    Drunken, off-duty officer kills young man with his car, cops say

    A drunken, off-duty rookie cop was arrested early Wednesday after he killed a young man with his car in the Bronx, cops said.

    Police said Officer Luis Arnao, 25, slammed into Tyre Chisholm, 22, with his 2011 Honda Accord as Chisholm was crossing White Plains Road in Wakefield at E. 241st St.

    "He got hit hard," said Devine Douglas, 45, a livery driver. "He flew up in the air. His shoes flew off with his socks still in them."

    Douglas said the driver "was definitely speeding. He kept going, but turned around and came back."

    Chisholm (photo) had just left a bar about 3:50 a.m. when cops said Arnao hit him. He initially was taken to Montefiore Medical Center, then Jacobi Medical Center, where he died.

    Arnao was charged with vehicular manslaughter, criminally negligent homicide and operating a motor vehicle while intoxicated. His blood-alcohol level was .07, a source said. The cop, who was immediately suspended, was released on $20,000 bail.

    Police said Arnao, assigned to Patrol Borough Bronx, was sworn in July 2010.

    "He didn't deserve this," said the victim's aunt, Karen Chisholm.

    "He wanted to get a job and prosper."

    Not necessarily. At .08% it is presumed a person is drunk (thus making the prosecutor's job that much easier). A person still can be charged at a lower level but the state carries a heavier burden of proof. (Of course, it's all dependent upon the individual laws of each state.)

    I wonder who the cop is supporting politically. I mean after all, the media made such a big deal about the drunk Ron Paul supporter.

    There are idiots in all professions (and political movements too). This man no better represents all policemen than the other guy represents all Ron Paul supporters.

    You are correct. At .08% and above, the officer shall arrest; however, the officer may arrest for BAC's between .05% and .08% depending on state and the perceptions of the officer with regard to the pre-exit and FST's. Nationwide, .08% has become prima facia for intoxication.
