    Trooper Fired After Brutally hanging/Kicking Police Dog Gets His Job Back w/ back pay.

    After a couple of years of trials and appeals, the North Carolina Court of Appeals finally ruled that the trooper Charles Jones, who was fired from the force in 2007, is to be reinstated with back pay. Jones was dismissed from the job for using excessive force on his K-9, and he’s been battling to get his job back since.

    What got him fired was one of the other troopers handing in two 15 second video clips that showed Jones kicking his dog to make him drop the chew toy he had in his mouth. Jones former supervisor Lt. Col. Cecil Lockley said in his testimony that they were planning to discipline Jones, but got instructions from “higher ground” to release him from his Highway Patrol position. The order came from then-governor Mike Easley’s office and wasn’t questioned. Lockley admits that Jones’ discipline method used on the dog named Ricoh was “ugly”, but not beyond the accepted training techniques.


    John Midgette, executive director of the North Carolina Police Benevolent Association, said:
    “These dogs are not pets. They are deadly weapons, and (if they are) not handled properly, people can get hurt – innocent people can get hurt.”

    Jones is going to get a back pay of an estimated $200.000 – $240.000, and it is yet unclear whether he’s planning to go back to his old job or continue working for the Apex Police Department, where he was hired four months after he lost his first job.

    North Carolina General Statutes § 14-360 Cruelty to animals; construction of section

    (a) If any person shall intentionally overdrive, overload, wound, injure, torment, kill, or deprive of necessary sustenance, or cause or procure to be overdriven, overloaded, wounded, injured, tormented, killed, or deprived of necessary sustenance, any animal, every such offender shall for every such offense be guilty of a Class 1 misdemeanor.

    (a1) If any person shall maliciously kill, or cause or procure to be killed, any animal by intentional deprivation of necessary sustenance, that person shall be guilty of a Class A1 misdemeanor.

    (b) If any person shall maliciously torture, mutilate, maim, cruelly beat, disfigure, poison, or kill, or cause or procure to be tortured, mutilated, maimed, cruelly beaten, disfigured, poisoned, or killed, any animal, every such offender shall for every such offense be guilty of a Class I felony. However, nothing in this section shall be construed to increase the penalty for cockfighting provided for in G.S. 14‑362.

    PETITION TO STOP REINSTATEMENT OF EX-OFFICER JONES

    Trooper Jones kicked and hung his k9 police dog Ricoh and then left him there to suffer over not releasing a TOY. He was fired in 2007 and now reinstated after an appeal and going to get paid 5 years of wages for compensation. Sign this petition to have him charged with animal abuse!

    We want him to be charged with assault on another K9 Officer instead!

    Are they talking about Jones or Ricoh? They clearly say dog(which Ricoh is), but I'm not sure.

    I know how I would like to 'properly' handle this P.O.S. Why was he not brought up on a felony I charge? I'll tell you why. Because, they are not bound by the same laws we are. And why the hell would the Apex police department hire this P.O.S. 4 months after his firing over this abuse?

    I'm trying to find out if there are any statutes were in police dogs are considered officers and whether or not this would be considered assault on an officer.

    EDIT: It appears from past news articles that one can be charged with attempted murder of a police dog. But, I can't find statute on assault.

    They're talking about the dog training. And this is one of the training exercises they use to make the animals dangerous enough to use against the criminal types among us. Especially those criminals types that like hiding in their own homes while using a particular herb. Gotta make sure the dogs are tough enough to deal with that kind of criminal.

    I've read that animal abuse is linked to serial killers, domestic violence and human abuse. Glad I don't live in the Town of Apex.

    Im not for abuse to animals (unless for self defense) but some laws are a bit redundant (victimless) ie: If I can't yell at my dog for while jumping out of the yard and running across the street without the neighbor calling the cops and wasting one hour of my time with an officer then this cop should tried and hanged for what he did. Which is going to be? are animals treated as humans or animals? Can cops treat animals the same way they treat humans??!!

    I missed it 2007. I'm sure if you did a search you could find it. This is relevant because he was just re-instated in appeals court and is to be given almost a quarter million in back pay.

    If you hit a police officer that's a Dog= jail time.

    If you hit a police officer that's a human= jail time.

    If a police officer(human) hits a police dog=$200k in back pay.

    If a police officer(human) kills a non police dog= combat Qual.

    The issue I see here is not that he should have to face any strong legal consequences for what he did, but that he shouldn't ever be allowed to serve as a law enforcer. The guy clearly has mental problems.
