View Full Version : Trump issues fewest regulations ever, 'Unconstitutionality Index' reaches record low

President Trump has made good and then some on his pledge to slash costly federal regulations, issuing the fewest new rules (https://cei.org/sites/default/files/Ten_Thousand_Commandments_2018.pdf) in recorded history in his first two years, according to a new analysis. In fact, the efforts by the White House, Office of Management and Budget (https://www.reginfo.gov/public/do/eAgendaEO13771), and several agencies to cut and reduce the flow of regulations this year have only ever been topped once: by the same Trump team last year.
“At year-end 2018, how is President Donald Trump’s regulatory reform project going? Better than Obama, Bush II, and Clinton in terms of fewer regulations; but not as good as Trump’s own first year,” said the Competitive Enterprise Institute. CEI regulations guru Clyde Wayne Crews Jr. (https://cei.org/expert/clyde-wayne-crews) said in a year-end report provided in advance to Secrets that Trump ended the year with 3,367 new regulations. That is the lowest since records were first kept in the 1970s (https://cei.org/sites/default/files/Ten_Thousand_Commandments_2018.pdf).
But Crews noted that Trump’s number of new regulations is lower. The reason: the government requires a “regulation” to kill a regulation, and Trump is continuing on his promise to kill two regulations for every new one he proposes.
“Obama’s own lowest count was 3,410, not much more than Trump’s new score. But fewer of Obama’s rules would be expected to have been devoted to rollbacks of prior initiatives, the emphasis of Trump’s ‘one-in, two-out’ executive order,” said Crews, CEI’s vice president for policy.
“The Federal Register closed out 2018 with 3,367 final rules in all. The only lower count was 3,281 under Trump a year ago, which was the lowest count since records began being kept in the mid-1970s,” he added.
Federal Register pages are also way down, winning praise from corporate America and consumers.

Former President Barack Obama’s high was 95,894 in 2016, as he was rushing through new rules before Trump took office. However, both both former Presidents George W. Bush and Bill Clinton had lower pages published in some years than Trump.
In what Crews has dubbed the “Unconstitutionality Index,” (https://cei.org/blog/2019-unconstitutionality-index-12-federal-agency-rules-every-law-congress-passes) Trump has has also slashed the percentage of new rules to new laws passed by Congress and signed by Trump, he wrote in a second report issued Monday.
Trump’s 2018 index was 12: 3,367 new rules compared to 291 new laws.
The Index reached 29 under Obama.

Yea Constituionalist freedoms are pretty high right now thanks to MAGA and drop in Patriot Act spending but no need to be complacent though, you need a bold Constituional defender like MAGA to be kept in power for at least two terms to guard against anti-liberty regulation regime of Chuck and Nancy (sometimes called big spender/debt expander Chancy anti-Constituionalists).

Whitaker Announces Justice Department Rescission of 69 Guidance DocumentsFriday, December 21, 2018


Acting Attorney General Matthew Whitaker today announced that, pursuant to President Trump’s Executive Order 13777 and the Department of Justice’s November 2017 memorandum (https://www.justice.gov/opa/pr/attorney-general-jeff-sessions-ends-department-s-practice-regulation-guidance) ending the practice of regulation by guidance, the Department is rescinding 69 additional guidance documents that are unnecessary, outdated, inconsistent with existing law, or otherwise improper. In making the announcement, Acting Attorney General Whitaker said:
"Under the Constitution, Congress writes our laws and the Executive Branch carries them out," Acting Attorney General Whitaker said. "Congress has given us a specific process for implementing regulations, and we have to follow it. Unfortunately, not every previous Administration has done that, and some have overstepped their lawful authority by issuing guidance documents that impose new obligations on parties outside of the Executive Branch and go further than existing law allows. The Trump Administration has already rescinded dozens of guidance documents that were improper, outdated, unnecessary, or inconsistent with current law, and today we are rescinding dozens more. We will continue this effort to restore the rule of law and our constitutional order because this government is accountable to the American people.”
In March 2017, President Donald Trump issued Executive Order 13777, (https://www.gpo.gov/fdsys/pkg/FR-2017-03-01/pdf/2017-04107.pdf?utm_medium=email&utm_source=govdelivery) which calls for agencies to establish Regulatory Reform Task Forces, chaired by a Regulatory Reform Officer, to identify existing regulations for potential repeal, replacement, or modification. Principal Deputy Associate Attorney General Jesse Panuccio chairs the Department of Justice Task Force, which is continuing its review of existing guidance documents that should be repealed, replaced, or modified.
The Task Force identified 25 guidance documents (https://www.justice.gov/opa/pr/attorney-general-jeff-sessions-rescinds-25-guidance-documents) for repeal in December 2017, 24 guidance documents (https://www.justice.gov/opa/pr/attorney-general-jeff-sessions-rescinds-24-guidance-documents) for repeal in July 2018, and has identified 69 more documents to announce for repeal this month.
