    A Trump campaign staffer, James Xing, died in Marion, Iowa, on Thursday night, the Republican party said. Sources with knowledge of the situation told CBS News that Xing was found dead in his home on Friday morning and foul play was not suspected in the case. Xing served as Trump campaign Regional Field Director in the Cedar Rapids area. "Last night we tragically lost a member of our team," Republican National Committee chairwoman Ronna McDaniel said in a statement to CBS News. "James is in our hearts, our minds and our prayers as we grieve with those who are suffering today." Xing's Twitter feed shows that he had previously worked for the Trump campaign in Nevada. One tweet shows him at a campaign event in Las Vegas. Xing was 29 years old and is survived by his parents. A spokesperson for the Marion Police Department said they are not releasing any information regarding the case at this time.     Bulgaria expelled two Russian diplomats who prosecutors suspect were involved in espionage and gave them 48 hours to leave the Balkan country, the foreign ministry said on Friday.EU and NATO member Bulgaria, which traditionally keeps close links to Russia, expelled another diplomat over espionage allegations in October and declined to grant a visa to Russia's incoming defense attache. The Russian Embassy in Sofia said the two diplomats would leave Bulgaria, but Moscow reserved its right to respond to their expulsions. The embassy said Sofia had handed diplomatic notes to the ambassador without providing any proof that the two had acted in a way incompatible with their status. Earlier on Friday Foreign Minister Ekaterina Zharieva said the two would most likely be expelled after the foreign ministry was informed about the prosecutors' allegations. "We will undertake the action that we are obliged to undertake and will most probably declare them 'persona non grata'," she said. In a separate statement, prosecutors said that a first secretary at the consular section of the Russian embassy had been involved in espionage since 2017, seeking information about the electoral process. A second diplomat, serving at Russia's commercial representation office in Sofia, had been collecting information on energy and energy security since October 2018, some of which were state secrets, prosecutors said.     Lead House impeachment manager Rep. Adam Schiff (D-CA) argued less than a year ago in the Washington Post that a president had a duty to investigate a candidate from the rival party if he was suspected of foreign corruption. Schiff, reacting to Special Counsel Robert Mueller’s report on “Russia collusion,” justified the Barack Obama administration’s counterintelligence investigation of the Trump campaign, and said Mueller should have included it. Schiff wrote that investigating a potential president — even from the opposition — was an urgent matter of national security if there were reason to believe that candidate were working for, or beholden to, a foreign country. He wrote (emphasis added): Counterintelligence investigations differ from criminal investigations in their means, scope and ultimate disposition. Their goal is not successful prosecutions, but to identify and mitigate threats to national security. If a foreign power possessed compromising information on a U.S. government official in a position of influence, that is a counterintelligence risk. If a foreign power possessed leverage, or the perception of it, over the president, that is a counterintelligence nightmare. Schiff added that the public deserved to see the material that the FBI found on the Trump campaign. (We know today that the FBI lied to the FISA court to obtain surveillance warrants on a Trump aide.) Today, Schiff and the Democrats are arguing that it is an impeachable offense for a president to investigate foreign corruption by a potential president from the opposition — even when, as in the Bidens’ case, former Vice President Joe Biden had a clear conflict of interest while his son, Hunter, was on the board of Ukrainian company Burisma. According to Schiff just last April, it is not an impeachable offense, but an urgent matter of national security for a president to investigate his potential successor. It is the president’s duty. That is, unless the president is Donald J. Trump.

    This short essay does what the House Judiciary Committee’s panel of “expert witnesses” did not successfully do. First, it explains the meaning of the Constitution’s “high Crimes and Misdemeanors” standard. Next, it discusses how that standard applies to President Donald Trump’s interactions with Ukrainian President Volodymyr Zelensky. Finally, it details the kind of evidence the House Judiciary Committee should gather to determine whether the president committed an impeachable offense. Many phrases in the Constitution—such as “necessary and proper,” “Privileges and Immunities,” and “Convention for proposing Amendments”—carry specialized 18th century meanings not obvious to the modern reader. Recall that most of the leading Founders were lawyers and the Constitution is a legal document. Some of these phrases derive from 18th century law. Therefore, to understand them you have to consult 18th century legal materials in addition to better-known sources such as the 1787 convention debates or the Federalist Papers. Unfortunately, most of the scholars called by the House Judiciary Committee to address the meaning of “high Crimes and Misdemeanors” were not able to do so accurately. According to the authoritative Westlaw database, two of the three Democratically appointed witnesses have published no scholarly work on impeachment: Their specialties are in other areas. None showed any familiarity with 18th century fiduciary standards—which (as explained below) are part of the law of impeachment. All of the witnesses voted against President Trump, and several have been involved in anti-Trump activity. It’s not surprising, therefore, that, except for professor Jonathan Turley’s heavily footnoted 53-page written statement, the testimony was biased and superficial.
