View Full Version : Women Outed By Heitkamp Campaign As Domestic Violence Victims Are Looking To Sue Campaign

After North Dakota Democratic Sen. Heidi Heitkamp’s campaign publicly named (https://www.foxnews.com/politics/heitkamp-apologizes-for-naming-sexual-assault-abuse-victims-in-newspaper-ad) some women as victims of domestic violence without the women’s consent or knowledge, some of the women have announced they are getting ready to sue the campaign.
CNN reported (https://www.cnn.com/2018/10/16/politics/heitkamp-apologizes-sexual-assault-survivors/index.html), “The misstep has led some women misidentified in the ad to decry the Democratic candidate and question how their names landed on the list, with one group of women saying they are seeking ‘a lawyer who will take our case’ because the ad has ‘interfered with, or downright ruined, our lives.’”
Three of the women, Shylah Forde, Megan Stoltz and Alexandria Delzer, gave a statement to CNN from a group of over one dozen women who were named by the campaign. The statement read:

Heidi Heitkamp's political agenda has interfered with, or downright ruined, our lives. Survivors of assault who had taken care to avoid the subject were suddenly bombarded by questions asking them to explain to their loved ones why their name appeared on this list. Women who have never been assaulted spent the day reassuring loved ones of their safety.
The women added that their "privacy was violated on this day" so they have started a "search for a lawyer who will take our case."

Amid reports that some of the women now fear retaliation (https://www.dailywire.com/news/37301/awful-sex-assault-victim-named-heitkamp-ad-says-emily-zanotti) from their abusers and some are taking legal action (https://www.dailywire.com/news/37228/women-outed-heitkamp-campaign-domestic-violence-hank-berrien) against Heitkamp for publicly outing them without their permission or knowledge, the embattled senator ran a brief apology in the Minot Daily News that may come back to haunt her.
In a piece for the Say Anything Blog, Rob Port (http://www.sayanythingblog.com/entry/heitkamp-ad-apologizing-for-outing-sexual-assault-victims-may-have-violated-fec-rules/) explains why that ad might prove to be an additional problem for the senator: it fails to provide the FEC-required disclaimer listing the ad as paid for by the Heitkamp campaign.

The FEC requires all campaign-related public communications to include a disclaimer telling the audience that it was paid for by the campaign (see full requirements below).
Port reached out the Minot Daily News to see if the ad was indeed paid for by the Heitkamp campaign; the paper said yes. "It was paid for by the campaign committee and it came to us through NDNA [North Dakota Newspaper Association]," Dan McDonald, the paper's publisher, told Port Friday.
"It would seem this apology ad, which has already been criticized for being tiny compared to the full-page size of the original ad being apologized for, also runs afoul of FEC rules," writes Port.

North Dakota Democratic Senator Heidi Heitkamp is reportedly in hot water after she released someone else’s information without their consent on Tuesday.
In a Facebook post Tuesday night, Heitkamp shared her experience meeting Lynn Aas, a World War II veteran. The senator was in attendance for when Aas was presented with “the French Legion of Honor award for his service in France.” The post goes on to describe his service during WWII and him continuing his education in North Dakota.
The post was deleted on Wednesday evening.

“Lynn is not happy that Heidi did this. We have posted a comment requesting that it be taken down,” David Aas, Lynn’s son, told Rob Port (https://www.sayanythingblog.com/entry/wwii-veteran-says-senator-heidi-heitkamp-is-using-his-image-without-permission/) on Wednesday. “Lynn wants to make it clear that no one from the Heitkamp campaign contacted him to ask for permission for this, and he does not want this to be viewed as an endorsement of her campaign.”
