The Fourth Amendment Gets Its Own House Caucus to Demand Its Respect
Coalition of 25 bipartisan lawmakers organizes against unwarranted surveillance and data collection.

    Scott Shackford
    Jul. 14, 2016 3:30 pm

Does Congress actually need a special caucus to advocate on behalf of a civil liberty that is spelled out in the Constitution's Bill of Rights?

For 25 lawmakers in the House of Representatives, when it comes to the Fourth Amendment, the answer is increasingly "yes." On Wednesday, the Hill saw the formal launch of the Fourth Amendment Caucus, a bipartisan coalition (nearly evenly divided between the two parties) of those who are concerned about the degradation of the right of Americans to protect their communications and personal information from unwarranted government searches.

    ...

Two of the House members who were vocal about stopping that Patriot Act expansion, Reps. Justin Amash (R-Mich.) and Thomas Massie (R-Ky.), are members of this new Fourth Amendment Caucus. The caucus was the brainchild of Rep. Ted Poe (R-Texas) a strong supporter of requiring better citizen privacy protections and for the NSA and feds to respect the restrictions the Fourth Amendment puts in place when investigating crime and terrorism. Poe asked Rep. Zoe Lofgren (D-Calif.) to help chair the caucus. Lofgren recently worked with Massie to attempt to pass legislation to try to force the feds to get warrants to access collected data on American citizens. Their efforts failed. The two are also strong voices in trying to protect tech companies from federal efforts to force them to make "back doors" in their software or otherwise weaken their encryption to assist authorities in investigations.

Other members of Congress known for speaking out on the Fourth Amendment are also on the caucus. Rep. Jared Polis (D-Colo.), who has been trying to change federal law to require warrants to access old emails, is on the caucus. Rep. Ted Lieu (D-Calif.), who blatantly once told a district attorney with a dim view of encryption to "follow the damn Constitution," is in the caucus. Rep. John Lewis (D-Ga.), himself once a target of federal surveillance during the civil rights movement, is in the caucus.

Government thrives on the threat of violence and/or the initiation of violence. Naturally such an institution will attract individuals and groups that will want to steer that violence in their favor and in the favor of friends.

This setup creates resentment amongst the victims of government violence. People themselves resort to using aggressive force against others. After all, if the government can do it, why can't they? An unfair justice system only adds fuel to the fire.

Then you have to consider the perpetual war that the U.S. government has subjected us to. Add to that an FCC-licensed media that sensationalizes and glorifies war. Ultimately, you end up with an entire culture of violence.

Professional demagogues are provided with a population ready for to hear that they are victims. Responsibility for ones own-self and actions are replaced with the temptation of identifying with a group or collective. Instead of using your mind to shape your own world, the siren song of the demagogue, and the abundance that is promised, become too hard to resist.

Only the adoption of a different set of ideas has the ability to turn around a culture of violence and victimization. If you and I are not allowed to rob our neighbor, the government should not be allowed to do it either. If you and I are not allowed to use aggressive force against our fellow man, neither should the government be granted immunity either.

The more that people decide to live by the non-aggression principle, the faster society would heal. Transactions, exchanges, trades and contracts should all be done voluntarily. Government violence should never be introduced to tilt the tables one way or another.

Once again, if government violence is introduced, resentment creeps in and a cycle of fighting to get in control of government force takes over.

The answers exist, and they're found in the ideas of liberty.

28 pages on alleged Saudi ties to 9/11 to be released as soon as Friday

By Jim Sciutto and Deirdre Walsh, CNN
    Thu July 14, 2016

(CNN) The long-classified pages detailing alleged ties of the Saudi Arabian government to the 9/11 hijackers will be released by Congress as early as Friday, sources told CNN Thursday.

Known as the "28 pages," the secret document was part of a 2002 congressional investigation of the Sept. 11 attacks and has been classified since the report's completion. It turns out there are actually 29 pages, sources said.

Sources said there are still some procedural steps that need to be taken before the release, which members of both parties in Congress and family members of victims have been seeking for years.

"This is great news," said Jerry Goldman, a lawyer who represents families of victims in a class-action suit, seeking to sue Saudi Arabia. "The families are happy just as the American people should be happy that information that has been kept hidden for well over a decade is finally coming to light."

Former Senator Bob Graham, who chaired the committee that carried out the investigation and has been pushing the White House to release the pages, said Thursday he was "very pleased" by the news.

"It is going to increase the questioning of the Saudis' role supporting the hijackers," Graham told CNN. "I think of this almost as the 28 pages are sort of the cork in the wine bottle. And once it's out, hopefully the rest of the wine itself will start to pour out."

Yes, the globalist elites have definitely been challenged, but the British now have a golden opportunity in front of them. What they do now is of great importance. If Britain were to restore maximum liberty to individuals, free up their markets and lower their taxes, the country could experience a cascade of prosperity. Those who live on government largesse would surely oppose such policies, but the opportunity is there. Will the British take it? More below:

New Hampshire became the latest state to roll back civil forfeiture, which allows law enforcement to seize and keep property without ever filing criminal charges. Under legislation signed by Gov. Maggie Hassan on Friday, the Granite State is now the 11th state to require criminal convictions as a prerequisite in most or all forfeiture cases. The legislation, SB 522, also raises the standard of proof to “clear and convincing evidence,” which will better protect property owners in court. In addition, SB 522 requires the attorney general to provide “detailed accounting” of grants made through the state’s drug forfeiture fund. The signing of SB 522 means New Hampshire is the eighth state to have reformed its forfeiture laws in 2016.

“Civil forfeiture is one of the most serious assaults on due process and private property rights in America today,” Rob Peccola, an attorney at the Institute for Justice, said in a statement. “Under this new law, only convicted criminals—and not the innocent—will lose their property to forfeiture.”

Unfortunately, while SB 522 is a welcome step in the right direction, it does not end law enforcement’s appalling incentive to profit from forfeiture cases. Under state law, once a property is forfeited, local agencies can keep 45% of the proceeds, while an additional 45% is funneled to the state’s drug forfeiture fund. (The remaining 10% is deposited into a separate account run by the New Hampshire Department of Health and Human Services.) Just over $1.15 million has been forfeited through state law from 1999 to 2013, a 2015 report by the Institute for Justice found.

In April, I touted candidate Rebekah Johansen Bydlak (disclosure: Bydlak is a friend and former Rare contributor), who’s running for an open seat in Florida’s 1st Congressional District. I said Bydlak was a constitutional conservative in the mold of senators like Rand Paul and Mike Lee, and congressmen like Justin Amash and Thomas Massie. Bydlak has already received the support of Rep. Amash.

Now she’s earned the endorsement of the original liberty congressman.

“I am pleased to endorse Rebekah Bydlak for Congress,” Ron Paul said in a statement Tuesday. “Rebekah’s commitment to, and experience in advancing, the principles of liberty show that she is the type of leader the GOP, Florida, and the country need.”

Ron Paul’s popular 2008 and 2012 presidential campaigns helped create a liberty movement within the Republican Party that has helped elect many of the tea party-friendly leaders in Congress, as well as inspiring countless activists.

“I am thrilled and honored to be endorsed by the godfather of the Tea Party,” Bydlak said of Paul’s endorsement. “Ron Paul’s name has become synonymous with the defense of the Constitution and reducing the size of government,” Bydlak said.

The intellectual battle for liberty can appear to be a lonely one at times. However, the numbers are not as important as the principles that we hold. Leonard Read always taught that "it's not a numbers game, but an ideological game." That's why it's important to continue to provide a principled philosophy as to what the role of government ought to be, despite the numbers that stare us in the face. I discuss with John Stossel:

This morning I was asked if there was ever an ideal American president. Of course, no one is perfect, but I particularly liked Grover Cleveland who was a gold-standard guy. He was also a non-interventionist when it came to foreign policy and he vetoed a lot of bills.

My biggest issue with the modern presidency is the amount of power that the position wields. Today's president is the exact opposite of what the Founders intended. There were supposed to be "checks and balances" in our government and the office of the president was not designed to run a worldwide military empire.

If there's one recurring pattern that has repeated itself throughout history, it's that there's a great tendency for power to concentrate in the executive. America's Founders tried to figure out a way to avoid such a concentration of power, but alas they failed as well.

Power is now more concentrated in the President than ever.

I'd like for the American president to have about as much power as Switzerland's president. Few even know who Switzerland's president is! That's the way it's supposed to be.

The Anti-Pot Editorial That Cost $140 Million
After an ardent prohibitionist bought Nevada's leading newspaper, a formerly libertarian editorial board suddenly turned against marijuana legalization.

    Jacob Sullum
    June 13, 2016

In May 2014, when activists began collecting signatures for a marijuana legalization initiative that will appear on Nevada's ballot this November, the Las Vegas Review-Journal welcomed the measure as "an opportunity to reset America's costly drug war." The paper's editorial board said "taxpayers finally seem to understand that spending vast sums of money at the local, state and federal levels on police, prosecutors, public defenders, judges and jails to lock up nonviolent offenders and enable the enrichment of gangs and thugs has done nothing to diminish demand for marijuana."

Last Wednesday the Review-Journal came out against the very same ballot initiative, saying "recreational weed comes with health, safety and social costs that make legalizing marijuana a dangerous proposal for Nevadans." It warned that "legalizing weed would jeopardize the health of countless Nevadans, expose more people to drug abuse and addiction, put excessive stress on the state's health-care facilities and do little to relieve the state's bloated prison population."

Sheldon Adelson, the billionaire casino owner and Republican megadonor, paid good money for that startling reversal, which was first noted by Tom Angell at Marijuana.com. Adelson, an ardent pot prohibitionist who bankrolled the opposition to a 2014 medical marijuana initiative in Florida that fell two points short of the supermajority required to pass a constitutional amendment, bought the Review-Journal last December for $140 million. That's 25 times what Adelson spent to defeat Amendment 2 in Florida, where he hopes to open a casino, but still just 0.5 percent of his fortune at the time, which Forbes pegged at $28 billion, making him the world's 18th richest person.

    Thread Starter: Tywysog Cymru
