    The Environmental Protection Agency has asked the Justice Department to investigate allegations that U.S. environmental groups have received covert funding from China and Russia. EPA administrator Andrew Wheeler made the request after Rep. Lance Gooden (R., Texas) alleged that left-wing environmental groups—including the Sea Change Foundation, Sunrise Movement, and Sierra Club—have functioned as conduits for "foreign influence, financial involvement, and election interference." Wheeler noted that it is not against the law for a nonprofit to take contributions from foreign entities but nonetheless asked the DOJ to look into whether the groups should register as foreign agents. "Given heightened concerns that foreign countries, primarily China and Russia, are potentially funding U.S.-based ‘green' groups to undermine American energy independence and to help maintain the integrity of the EPA's decision-making, EPA will refer this matter to the DOJ Unit," Wheeler said. "The DOJ can then determine what appropriate steps to take, if any, including whether those entities should be registered as foreign agents." Gooden's allegations follow calls from other Republican lawmakers to investigate the anonymous funding of green groups for potential foreign influence. In September, Rep. Liz Cheney (R., Wyo.) asked the DOJ to investigate whether Russia and China are working to infiltrate environmental groups as a way of influencing U.S. policy. Barrett sent a powerful signal in her dissent last year in Kanter v Barr in the Seventh Circuit Court of Appeals, where she argued that non-violent felons should not lose their right to acquire arms, as currently required by law, though she is fine with felons losing their right to vote. Her dissent put her to the right of dozens of Republican-appointed judges across the country who have upheld the prohibition on felons having guns, and even to the right of her mentor, the late Justice Antonin Scalia.     The latest survey of consumers from the University of Michigan — its “Preliminary Results for October 2020” — just released showed “gains in economic prospects for the year ahead,” according to its authors. And that’s just the beginning of the reports issued last week and those coming this final full week before election day. In September its Index of Consumer Sentiment was 80.4; a month later it is 81.2. Its Index of Consumer Expectations for September was 75.6; for October it’s 78.8. When the results are broken down by political party, “Trump still held an advantage over Biden,” the same advantage he held in September, according to the UMich survey. The “flash” (preliminary) output, services, and manufacturing indices from the data firm IHS Markit on Friday each showed 20-month highs, with its author reporting: “U.S. output growth regained growth momentum in October, as business activity rose at the fastest rate for 20 months, and business optimism improved markedly. The upturn was largely driven by service providers, though manufacturing firms also reported a further solid increase in production.” Chris Williamson, chief business economist at IHS Markit, added:

    Issued on: October 21, 2020 By the authority vested in me as President by the Constitution and the laws of the United States of America, including sections 3301, 3302, and 7511 of title 5, United States Code, it is hereby ordered as follows: Section 1. Policy. To effectively carry out the broad array of activities assigned to the executive branch under law, the President and his appointees must rely on men and women in the Federal service employed in positions of a confidential, policy-determining, policy-making, or policy-advocating character. Faithful execution of the law requires that the President have appropriate management oversight regarding this select cadre of professionals. The Federal Government benefits from career professionals in positions that are not normally subject to change as a result of a Presidential transition but who discharge significant duties and exercise significant discretion in formulating and implementing executive branch policy and programs under the laws of the United States. The heads of executive departments and agencies (agencies) and the American people also entrust these career professionals with non‑public information that must be kept confidential. With the exception of attorneys in the Federal service who are appointed pursuant to Schedule A of the excepted service and members of the Senior Executive Service, appointments to these positions are generally made through the competitive service. Given the importance of the functions they discharge, employees in such positions must display appropriate temperament, acumen, impartiality, and sound judgment. Due to these requirements, agencies should have a greater degree of appointment flexibility with respect to these employees than is afforded by the existing competitive service process. Further, effective performance management of employees in confidential, policy-determining, policy-making, or policy-advocating positions is of the utmost importance. Unfortunately, the Government’s current performance management is inadequate, as recognized by Federal workers themselves. For instance, the 2016 Merit Principles Survey reveals that less than a quarter of Federal employees believe their agency addresses poor performers effectively. Separating employees who cannot or will not meet required performance standards is important, and it is particularly important with regard to employees in confidential, policy-determining, policy-making, or policy-advocating positions. High performance by such employees can meaningfully enhance agency operations, while poor performance can significantly hinder them. Senior agency officials report that poor performance by career employees in policy-relevant positions has resulted in long delays and substandard-quality work for important agency projects, such as drafting and issuing regulations.
