    Default NH House passes bill to allow unlicensed barbering, manicuring, cosmetology & esthetics

    The NH House passed HB 450 to allow the unlicensed barbering, manicuring, cosmetology and esthetics to family and friends for no compensation. The bill also reduces the penalty if anyone does barbering, manicuring, cosmetology and esthetics for compensation.

    STATE OF NEW HAMPSHIRE

    In the Year of Our Lord Two Thousand Eleven

    AN ACT relative to the regulatory authority of the board of barbering, cosmetology, and esthetics.

    Be it Enacted by the Senate and House of Representatives in General Court convened:

    1 Barbering, Cosmetology, and Esthetics; License Required; Compensation. Amend RSA 313-A:9, I to read as follows:

    I. It shall be a [class A misdemeanor] violation for any natural person, and a [felony] class A misdemeanor for any other person, to engage in any practice regulated by this chapter without the appropriate license.

    2 New Paragraph; Exemption Added; Barbering, Manicuring, Cosmetology, and Esthetics. Amend RSA 313-A:25 by inserting after paragraph II the following new paragraph:

    III. The provisions of this chapter relative to barbering, manicuring, cosmetology and esthetics shall not be construed to apply to the provision of barbering, manicuring, cosmetology, or esthetics services to family and friends when done for no compensation.

    3 Effective Date. This act shall take effect 60 days after its passage.

    You may not know, but this was a big issue in New Hampshire because of a FSPer years ago. Mike Fisher announced to the government that he was going to cut his friend's nails in front of the government building that was in charge of cutting nails. The media came out and it made headlines throughout NH. He was arrested but almost everyone disagreed with his arrest. The laws were than changed in NH to greatly reduce the amount of time it took to get a license to cut nails in NH. If this bill becomes law, it greatly increases the freedom to do that in NH.

    News on Mike Fisher

    On May 9, 2005, Mike Fisher, an FSP participant, violated NH's licensing laws at the State Board of Barbering, Cosmetology, and Esthetics in Concord.

    The purpose of the event was "to call attention to the State's intrusive and unnecessary licensing restrictions on entry-level workers and entrepreneurs in many industries," according to Fisher, the activist heading up the effort through the NH Underground. "In a free country, people do not need permission to start a business. We are no longer free to make a living without government approval."

    It is a misdemeanor in New Hampshire to sell services such as manicures, haircuts, or massages without a license.

    Wait, it really was illegal to cut a family member's hair without a license? Am I reading this right? Like a mom could go to jail for cutting her son's hair?

    In all fairness to NH, what if she gave him a perm...or a bowl cut? That's abuse...

    Heck yeah! This cause has taken 6 years and isn't over yet. My goal is for it to become law that you can do barbering, manicuring, cosmetology & esthetics to family and friends for money legally in NH. I mean, it is clearly already done, heck, that's usually how I get my hair cut. I usually pay a friend something like $10 and I admit it, I'm currently involved in something that is illegal but to my knowledge has never been prosecuted in NH. However, it doesn't matter if it is prosecuted or not, it should not be illegal.

    There is a State Rep that is a FSPer in NH that has made a name for herself trying to remove silly laws from the books. The laws tend not to be enforced and most people tend to think that they shouldn't be laws at all, yet they sit on the books.

    Yeah, it is really sad, but that tends to be the law in most of the US. Thankfully, there are people trying to change this
