    Ohio patrolman acquitted in 2 deaths amid 137-shot barrage

    CLEVELAND (AP) — A white patrolman who fired down through the windshield of a suspect's car at the end of a 137-shot barrage that left the two unarmed black occupants dead was acquitted Saturday of criminal charges by a judge who said he could not determine the Cleveland officer alone fired the fatal shots.

    Michael Brelo, 31, put his head in hands as the judge issued a verdict followed by angry, but peaceful, protests: Outside the courthouse police blocked furious protesters from going inside while across the city others held a mock funeral with some carrying signs asking, "Will I be next?"

    The acquittal came at a time of nationwide tension among police and black citizens punctuated by protests over deaths of black suspects at the hands of white officers — and following a determination by the U.S. Department of Justice that Cleveland police had a history of using excessive force and violating civil rights.

    Before issuing his verdict, Cuyahoga County Common Pleas Judge John P. O'Donnell reflected on the unrest. "In many American places people are angry with, mistrusting and fearful of the police," he said. "Citizens think the men and women sworn to protect and serve have violated that oath or never meant it in the first place."

    But O'Donnell said he would not offer up Brelo to an angry public if the evidence did not merit a conviction.



    "I will not sacrifice him to a public frustrated by historical mistreatment at the hands of other officers," O'Donnell said.
    Brelo — who fired a total of 49 shots, including 15 while standing on the hood of the suspects' vehicle — faced as many as 22 years in prison had the judge convicted him of voluntary manslaughter in the shooting that happened after Timothy Russell's beat-up Chevy Malibu backfired while speeding by police headquarters.

    Russell's sister, Michelle Russell, said she believed Brelo would ultimately face justice.

    "He's not going to dodge this just because he was acquitted," she said. "God will have the final say."

    The U.S. Justice Department, U.S. Attorney's Office and the FBI will review the testimony and evidence and examine all available legal options, said Vanita Gupta, head of the Justice Department's Civil Rights Division.

    After the verdict, sheriff's deputies stood in front of the courthouse carrying clear shields as protesters chanted "Hands up! Don't shoot!" — a rallying cry linked to the death of 18-year-old Michael Brown in Ferguson, Missouri. One demonstrator bowed his head, hands folded, in front of the phalanx of deputies, praying in silence.

    Gee, where could citizens have gotten such strange ideas? Hmmmmm ...

    Maybe they got it from the fact that the courts (up to and including the Supreme Court itself) have long since ruled that "sworn" officers are under NO OBLIGATION WHATSOEVER to preserve or defend persons or property.

    In other words: POLICE DO NOT EXIST TO "PROTECT AND SERVE" - at least, not with respect to citizens (or their lives or their property) - and the courts of His Reverend Magistrate O'Donnell have said so themselves, repeatedly.

    Police exist solely for the purpose of monitoring and enforcing compliance with the State's body of statutory rules. THAT IS ALL.

    (And the fact that cops deal with malum in se offenders as a subset of malum prohibitum offenders is purely coincidental to their raison d'être.)

    Since the act of 1871 the intent behind that policy has been wide spread, and spreading throughout government.

    Clearly, only a Lawful and peaceful revolution, with unity behind the greater intents of the 1787 constitution can have a real effect.

    The greater intent of the Constitution was big centralized government; the Articles of Confederation were much more about freedom.

    Investigated by government investigators.

    Prosecuted by government prosecutors.

    To have a government judge declare the government did nothing wrong.

    Brelo could have been convicted of lesser charges, but O'Donnell determined his actions were justified following the chase, which included reports of shots fired from Russell's car, because officers perceived a threat.

    Brelo's lead attorney, Patrick D'Angelo, said Brelo had been unfairly prosecuted. He called the case a "blood fight."

    "Officer Brelo risked his life on that night," D'Angelo said.

    Sgt. Peters says four officers from his district disregarded the order to terminate chase and they were disciplined.
    So that right there says they should be held liable for everything that happened from that point on.

    No one can be convicted of murder if the coroner cannot say which of the 137 bullets in the body was the last one in before death occurred.

    Ballistics only matter in cases in which mundanes are accused.

    Wow, that 137-shot barrage that killed the occupants sounds dangerous. The Officer who was near that barrage could have really gotten hurt, I'm glad he's OK.

    Cleveland Cop Michael Brelo Arrested Days After Acquittal for Shooting Death of Two Unarmed Suspects

    Michael Brelo, the Cleveland police officer who was acquitted on manslaughter charges last month after he hopped on the hood of a car and finished off two unarmed citizens by shooting them 15 times, is now facing assault charges stemming from a drunken altercation with his brother.

    His brother, Mark, is also facing assault charges as well as a charge of disorderly conduct. The incident took place May 27 in the home of Michael Brelo in Bay Village, a municipality west of Cleveland.

    But the brothers didn’t turn themselves in until today, a week after the altercation.

    Knowing this would be a national story, Michael donned a collared shirt and tie for his mugshot. His brother opted for the shirtless look.

    According to Fox 8 in Cleveland.

    Both men voluntarily surrendered to Bay Village police on Wednesday. They were processed and released, with court appearances scheduled for June 10.

    According to the police department, the men, who had been drinking, got into a physical fight at Michael’s house. Court documents said both Brelos suffered visible injuries.

    Cleveland Police Union President Steve Loomis said Michael Brelo wanted his brother out of his house and a fight broke out.

    “The incident between the Brelo brothers was thoroughly investigated and reviewed with the city prosecutor. Based on the facts, it was determined that assault charges against both were appropriate and warranted. This determination was made independent of the criminal court case involving Michael Brelo,” Bay Village Police Chief Mark Spaetzel said in a news release on Wednesday.

    Michael Brelo is still on unpaid administrative leave from the Cleveland Police Department for the shooting of Timothy Russell and Malissa Williams, whose car had backfired during a pursuit, causing dozens of police officers to fear for their lives and open fire after a pursuit that involved 60 officers.

    But Brelo proved to be the cowboy of the bunch, walking up to the car after reloading and hopping on the hood – later claiming he was in fear for his life – where he fired the final 15 of the 49 shots he had fired.

    Cuyahoga County Common Pleas Judge John O’Donnell acquitted him on May 23, stating that there was no way to know if Brelo’s final 15 shots were the ones that killed the couple considering they were struck by a total of 122 bullets.

    Since then, the prosecutor in the case filed an appeal to get the judge to “correct the record” to prevent cops in the future to believe they have a license to kill as if they already don’t believe that.
