    Texas Senator Bob Hall introduces bill to rein in Eminent Domain and defend property rights


    Dear Constituents,

    I am excited to announce that my Private Property Protection bill, SB 444, is up for a hearing in the Transportation Committee next Wednesday, March 11th. Private property currently is vulnerable to private corporations that would profit from the oppressive powers of eminent domain by using those powers to build toll roads. Property owners should never be subject to such powers from private corporations, and taxpayers should never have to fund private investments.

    Case in point - Assisted by an unelected body, NTCOG, a private company recently attempted to use their eminent domain authority to unilaterally designate a route for a toll road.

    Without SB 444's important change in state law, private companies would continue to have the legal authority to confiscate private property at their discretion and use it for their private gain. This is clearly antithetical to what the citizens intended by amending Article I, Section 17 of the Constitution, which was passed by voters in 2009 as Proposition 11.

    SB 444 would effectively

    • Repeal all eminent domain authority from private corporations
    • Protect land owners from having their land sacrificed for private investments
    • Eliminate loopholes in existing law

    Pleased to announce that my Private Property Protection Bill, SB 444, was unanimously voted out of the Senate Transportation Committee this morning and reported favorably to the Senate Floor. SB 444 will take eminent domain power away from private toll road corporations who use eminent domain for private gain. I am dedicated to defending private property rights of Texans, and will work with my fellow Senators to pass SB 444 this session.
