Feds Closer to Losing Over Lifetime Ban for Misdemeanor: Litigated By Donald Kilmer

    I have a thread on calguns. http://calguns.net/calgunforum/showthread.php?t=417935

If you know anyone who has been impacted by lautenberg or feels that the lifetime misdemeanor ban is wrong, please email them a link to this thread. There are millions of us who feel this law is wrong. Let's go viral with this.

Donating money here http://madison-society.org/donation.html would really help this case and a possible future case for the plaintif who was dismissed by the judge. According to Donald Kilmer, that plaintiff had the best 10th amendment claim.

The 10th amendment claim will get more people interested than just gun people.

The Madison Society is suing Eric Holder and the feds over the lifetime federal ban on "domestic violence" misdemeanants. People who know about this issue know just how easy it is to become prohibited due to one of these convictions.

The case is Enos V Holder.

Look at page 12. http://www.madison-society.org/laws/...-1-MTD-MPA.pdf The government is arguing that the second amendment is NOT a civil right. They say voting, speech, freedom of the press are, but not the second.

Update; Don Kilmer filed this Supplemental Authority. http://ia600300.us.archive.org/35/it...15824.23.0.pdf

Update; Enos survived the motion to dismiss by the federal government.http://ia600300.us.archive.org/attac...15824.24.0.pdf

    We are winning!

A lifetime ban on what is supposed to be an inalienable right that government shall not infringe for anyone other than those convicted of mala en se crimes and sentenced to life in prison is outrageous, unconstitutional, and has no place in a society that is supposed to be able to let people move on from past transgressions.

Lets start with the Lautenburg nonsense.

And move on to repeal of the whole GCA68.

I agree. This is the first case I have seen with a good chance of getting this fixed.

Glad to see you back, and i agree - rights are rights period. Punishment should be proportionate to the crime and once completed, any infringed right is restored.
Out of every one hundred men they send us, ten should not even be here. Eighty will do nothing but serve as targets for the enemy. Nine are real fighters, and we are lucky to have them, upon them depends our success in battle. But one, ah the one, he is a real warrior, and he will bring the others back from battle alive.

Duty is the most sublime word in the English language. Do your duty in all things. You can not do more than your duty. You should never wish to do less than your duty.

Pericles-we moved recently from the ghetto to a rural area. Its been quite an arduous deal, let me tell ya.
We knew it was time to go after 3 hoods broke into a neighbors house in broad daylight and stole a Glock 9mm pistol.

AND- I never left my beliefs and personal values, despite any hiatus from the board. There is nothing in this world that can convince me to give up on the struggle for liberty.

As for punishment, one of the things the proponents of lifetime bans like to claim is that the Constitution allows them to strip people of their rights via due process.
That is absurd. They aren't stripped of their rights, inalienable rights are a condition of our humanity like having a soul is-and the government ,NO government to be precise, has the power to take our souls.
However, what being convicted does do,is allow them to hold you in a position where you cannot excersize your rights.
Such as in the custody of the state in a prison or asylum.
So to turn this concept on its head-basically what they are saying is that any transgression of their mala prohibita law means you are in the custody of the state FOR LIFE,because they claim to be able to restrict you of the excersize of inalienable rights.

Hence-they have just admitted that we live in a police state, where each and every one of us is in one way or another subject to being in the custody of the state at all times without a hint of due process being observed.
That is the only condition that could exist to facilitate such a blatant lifetime transgression of one's individual rights.
Without a police state, such laws are unenforceable...and yet I hear of more and more enforcement of this odious,Nazi inspired law(GCA68) every day.....as the police state grows,so does the myriad and sundry authorities power to violate inalienable rights.....

"The course of history shows that as a government grows, liberty decreases."
    -Thomas Jefferson
