MA governor wants to pass new NY gun laws in MA.

First the governor of MA called for around 2 billion dollars in new taxes, now he wants to copy the new New York gun laws. My guess is some of the liberty folks are going to be leaving NY and MA soon. Hopefully they drive northeast to New Hampshire

Seriously, though, this is not good. There might be enough political capital to pass these laws in a 1/2 dozen states.

Massachusetts Governor Patrick’s office has released the text of An Act To Strengthen and Enhance Firearms Laws in the Commonwealth [Click here for the text of the bill. Click here for the Governor's Press Release touting the civilian disarmament package]. TTAG legal eagle Chris Dumm parsed the laws and provided the following bullet points.
- Seven round mag limit – Magazines are now limited to seven rounds. Current 10 round mags are grandfathered. Owners of so-called “pre-ban” Mass mags (magazines with more than 10-rounds which were allowable under existing law) have one year to ditch them
- One Gun A Month – Sales – Bay Staters may not purchase more than one firearm per month. To exceed that rate is a felony. (2.5 years in prison, $1000 fine)
- One Gun a Month – Rental/Lease – Citizens may not rent or lease more than one firearm a month (2.5 years in prison $1000 fine)
- Universal background checks – All firearms sales (including private sales) must be preceded by a NICS criminal background check
- Gun show registration – Gun shows must report every seller at a show to the Department of Criminal Justice Services and pay a $500 fee to same
- No Bail for Gun Offenders - If a gun is used in a violent crime the offender may be held without bail until trial
- NERF-free schools - Airguns, BB guns, paintball guns, air rifles and yes NERF guns may not be possessed on school property ($500 and a year in jail)
- “Rat Rule” – Any staff or administrators who fail to report a violation of the above law are criminals ($500 fine)

Here are details of the proposed new taxes by the governor and department of transportation. The idea is to raise almost 3 billion a year to help pay for college for illegal immigrants, expand the T (Boston area subway and train system) to southern and western MA, and throw more money at government k-12 education (already nearly the most expensive and best performing government k-12 system in the US).

If MA expands the T, that would be great for people in NH/ME/VT/RI/CT/NY. We won't have to pay for it. Yet, we will get better transportation services in MA. Sure, it would take about a billion extra a year in taxes, but the people of MA want higher taxes so that's OK, right

Massachusetts Governor Deval Patrick (D) yesterday proposed the following package of tax changes:
Broaden the income tax base [by eliminating itemized deductions], double the personal exemption, but raise the single-rate income tax from 5.25 percent to 6.25 percent. Overall, this would raise $2.8 billion in additional tax revenue.
Reduce the state sales tax from 6.25 percent to 4.5 percent, reducing revenue by $1.1 billion.
Business tax changes that would raise an additional $194 million.

Earlier this week, the state Department of Transportation outlined a number of options (PDF) to boost spending for transportation by about $1 billion per year. These included:

A new payroll tax of 0.16 percent for workers in the Boston area. While only Nevada has a statewide payroll tax (1.17 percent on wages over $62,500, minus health care deductions), but similar payroll taxes exist in Newark (NJ), New York City, and Portland (OR). Tax would raise $100 million per year.
Raise the gas tax or index it to inflation.
Increase the state sales tax from 6.25 percent to 7.75 percent.
Increase the state income tax from 5.25 percent to 5.66 percent.
Impose an additional vehicle registration tax based on carbon emissions (motorcycles and hybrids pay $15, hybrid SUVs and cars pay $30, SUVs pay $60, heavy trucks pay $85).
A 2.4-cents-per-mile vehicle miles traveled tax (VMT), collected during the annual safety inspection.
Routinely increase vehicle taxes and fees, tolls, and transit fares by 5 percent every other year.
New tolls, which would require federal approval.
Maintaining tolls on the Western Turnpike after the bonds are paid off in 2017.

New Proposal Will Force Gun Owners to Store Assault Weapons At Government Authorized Storage Depots

Because you can never have too many laws, regulations and mandates, Massachusetts State Representative David Linsky has filed a new bill that would, among other things, force gun owners to undergo mental health background checks, acquire liability insurance, pay an additional 25% tax on all forms of ammunition, and require firearms categorized as “assault weapons” to be stored outside of their homes and only at government approved storage depots.

“This bill is a comprehensive effort to reduce all types of gun violence – murders, intentional shootings, accidental shootings and suicides. There is not one solution to reducing gun violence – we can’t eliminate it – but there are a lot of common-sense steps that we can take to significantly reduce the everyday tragedy of gun violence and deaths,” said Linsky.

“I have spoken with hundreds of people over the past few weeks in developing this legislation – victims, police officers, criminologists, physicians, and yes – gun owners and sportsmen,” stated Linsky. “There are a lot of good ideas out there. We should all have one goal – reducing gun violence and trying to keep more tragedies from happening.”

Provisions in the bill include:
Having one standard of the issuance of all gun licenses, giving local police chiefs the ability to evaluate all aspects of an application for a gun license.
Requires proof of liability insurance for possession of a firearm, rifle or shotgun.
Requires that all large capacity weapons and grandfathered assault weapons must be stored at gun clubs or target ranges.
Requires live shooting as part of the curriculum for a basic firearms safety course; this is not a current requirement.
Requires all applicants for gun licenses and FID cards to sign a waiver of mental health records for review to be destroyed after decision.
Imposes 25% sales tax on ammunition, firearms, shotguns, and rifles; dedicates funds towards firearms licensing, police training, mental health services, and victim’s services.
Brings Massachusetts into compliance with the National Instant Criminal Background Check System (NICS).
Limits gun buyers to one firearm purchase per month.

The biggest threat in NH right now is the NH House Majority Leader's bill to remove the recently passed stand your ground legislation. Castle Doctrine is safe, though

There is a rally at the NH State House today. There is another rally in the 31st. However, the 1st hearing on this bill is the 22nd. It looks like a lot of liberty lovers are going to testify against it, including this guy. Feel free to email the committee (email below) and say you are opposed to HB 135.
