(This was discussed in another recent thread but I think it demands much more immediate attention.)

The South Carolina Primaries scheduled to take place today are in clear violation of the S.C. Constitution. In other words, they are completely illegal and their results should be null and void.

All elections by the people shall be by secret ballot, but the ballots shall not be counted in secret.
- South Carolina Constitution, Article II Section I

We need people to write e-mails to ALL of the campaigns, media, and relevant local officials demanding that the election conform to the constitution of South Carolina. Here is a letter I wrote up, please feel free to use it. Just fill in the blank with the name of the person or company you are e-mailing.


As a citizen of the United States, I am requesting that _______ take legal action to prevent unconstitutional primaries from taking place in South Carolina on Saturday, Jan 19, 2008. Article II Section 1 of the S.C. Constitution clearly states "the ballots shall not be counted in secret." The electronic voting machines scheduled to be used in for the primaries are therefore an illegal means of counting the votes, because the counting is done "in secret" by proprietary software inside the machines, not in public view. There is no integrity to these elections whatsoever.

_______ must take a stand against this illegal election immediately and stand up for our rights and the rule of law. We The People will not accept the illegal results of an unconstitutional election.

Not a single taker? As far as I know this information just came out, and it is black and white evidence that the vote is fraudulent. We need to keep the pressure for fair elections on now and make it a big issue. We can canvass and donate all we want... if the machines count the votes in half the country we will lose.

I'm pretty sure that an election done within a party is not required to be done within the rules of a general government election. A party has the right to choose its nominee how they wish, as far as I think.

yes with some exception (law suits, specific state laws passed, etc) these party events are unregulated - you could create your own 'kangaroo party' and decide your parties nominee by virtue of the winner of a turtle race if you felt like it ...

RIGHT OF SUFFRAGE

SECTION 1. Elections to be by secret ballot; protection of right of suffrage.

All elections by the people shall be by secret ballot, but the ballots shall not be counted in secret. The right of suffrage, as regulated in this Constitution, shall be protected by laws regulating elections and prohibiting, under adequate penalties, all undue influence from power, bribery, tumult, or improper conduct.

I'm pretty sure that an election done within a party is not required to be done within the rules of a general government election. A party has the right to choose its nominee how they wish, as far as I think.

I think you are right, it probably only applies to the elections in November.
