    NY Psychiatrists Served With Subpoenas For Patient Records In NY Gun Confiscation

    NY Governor Andrew Cuomo’s Machiavellian Plot to ignore and subvert the Rights of potentially millions of NY State residents developed another layer late Sunday.

    After breaking the story of Amhurst NY Area Resident David Lewis having his lawfully purchase and legally owned firearms confiscated by order of the State Police after a flagrantly illegal and Un-Constitutional review of his medical records , Word came to me in my capacity as in journalist late Sunday that NY Officials have apparently doubled down on their sinister plot and blatant abuse of power.

    My sources revealed that two prominent and well regarded Buffalo Area Psychiatrists received subpoenas from State Officials, possibly on Friday April 12th 2013, commanding them to turn over all of their patient files to the State. Details are sketchy at this early stage, but I have been told that both Doctors have in house counsel as well as potentially consulting with the Law Firm of Jim Tresmond, Firearms Law Specialist and the Attorney of Record for Mr Lewis.

    This is a MAJOR violation of HIPAA, the Federal law that guarantees doctor patient confidentiality.

    There are exceptions to HIPAA of course, if a doctor believes a patient is a danger to him/herself or to others. Or if a judge issues a warrant based on sufficient probable cause that a crime has been committed. But a blanket subpoena like this? Definitely sounds illegal and unenforceable.

    I hope these docs stand their ground and I hope the "State Officials" involved in these subpoenas are prosecuted for attempting to violate HIPAA. (Anyone connected with the medical field can tell you penalties for HIPAA violations can be very severe.)

    They'll just bypass the doc records and go straight to Walgreens/CVS databases and cross reference gun owners against a list of meds deemed 'prohibited' for 'responsible' gun owners to have or be taking.

    This IS a Gun Grab. Every time that guns are taken away from people, it is usually the legitimate gun owners that pay the price, and every excuse is used to grab the guns. Taking guns away from legitimate gun owners (dont care about "registration", Im saying gun owners that dont use their guns to knock over 7-11's) does nothing but make those previously legitimate gun owners dependant on those who have the guns. Our politicians know full well that their laws wont do a $#@!ing thing to the criminals. In fact, our Govt WANTS the criminals to have guns and honest people to be dependant on them.

    When Guns are Outlawed, only Outlaws will have Guns.

    Everyone else will be dependant on those that took peoples Guns away to begin with to maintain the Illusion that Govt is necessary for their protection. And finally, when the people have been deprived of their ability to defend themselves, the abuses of the people in general can only continue to escalate.

    The problem stems from the fact that people are being forced to let the Govt know who owns a gun. Thus, the solution is obvious. Dont let the Govt know you own a gun.

    Too many folks addicted to the legal numb your feelings drugs. The psych doctors are the ticket to their fix. Nowadays people thing if you have emotions you need to be drugged up because so many folks live in zombie land that they believe feeling numb is the norm. I agree with you AF. Unfortunately psych doctors with their pseudo science aren't going anywhere. This has always been in the hopper since they made CT the poster child for the gun grab...

    I work in a hospital and one thing we were told about HIPAA during nursing orientation is that it was never intended to protect your privacy from the government. It was to protect your privacy from those evil insurance companies and 3rd-party marketing sources.

    Gov't is good, see? They can look. You just don't want insurance companies to cancel your coverage based on something in your medical history, or to get a bunch of junk mail offers from insurance groups. That would be really bad.
