A 39-year-old Superior man was jailed this weekend for allegedly assaulting a 13-year-old boy he believed, according to one witness, had disrespected the national anthem.

Curt James Brockway was arrested by Mineral County Sheriff's deputies around 11 p.m. Saturday. Montana Department of Justice records show he is registered as a violent offender. Brockway made his initial appearance in Mineral County Justice Court on Monday, and was scheduled to be released on his own recognizance on Tuesday.

Taylor Hennick was at the Mineral County Fair and Rodeo on Saturday, and told the Missoulian she had just stopped at the entrance to the fairgrounds in Superior to pause for the national anthem when she heard a "pop."


"There was a little boy lying on the ground," she said. "He was bleeding out of his ears, seizing on the ground, just not coherent." She said she recognized the boy as a family member's neighbor.

A press release from Mineral County Sheriff Mike Boone stated the boy is 13.


Hennick said the man, who she had by then identified as Brockway, tried justifying the assault as bystanders moved in on him Saturday evening.

"He said (the boy) was disrespecting the national anthem so he had every right to do that," Hennick said.

Montana Department of Corrections records show Brockway, born in 1980, is serving a 10-year probation sentence for an assault with a weapon charge in 2010.

Brockway's arraignment has been set for Aug. 14 at 10 a.m., with District Judge John Larson presiding.

Man charged with assaulting 13-year-old who didn't remove hat during national anthem

A Montana man was charged with assault after allegedly throwing a 13-year-old boy to the ground at a county fair because he believed the teenager was "disrespecting" the national anthem.

The Missoulian reports that Curt Brockway was arrested Saturday at the Mineral County Fair and Rodeo after he allegedly slammed the teenager to the ground when the 13-year-old didn't remove his hat when the anthem played.

A witness at the event told the news outlet that Brockway justified the alleged assault by saying the teenager was disrespecting the national anthem.

"He said (the boy) was disrespecting the national anthem so he had every right to do that," Taylor Hennick told the news outlet.

Local CBS affiliate KPAX reported that witnesses said the boy did not remove his hat during the anthem, prompting the alleged assault.

Mineral County Sheriff Mike Boone said in a news release that Brockway was detained at the fair and is facing charges of assault on a minor, a felony in Montana.

Brockway was scheduled for release Tuesday morning, with his arraignment scheduled for next week.

The parents of the child said he was hospitalized and bleeding from his ear for hours after the incident that left him with temporal skull fractures.

He was released from the hospital and has since returned home to continue his recovery.

"His commander in chief is telling people that if they kneel, they should be fired, or if they burn a flag, they should be punished," Jasper said. "He certainly didn't understand it was a crime."

Trying to put together an insanity defense I suppose...

It wouldn't be at all surprising if the new jingoism motivated him, but color me skeptical that he didn't realize "choke-slamming" a kid was a crime.

I just think its outrageous that people are allowed to wear a hat during the national anthem at all.

There should be a law to force people to respect the anthem and the freedom that it represents.

In a video posted by the Miami Herald, Trump is waving his hands like a conductor, adjusting his chair, looking around, greeting guests — all while those around him, including his wife, Melania, stand with their hands over their hearts.

The Herald pulled the video from an Instagram story posted by a real estate agent for a Russian-American firm that frequents Mar-a-Lago.The White House and the Trump Organization did not respond to requests for comments from the paper, which sent along copies of the video.

But the president has made his stance clear before, telling Fox & Friends in 2018 that “You have to stand, proudly, for the national anthem or you shouldn’t be playing. You shouldn’t be there. Maybe you shouldn’t be in the country.”

There should be a law to force people to respect the anthem and the freedom that it represents.

Many many many years ago I saw a skit at Chicago's Second City comedy club. It started with six people sitting in chairs facing the audience. An offstage voice said, "Ladies and Gentlemen, our National Anthem." Five of the six stood up with their hands on their hearts and began singing the anthem while the other remained seated. The ones standing gently motioned the guy sitting to stand up but he remained quietly in his chair. Gentle nudges turned to sharp elbows which turned into tugging to try to get the guy to stand. Finally, they yanked him out of his seat, threw him to the ground, and began beating the crap out of him. And when they sang the line "O'er the land of the free..." Blackout.

The irony will no doubt be lost on the politically correct authoritarians here.
