Otter Signs Order Banning Health Care Reform
Order Prohibits State From Receiving Federal Funds

Associated Press / Local News 8
    April 20, 2011

The governor vetoed a bill to help Idaho block the federal health insurance overhaul and instead, issued a sweeping executive order Wednesday targeted at the reforms.

Republican Gov. C.L. "Butch" Otter is no fan of the health care reform - he was the first governor to sign legislation requiring his state to sue over President Obama's overhaul - but said the bill state lawmakers passed in the 2011 session would have required Idaho to forego the creation of a state health insurance exchange.

That would have opened the door for the federal government to step to develop and operate the system, Otter said.

"While I agree that the state should not implement Obamacare, this legislation has the unintended consequence of eliminating a possible opportunity for Idaho and ceding control to the national government," Otter said in a letter to the Idaho Secretary of State detailing his decision to veto the bill.

The governor instead issued an executive order to prohibit Idaho agencies from implementing the reform, or assisting the government in carrying out the law, while still allowing the state to continue developing a home-grown health insurance exchange.

"No one has opposed Obamacare more vehemently than me," Otter said in his letter to Secretary of State Ben Ysursa. "... However, ending Obamacare by whatever means does not alleviate the need for Idaho to develop its own solutions to healthcare issues in our state."

Because the Supreme Court has for many years interpreted the Constitution in a manner to further empower the federal government, states are moving to take power back from the feds through a growing and vibrant nullification movement. By Patrick Krey

    Nullification in a Nutshell
The modern-day nullification movement has as its genesis the principle of federalism and the writings of James Madison and Thomas Jefferson, in particularly the famous Kentucky and Virginia Resolutions of 1798, supporting the right of states to nullify unconstitutional federal usurpations. The state has averted a federal takeover of insurance rate increase reviews in Idaho.

Federal officials said in July they would assume the responsibility of reviewing increases of 10 percent or more in health insurance premiums proposed by private Idaho insurance companies starting Sept. 1.

The move was the result of an executive order Idaho Gov. C.L. "Butch" Otter signed earlier this year to prohibit the state from implementing any component of the 2010 federal health care overhaul.

Otter's order came after the end of the 2011 Legislature to underscore his official objections to some of the provisions passed by Congress, including to eventually force residents to buy health insurance come 2014, or be fined.

Idaho is among states suing over the federal law.

The Idaho Statesman reports (http://bit.ly/qc8rci ) the state Department of Insurance was already was reviewing some health plan rates filed by insurance companies, as parts of its regular procedures, but the executive order Otter issued in late April had made it impossible for the Idaho Department of Insurance to meet new standards under the federal health care law.

Otter has since issued a waiver allowing the agency to comply with the federal provisions.
