I'm a little confused.

Let's say I lived in a state where cannabis was illegal.

Let's say I drove down the street smoking a rolled tobacco cigarette that looked like a joint.

Let's say a cop pulled me over.

Let's say I threw the cigarette out the window.

Let's say it is not a crime to throw cigarettes out the window in this state.

Let's say the cop was able to charge me with obstruction of justice because I threw what looked like a joint out of the window.

Would those charges still hold if it turns out the joint was actually a cigarette, and I didn't do anything illegal?

I'm just curious how, or why, if Trump is exonerated of conspiring with Russia, he could obstruct justice? If you don't commit a crime in the first place, how can you possibly obstruct justice?

I mean, let's say you had a witness in the car who saw you throw the cigarette out the window. Let's say you told them if they don't testify that it was a cigarette, that you are going to slap them upside the head. Is that tampering with a witness? If you tell a witness to tell the truth and there was no crime committed?

It just seems like the only reason to go after Trump for obstruction of justice would be if you dislike Trump and want to see him out of office.
