I believe it was the interest of the Founding Fathers to create a nation, not a confederation of states. They tried that once before and it failed. Communism would be pretty nifty if it worked too. The Founding Fathers realized that idealism needs to be grounded by practicality, or else we would end up with just another confederation destined to fail.


Thus the Emancipation Proclamation, which purported to free all of the slaves, applied only to those states “in rebellion against the United States.”
As Commander-in-chief, the Emancipation Proclamation, legally, could only go into effect in the states at war with the Union. That is the best example of upholding the Constitution in that entire war. A presidential proclamation holds no force of law, and therefore is not entitled to be enforced. But, because the abolishment of slavery would be an economically-crippling tactic, he was authorized to enforce it in the south as a military tactic to win the war.
