North Carolina Senate Passes Health Care Freedom
Tenth Amendment Center
February 18th, 2011
The N. C. Senate this week approved the Health Care Freedom act on a strictly party-line vote of 30-18. The bill now goes back to the House, which has already passed an earlier version, for concurrence with changes made in the Senate.
The bill, sometimes known as the “Repeal ObamaCare” law would direct the N. C. Attorney General to join one of the law suits now working their way to the U. S. Supreme Court on behalf of North Carolina. The suits, generally, challenge the constitutionality of ObamaCare and specifically the provision that would require every American to buy health insurance or face possible fines and even jail time for failure to do so. Opponents of ObamaCare contend that the Federal Government does not have the delegated authority under the U. S. Constitution to require Americans to buy any particular product.
The bill is expected to pass the House in short order and will then be sent to Governor Perdue. She is expected to veto the bill but there are indications that her veto would be overridden in the Senate.
