put forth a very good argument on this subject today when Brown decided to change some jury instructions out of the blue. She said that the defense was misusing the word ‘terrorist’ when it came to discussion of the Hammonds being prosecuted under the Anti-terrorism and Effective Death Penalty Act of 1996. “The defendants are using the term improperly,” she stated.

    When Mumford challenged her need to change the jury instructions, he states that the “court is taking sides against the defense.” She completely ignored his argument and did not even bother to address it.

    This fit with the rest of the day and how many objections the prosecution could jump up and make. She sustained nearly all of them. However, she was so wrapped up in helping the prosecution that at one point she even sustained an objection that was not made.

    During the questioning of Chris Briels, Brown burst out and said “Objection Sustained!” When she realized that no one had made an objection, she then said, “Oh, there was no objection, but I am going to sustain it anyway. I am not going to let the witness speculate.”

    This is what the defendants are dealing with. The public audience is on to her as well, as she has noticed. She has threatened the public in the gallery with expulsion for making any noise whatsoever, even turning a page in a notebook. If she hears a pen click or a page turn she will have everyone removed.

    The stress of this trial could be proving to be too much for Judge Brown. I think she needs a vacation. I know I do.

    The Oregon wildlife refuge standoff trial has entered the closing arguments phase. Seven people, including members of the Bundy family, face federal obstruction charges after occupying the refuge earlier this year in a protest against government overreach.

    Ryan Bundy, acting as his own attorney, quoted Martin Luther King, Jr. twice during his closing argument Wednesday, telling jurors to “stand for freedom” and find him not guilty.

    Bundy said injustice anywhere is a threat to justice everywhere, and explained he joined the protest in support of two ranchers he believed were wrongly imprisoned.

    “At some point the people have to insist that the government is not our master,” he said, according to the Associated Press. “They are our servants, and we have given them a duty.”

    The conspiracy charge is punishable by up to six years in prison.

    Federal prosecutor Ethan Knight gave his closing arguments on Tuesday, asserting it was “inherently intimidating” to have a workplace taken over by an armed group.

    Knight told jurors the case isn’t about the policing of land in the US West.

    “They decided to pick and choose the rules and laws that apply and take over property that didn’t belong to them,” Knight said, according to AP.

    Ammon Bundy’s attorney, Marcus Mumford, spoke after Knight and told jurors: “The problem wasn’t with the employees. It was with their employer, the federal government. It won’t respect its limits.”

    Mumford reiterated points made during Bundy’s testimony, including the presence of firearms that ensured the protest wouldn’t be immediately stormed by armed federal agents.

    Mumford told the court the plan was to take ownership of the refuge by adverse possession, occupying it for years and then turning it over to local officials.

    Knight in his argument said the plan to stake a claim through adverse possession proves there was a conspiracy. He said it started two months before the armed takeover when Ammon Bundy and another out-of-state activist met with Harney County Sheriff Dave Ward and vowed there would be civil unrest if the sheriff didn’t protect the Hammonds against returning to prison.
