    Scandal In St. Louis! Couple Face Felony Charges For Defending Their Home!

    A couple in St. Louis will face felony charges in their much-photographed defense of their home in a private, gated and locked community as BLM and other protesters broke through the gates and moved toward the couple's home. Justice...or an attack on property rights and the Second Amendment. Plus in today's Report: More threats to jail Covid-19 positive cases if they resist house arrest. Also - what happened on June 14th that led to the massive spike in "cases"?

    Can the AG charge the prosecutor with prosecutorial misconduct? Feds have retried a significant number of cases using human rights violations as the end run around double-jeopardy. Charging that couple is a clear violation of their rights, so I see no reason that a special prosecutor could not charge the local prosecutor with human rights violations.

    The governor (Parson) and attorney general (Schmitt) of Missouri have made noises of disapproval - and to his credit, the AG has moved to have the charges dismissed - but it's rather doubtful that they'll actually do anything except squawk about the prosecutor (Gardner) herself ... ("Just Us" and all that, don'cha know ...)

    “The right to keep and bear arms is given the highest level of protection in our constitution and our laws, including the Castle Doctrine, which provides broad rights to Missourians who are protecting their property and lives from those who wish to do them harm,” Schmitt said in a prepared statement provided to Fox News.

    “Despite this, Circuit Attorney Gardner filed suit against the McCloskeys, who, according to published reports, were defending their property and safety. As Missouri’s Chief law enforcement officer, I won’t stand by while Missouri law is being ignored,” Schmitt said.

    The brief filing says the attorney general “respectfully requests that the Court dismiss this case at the earlier possible opportunity.”

    McCloskeys' attorney says Gardener's staff altered evidence

    In Missouri, police and prosecutors must prove that a weapon is “readily” capable of lethal use when it is used in the type of crime with which the McCloskeys have been charged.

    [B]Assistant Circuit Attorney Chris Hinckley ordered crime lab staff members to field strip the handgun and found it had been assembled incorrectly. Specifically, the firing pin spring was put in front of the firing pin, which was backward, and made the gun incapable of firing, according to documents obtained by 5 On Your Side.

    Firearms experts then put the gun back together in the correct order and test-fired it, finding that it worked, according to the documents

    Patricia McCloskey and her husband, Mark McCloskey, have said the handgun Patricia McCloskey waved at protesters was inoperable because they had used it as a prop during a lawsuit they once filed against a gun manufacturer. In order to bring it into a courtroom, they made it inoperable.

    Their attorney, Joel Schwartz, confirmed to 5 On Your Side that the McCloskeys intentionally misplaced the firing pin on the gun and that it was in that condition when Patricia McCloskey waved it at protesters and turned it into their former attorney Al Watkins.

    “It’s disheartening to learn that a law enforcement agency altered evidence in order to prosecute an innocent member of the community,” Schwartz said.

    A spokeswoman for Gardner wrote: "We can't comment on a pending case."
    There is no reference to the operating condition of the gun in the probable cause statement police wrote on the case. The only reference to it is contained in the charging document with Hinckley’s name on it....

    In all fairness that couple is showing extremely bad handling of weapons esp. poor muzzle discipline. Your barrel should never be pointing out at people but at the ground, like a soldier does. You'd be kicked off the range for sweeping a muzzle like that.

    Kind of a sick feeling knowing that we have to be on the same side of an issue and defend these two BLM supporting anti-gun hypocrites.

    Perhaps some fast acting diabetes will resolve this to everyone's satisfaction.
